Authorized Agent: Killen, Griffin & Farrimond / Ashley Farrimond- Attorney APPLICATION SUBMITTAL DATE: Date: Application Submittal Type: March 26, 2021 Original Application BACKGROUND: A Specific Use Permit for a convenience store with gas pumps was previously recommended for approval by the Planning and Zoning Commission on September 11, 2019 and was approved with conditions by City Council on October 22, 2019. This SUP expired on October 22, 2020 per the original condition that a building permit be approved within one year of the adoption of the ordinance. Since the original SUP was approved the applicant has made progress towards the issuance of a building permit, however, they were not issued a full building permit before the expiration of the SUP. The applicant had a preliminary plat for the approximately 1.6.037 acre parent tract approved by the Planning and Zoning Commission on June 10, 2020, and the applicant is currently in the last stages of the final plat certification process and building permit review process. Since the originally approved specific use permit expired on October 22, 2020, in order to proceed forward with the desired convenience store with gas pumps, a new Specific Use Permit was required to be requested. The proposed Specific Use Permit application and site plan are consistent with what was previously approved by the City Council in October of 2019. . PUBLIC NOTICE: Five (5) public hearing notices were mailed to surrounding property owners within two hundred (200) feet of the subject property on July 2, 2021, and a public hearing notice will be published in the San Antonio Express prior to the City Council public hearing. At the time of this staff report, Staff has received no responses in relation to the Specific Use Permit. ITEM SUMMARY: The applicant is requesting a Specific Use Permit to allow a convenience store with gas pumps on approximately 8.5 acres of land, more specifically described as the northwest corner of the intersection between IH -35 and Schwab Road, City of Schertz, Comal County, Texas. The subject property is currently undeveloped, vacant land. The proposed development includes an approximately 7,318 square foot convenience store with seventeen (17) total gas pumps under two (2) separate canopies. Access to the site is proposed to be through five (5) new driveways: two (2) right -in /right -out driveways on the IH -35 frontage road, one (1) full movement driveway on Baugh Lane, one (1) full movement driveway on Schwab Road, and one (1) right -in /right -out driveway on Schwab Road. The subject property is currently zoned General Business District (GB). LAND USES: IMPACT ON EXISTING ADJACENT DEVELOPMENT: The subject property is currently surrounded by the remainder of the sixteen (16) total acre undeveloped parcel of land and the Rights -Of -Way for three (3) separate public roads: Interstate Highway 35 (IH -35), Schwab Road, and Baugh Lane. The parcel of land to the west of the subject property is zoned General Business District (GB) and is currently undeveloped, the parcel of land to the east of the subject property and Schwab Road is zoned General Business District (GB) and is currently undeveloped, and the parcel of land to the north of the subject property and Baugh Lane is zoned Manufacturing Light District (M -1) and is currently developed with a national food service distributor (Sysco). Given that the proposed convenience store would be surrounded by three roadways, and the adjacent properties are zoned General Business District (GB) and Manufacturing Light District (M -1), the proposed Specific Use Permit would not have an additional adverse impact on the currently adjacent development. The Comprehensive Land Use Plan, through the North Schertz Sector Plan, identifies this area as Highway Commercial. The Highway Commercial land use is intended for regional scale retail and commercial uses that can take advantage of the highway frontage, with a land use mix of mostly large format retail with restaurants and entertainments uses or mid -rise office buildings. The Highway Commercial future land use areas are specifically located along major intersections on IH -35 in order to maximize access to the region and provide accessible services to planned neighborhoods in the area. A convenience store with gas pumps fits the retail land use desired in Highway Commercial designated areas, and is also a business that can take advantage of its proximity to IH -35; a highway- oriented business is dependent upon both a large flow of traffic and convenient access, and is typically a business that caters to the traveling public. The proposed convenience store with gas pumps is compatible with the Highway Commercial land use designation, and therefore the proposed SUP is generally in conformance with the Comprehensive Land Use Plan, through the North Schertz Sector Plan CONCEPTUAL SITE PLAN: The applicant is proposing to construct an approximately 7,300 square foot convenience store with seventeen (17) gas pumps on the approximately 8.5 acre tract of land. • Architectural Standards: Schertz Unified Development Code (UDC) Sec. 21.9.5 requires all non - residential buildings to comply with the architectural feature requirements; the proposed convenience store complies with the minimum required horizontal and vertical articulations. • Parking: The proposed parking areas meet all current regulations within UDC Article 10; the site will provide sixty -three (63) parking spaces sized 10' x 20' and twelve (12) truck parking spaces sized 14'x 55. • Screening requirements: The site has satisfied the minimum screening requirements for the location. The trash receptacle will be constructed of a masonry material with metal gates that meet the minimum requirements. • Landscaping: The proposed site plan will meet all requirements outlined in UDC Sec. 21.9.7. The applicant is proposing to install 82 total shade trees, including 25 Live Oak, 31 Texas Ash, and 26 Texas Redbud, all of which are proposed to be 3" caliper DBH. Additionally, the current proposed site plan indicates 7 Yaupon Holly to be planted along Schwab Road. Prior to approval of the Specific Use Permit / Site Plan these proposed 7 Yaupon Holly will be replaced with an approved shade tree variety in order to meet the shade tree requirement along Schwab Road. • Access and circulation: Access to the site is proposed to be through five (5) new driveways: two (2) right -in /right -out driveways on the IH -35 frontage road, one (1) full movement driveway on Baugh Lane, one (1) full movement driveway on Schwab Road, and one right- in/right -out driveway on Schwab Road. A 25' fire lane is being