AN ORDINANCE
DIRECTING AND MAKING PROVISION FOR THE SALE
OF A 5.231 ACRE TRACT OF LAND BY THE CITY OF
SCHERTZ, TEXAS, TO CIBOLO CREEK MUNICIPAL
AUTHORITY, AND PROVIDING THE FORM AND MANNER
OF THE EXECUTION OF THE DEED OF CONVEYANCE.

WHEREAS, the City of Schertz, Texas, presently owns a
5.231 acre tract of land, which land is hereinafter more particularly
described by metes and bounds; and
WHEREAS, Cibo1o Creek Municipal Authority has expressed a
need for said tract of land and a desire to purchase the same from
the City for the purpose of constructing a sewer plant, which plant
will serve the needs of the City of Schertz; and
WHEREAS, the City Council of said city has determined that
it is to the best interest of said city and the residents thereof
that such sale be consumated on the terms and conditions hereinafter
provided; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:

That the following described 5.231 acre tract of land, owned
by the City of Schertz, Texas, be conveyed to Cibolo Creek Municipal
Authority for a cash consideration of FORTY TWO THOUSAND AND NO/lOa
DOLLARS ($42,000.00). Said tract of land is more particularly de-
scribed as follows:
BEGINNING at a point in a fence for the most
northern corner of this tract, from which
point the most northern point of the City of
Scher~z sewage treatment plant 8.6 acre tract
lies north 54 deg. 47' east a distance of 65.0
feet; the said most northern corner of the
Schertz sewage treatment plant site is on the
boundary line between the Helma Dietz tract
and the Otto Dietz tract and an iron pin in
the south right-of-way line of FM 78 bears
south 30 deg. east a distance of 2,540.5 feet;
THENCE, south 00 deg. 02' 41" west a distance
of 461.17 feet to a corner; THENCE south 30
deg. 00' east a distance of 245.00 feet to
the southeast corner of this tract; THENCE
south 62 deg. 53' west a distance of 57.7
feet to a corner; THENCE north 86 deg. 32'
west a distance of 247.5 feet to a corner;
THENCE north 73 deg. 42' west a distance of
131.0 feet to a corner; THENCE, north 30 deg.
00' west a distance of 358.25 feet to a corner;
THENCE, north 54 deg. 47' east a distance of
587.6 feet to the place of beginning con-
taining 5.231 acres of land out of the G.
Malpaz Survey, Abstract 221 in Guadalupe
County, Texas.

That said land be conveyed by Warranty Deed executed by
the Mayor and attested by the City Secretary with the seal of the
City affixed thereto, and the Mayor and City Secretary are hereby
ordered to effectuate the execution of said deed and to make delivery
thereof upon receipt of payment from the Cibo1o Creek Municipal
Authority in the amount of FORTY TWO THOUSAND AND NO/lOa DOLLARS
($42,000.00).

Whereupon, among other business, the
following was transacted as said meeting: A written ordinance DIP~CT-
ING AND f1AKING PROVISION FOR THE SALE OF A 5.231 ACRE TRACT OF LAND
TO CIBOLO CREEK MUNICIPAL AUTHORITY, was duly introduced for the con-
sideration of the Council and read in full. It was then duly moved
and seconded that said ordinance be adopted; and, after due discussion,
said motion, carrying with it the adoption of said ordinance, prevailed
and carried by the following vote:
