REGULATING PUBLIC UTILITIES, INSTALLATION OF SUCH SYSTEMS, ADDITIONS
TO, REPLACEMENTS THERETO, OR MAINTENANCE '!HERETO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
Section 1. That no persons, firms or corporations shall in any way
disturb, dig into or cut the surface of any street or alley in the
City of Schertz, Texas, for the location of driveways, electric lines,
gas lines, any manner of utilities or any other purpose without first
securing a permit from the City Secretary of the City of Schertz, Texas.
Section 2.
Any person, firm or corporation seeking to disturb in any
manner the surface of the streets or alleys of Schertz shall, prior to
commencement of such activities, file with the City of Schertz, Texas,
complete plans for such excavations or other work that is intended to
be accomplished and plans for restoring the surface of such street or
alley after such excavation or other work is completed. If such plans
are satisfactory and include proper provisions for restoration of the
surface of such street or alley to the same condition it was in prior
to commencement of such work, the City Secretary upon payment of a fee
of $ ~tCby such person, firm or corporation shall issue a permit to
such applicant for the work in question to be done. Such permit will
contain cost of construction and all work authorized under the permit
must be completed within ninety (90) days after the receipt of such per-
mit or the same shall be void.
Section 3.
Any person, firm or corporation which has received a permit
for excavation or other work in the streets or alleys of the City of
Schertz, Texas, shall be required to restore the surface of such street
or alley in accordance with the requirements and specifications of the
City Engineer of the City of Schertz, Texas. In the event that the City
of Schertz, Texas, shall be required to perform any work in connection
with the restoration of the surface of such street or alley, the same shall
be paid by the person, firm or corporation securing such permit.
Section 4.
The City will provide an inspector to inspect the progress
of all such work in the streets or alleys while the same is in progress
and the said City of Schertz, Texas, spall~be r~imbu~sed at the r~te of

Section 5.
All streets on which work is being performed by any person,
firm, or corporation subject to the terms of this ordinance, shall be left
in such condition to allow such streets to remain open for traffic at night
and at all other times unless 24 hours notification is given the police
department and the fire department of the City of Schertz, Texas. No public
street in said city shall be barricaded or closed by any person, firm, or
corporation without the ..~ .~ consent of the police department and fire
department of the City of Schertz, Texas.
Section 6.
Persons, firms or corporations that maintain utilities dis-
tribution systems or other permanently installed service systems within the
City of Schertz shall maintain current "as built" plans on file with the
City Secretary at all times.
Section 7.
An inspector furnished by the City of Schertz, Texas, shall
supervise any and all trimming of trees, shrubs, or other foliage performed
by any person, firm or corporation to which this ordinance is applicable.
All such trimming shall be done in accordance with the requirements prescribed
by such inspector. Such inspector may at any time require the trimming of
trees, shrubs or other foliage by any person, firm, or corporation subject
to this ordinance and whose lines, poles, or fixtures are so placed as to
require trimming to keep same free of fire and other hazards created by the
proximity of such trees, shrubs, or other foliage.

Dear Mr. Bueker:
Thank you for your letter of June 26, 1972, regarding
the effect of any conflict between proposed ordinance #256 and
ordinance #28 currently in force covering the furnishing of
telephone service in the City of Schertz by Southwestern Bell
Telephone Company.
It is my understanding from your letter that South-
western Bell Telephone Company, its employees, servants and
agents as well as contractors doing work for Southwestern Bell
will be exempt from the provisions of proposed ordinance 1256.
If this is not correct, I would appreciate your letting me know.

iVhen it becomes necessary in the construction, maintenance and operation of a utility
system to cut the surface of any streets or alleys in the City the follo\oling procedures
will be followed where there is a cut in pavement with a flexible base and asphalt
surf ace.
1) The trench will be opened to the minimum width necessary.
2) The trench shall then be backfilled with any material deemed proper
by the Grantee to a height of six inches above the pipe, the balance
of the backfill to the bottom level of the flexible base shall be
bravel or its equivalent. Backfill may be mechanically tramped in a
moist condition or water added to provide free flowing mixture.
3) The backfill being placed as provided in 2 above, the base composed of
six inches of concrete shall then be placed and surface shall be
restored to the same as or equal to the original base and surface.