proposed on all sides of the convenience store to allow for emergency vehicle access. The associated Site Plan and Traffic Impact Analysis Study have been reviewed and approved by both the City of Schertz Engineering Department and the Texas Department of Transportation (TxDOT). Due to the limited adverse impact on adjacent development and the compatibility between the proposed land use and the Comprehensive Land Use Plan, Staff recommends approval of the Specific Use Permit to allow a convenience store with gas pumps at the subject property conditioned upon the following: 1. A building permit is approved within one year of the adoption of the SUP ordinance; and 2. The use begins operation within two years of the issuance of the necessary building permit(s). * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: The Planning and Zoning Commission is making a recommendation to City Council on the proposed Specific Use Permit and associated conceptual site plan. In considering action on a Specific Use Permit application, the Commission should consider the criteria within UDC, Section 21.5.1.1 D. No parkland is being dedicated with this plat. The applicant and the City entered into a parkland development agreement that was executed January 4, 2017. PUBLIC SERVICES: The unit will be serviced for water by Green Valley Special Utility District and City of Schertz, sewer will be provided by City of Schertz, Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy. There is also an approximately 56 acres of private open space within the Homestead Master Development Plan. The overall recreation and open space master plan was reviewed by the Parks and Recreation Advisory Board and approved as part of the PDD Ordinance 14 -S -29. The open space and parkland amenities will include both passive and active areas, as well as pathway and hike and bike trails which will provide links between the city park, open spaces, neighborhoods, and the SCUCISD school site. Open space and park improvements will include such amenities as play scapes, sport courts, playing fields, pavilions, picnic tables, and natural water features. The applicant and the City entered into a parkland development agreement that was executed January 4, 2017. The approximately 15 acre tract of public parkland has been reviewed by the Parks Department and finds no objections. Road Improvements: All streets will be developed to the City of Schertz specifications. Construction plans for all public improvements will be submitted for review and approved by the Public Works and Engineering Departments prior to the approval of the final plat. The open space and parkland amenities will include both passive and active areas, as well as pathway and hike and bike trails which will provide links between the city park, open spaces, neighborhoods, and the SCUCISD school site. Open space and park improvements will include such amenities as play scapes, sport courts, playing fields, pavilions, picnic tables, and natural water features. No parkland is being dedicated with this plat. The applicant and the City entered into a parkland development agreement that was executed January 4, 2017. . Road Improvements: All streets will be developed to the City of Schertz specifications. Construction plans for all public improvements will be submitted for review and approved by the Public Works and Engineering Departments prior to the approval of the final plat. BACKGROUND At the May 26, 2021 Planning and Zoning Commission Meeting, Planning staff provided a presentation in relation to public hearing notice signs. During this presentation it was discussed when the Unified Development Code regulations were established, why they were established, what the current public hearing notice signs looked like, and examples of surrounding and target cities public hearing notice signs. After the staff presentation there was a discussion between the Planning and Zoning Commission and Planning staff on what items from our current sign were liked, and what items from the other city examples were liked. Additionally, the Planning and Zoning Commission provided some direction on changes that could be made to our current public hearing notice signs. Some examples of the suggestions provided included: • Larger text • Utilizing red font • Fewer words • Addition of a QR Code Some of the items that the Planning and Zoning Commission indicated should not be modified include: • The size of the sign (18" x 24 "), however consider flipping the sign vertically versus the current horizontal configuration • The utilization of the metal "H" frames for installation. • Applicants being required to place the sign on the property From this discussion Planning staff has created two proposed public hearing notice signs. Ultimately, the two mock signs are very similar to each other but did incorporate some suggested modifications. Proposed Sign #1- Staffs Preferred Sign, includes the following: • Utilization of the 18" x 24" sized sign, so that applicants can utilize the metal "H" frames • Changing the orientation of the sign from horizontal to vertical in order to increase text size • Utilization fo red text, with "Notice of Public Hearing Zone Change Pending" in Larger bold font to draw more attention • Fewer words, while still providing the reader the case number, proposed request, public hearing date, along with the City of Schertz website, and the Planning Division phone number Proposed Sign #2- includes the following: • All the same information and formatting as proposed sign #1 • Addition of a QR code that directs the user to the City of Schertz website Proposed Sign #1 is the staff recommended sign based on the appearance of the sign providing enough information while still having the text increased for ease of reading. From staff s opinion since the City of Schertz website is already provided on the sign, it does not seem necessary to also have a QR code that would point the user to the exact same webpage. By not including the QR code there are fewer items on the sign, which really makes the content that is present stand out. Although, additional items could be removed in order to increase the text size, staff feels that the case number, proposed request, and public hearing dates should remain on the sign. Without this basic information, it would require every reader to either call staff or visit the website. The goal behind this workshop, discussion, and possible action is for staff to receive feedback from the Planning and Zoning Commission on the two proposed signs in order to move forward with making modifications and working with the sign shop to create the new public hearing signs.
