CLOSllJG AND ABANOONING CERTAIN STREETS, ALLEYS
AND OTHER UNNAMED PUBLIC RIGHTS-OF-WAY LOCATED
WITHIN THE BUFFALO VALLEY NORTH PROJECT TEX.
R-112; AUTHORIZING THE MAYOR TO EXECUTE A
QUITCLAIM DEED TO SAID STREETS, ALLEYS AND
UNNAMED PUBLIC WAYS TO THE URBAN RENEWAL AGENCY
OF THE CITY OF SCHERTZ; RETAINING CERTAIN EASE-
MENTS FOR UTILITIES.
WHEREAS, prusuant to the terms of the Urban Renewal Plan for Buffalo
Valley North Project, Tex. R-112 to be used for a park for the City of
Schertz, the Urban Renewal Agency of the City of Schertz has acquired land
abutting both sides of certain streets, alleys and unnamed public ways
within the project area; and
WHEREAS, the City has entered into agreements with the Urban Renewal
Agency to cooperate in the redevelopment of said property for a park; and
WHEREAS, such streets, alleys and rights-of-way are no longer needed
for access to the property; and
WHEREAS, in the interest of the safety, health and welfare of the
community, certain streets, alleys and rights-of-way should be vacated
and closed; now, therefore
BE IT ORDAllJED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ:
SECTION 1. Certain streets, alleys and pUblic rights-of-way located
within the Buffalo Valley North Project, Tex. R-112 being located within
the City of Schertz are hereby closed and abandoned as follows:
Easement between Aero Avenue and Brooks Avenue from Oak Street
to Farm Road 1518;
Brooks Avenue oetween Oak Street and Farm Road 151Cl;
Easement between Brooks Avenue and Winburn Avenue from Oak
Street to Farm Road 151d;
Winburn Avenue between Oak Street and Farm Road 151Cl;
Easement between Winburn Avenue and Wright Avenue from Oak
Street to Farm Road 1518;
Wright Avenue between Oak Street and Farm Road 151d;
Poplar Street between Aero Avenue and Farm Road 1518.
SECTION 2. In addition to the streets and alleys described in
paragraph 1. above, all unnamed streets and alleys shown in the area
designated "X" on the map attached hereto and made a part hereof, as
Exhibit "A" hereof, are included and are also vacated and abandoned,
except those utility easements mentioned in Section 4. herein.
SECTION 3. The Mayor is hereby authorized to execute a Quitclaim
Deed to the Urban Renewal Agency of the City of Schertz to the portions
of those streets and alleys closed and abandoned in paragraph 1. above.
SECTION 4. All in place utilities and utility easements now located
in the aforementioned area within the Buffalo Valley North Project area
shall remain and shall not be included in the Quitclaim Deed.
