PUBLIC HEARING:
The Planning and Zoning Commission will hold a public hearing related to zone change requests and replats within this agenda. The public
hearing will be opened to receive a report f om staff the applicant; the adjoining property owners affected by the applicant's request, and any
other interested persons. Upon completion, the public hearing will be closed. The Commission will discuss and consider the application, and
may request additional information from staff or the applicant, if required. After deliberation, the Commission is asked to consider and act
upon the following requests and make a recommendation to the City Council if necessary.

The Schertz Planning and Zoning Commission convened on January 26, 2022 at 6:00 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

The applicant is proposing to final plat approximately 33 acres of land establishing 54 residential lots. The site is zoned Planned
Development District (PDD). The preliminary plat was reviewed using the PDD Ordinance 17 -S -02 design standards and current UDC,
Ordinance 11 -S -15 as amended.
GENERAL LOCATION AND SITE DESCRIPTION:
The subject property is currently undeveloped and is generally located approximately two thousand two hundred (2,200) feet south of the
intersection of Somervell and Homestead Parkway.
ACCESS AND CIRCULATION:
The UDC, Article 14, requires that all residential subdivision have a minimum of two (2) locations accessing existing public streets. This
unit is designed to have one (1) point of access from Homestead Parkway and one (1) point of access from Fred Couples.

The applicant is responsible for complying with the Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The
applicant has submitted a tree affidavit indicates that the site does not contain any protected and heritage trees.
PUBLIC SERVICES:
The unit will be serviced for water by Green Valley Special Utility District and City of Schertz, sewer will be provided by City of Schertz,
Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy.
PUBLIC IMPROVEMENTS:
All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section
21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by
the Public Works and Engineering Departments prior to approval of the final plat.
Water: The unit will be serviced by both Green Valley Special Utility District as well as the City of Schertz for water through an 8" line that
will extend throughout the subdivision and be stubbed for future development.
Sewer: The unit will be serviced by an 8" sewer line that will extend throughout the subdivision and be stubbed for future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Stormwater
regulations. A drainage report has been reviewed and approved by the City Engineer
Sidewalks, Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision. All sidewalks will
be designed to meet the City of Schertz specifications.
Parks: An approximately 15 acre public park with improvements is being proposed within Homestead Unit 5. There is also an approximately
56 acres of private open space within the Homestead Master Development Plan. The overall recreation and open space master plan was
reviewed by the Parks and Recreation Advisory Board and approved as part of the PDD Ordinance 14 -S -29. The open space and parkland
amenities will include both passive and active areas, as well as pathway and hike and bike trails which will provide links between the city
park, open spaces, neighborhoods, and the SCUCISD school site. Open space and park improvements will include such amenities as play
stapes, sport courts, playing fields, pavilions, picnic tables, and natural water features. The applicant and the City entered into a parkland
development agreement that was executed January 4, 2017. The approximately 15 acre tract of public parkland has been reviewed by the
Parks Department and finds no objections.
Road Improvements: All streets will be developed to the City of Schertz specifications. Construction plans for all public improvements will
be submitted for review and approved by the Public Works and Engineering Departments prior to the approval of the final plat.
STAFF ANALYSIS AND RECOMMENDATION:
The final plat is consistent with the application requirements, ordinances, and regulations for this property. It has been reviewed with no
objections by the Engineering, Public Works, Fire and Planning Departments.
* While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC.
COMMISSIONERS CRITERIA FOR CONSIDERATION:
The Planning and Zoning Commission is the final approval authority of the proposed final plat. In considering final action on a final plat, the
Commission should consider the criteria within UDC, Section 21.12.10.D.

ITEM SUMMARY:
The applicant is proposing to final plat approximately 17 acres of land establishing 49 residential lots. The site is zoned Planned
Development District (PDD). The preliminary plat was reviewed using the PDD Ordinance 17 -S -02 design standards and current UDC,
Ordinance 11 -S -15 as amended.
GENERAL LOCATION AND SITE DESCRIPTION:
The subject property is currently undeveloped and is generally located approximately two thousand two hundred (2,200) feet south of the
intersection of Somervell and Homestead Parkway.
ACCESS AND CIRCULATION:
The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This
unit is designed to have one (1) access point from Hutchinson Way which then connects to Homestead Parkway and will be constructed as
part of Homestead Unit 5 and the second point of access will be through Hansford Way to Fred Couples which will also be constructed with
Homestead Unit 5.
TREE MITIGATION AND PRESERVATION:
The applicant is responsible for complying with the Unified Development Code (UDC), Section 219.9 Tree Preservation and Mitigation. The
applicant has submitted a tree affidavit which indicates that the site does not contain any protected or heritage trees.
PUBLIC SERVICES:
The unit will be serviced for water by Green Valley Special Utility District and City of Schertz, sewer will be provided by City of Schertz,
Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy
PUBLIC IMPROVEMENTS:
All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section
21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by
the Public Works and Engineering Departments prior to approval of the final plat. Recordation of Homestead Unit 9 will be contingent on
Homestead Unit 5 being constructed and recorded first as it will build the points of access for Unit 9.
Water: The unit will be serviced by both Green Valley Special Utility District as well as the City of Schertz for water through an 8" line that
will be extended throughout the subdivision and be stubbed for future development.
Sewer: The unit will be serviced by an 8" sewer line that will extend throughout the subdivision and be stubbed for future development.
Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Stormwater
regulations. A drainage report has been reviewed and approved by the City Engineer.
Sidewalks, Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision. All sidewalks will
be designed to meet the City of Schertz specifications.
Parks: An approximately 15 acre public park with improvements is being proposed in the Homestead Master Development Plan as well as
approximately 56 acres of private open space. The overall recreation and open space master plan was reviewed by the Parks and Recreation
Advisory Board and approved as part of the PDD Ordinance 14 -S -29. The open space and parkland amenities will include both passive and
active areas, as well as pathway and hike and bike trails which will provide links between the city park, open spaces, neighborhoods, and the
SCUCISD school site. Open space and park improvements will include such amenities as play scapes, sport courts, playing fields, pavilions,
picnic tables, and natural water features. No parkland is being dedicated with this plat. The applicant and the City entered into a parkland
development agreement that was executed January 4, 2017.
Road Improvements: All streets will be developed to the City of Schertz specifications. Construction plans for all public improvements will
be submitted for review and approved by the Public Works and Engineering Departments prior to the approval of the final plat.
STAFF ANALYSIS AND RECOMMENDATION:
The final plat is consistent with the application requirements, ordinances, and regulations for this property. It has been reviewed with no
objections by the Engineering, Public Works, Fire and Planning Departments.

Three (3) public hearing notices were mailed to the surrounding property owners within two hundred feet (200') of the subject property on
January 28, 2022, with a public hearing notice to be published in the "San Antonio Express" prior the City Council public hearing. At the
time of this report Staff has received one (1) response that is neutral to the zoning request.
ITEM SUMMARY:
The applicant is requesting to rezone the approximately 9 acres of land from General Business District (GB) and Pre - Development (PRE) to
General Business District (GB) and General Business District -2 (GB2). The 9 acre tract is a portion of the remaining approximately 114 acre
tract.

PROPOSED ZONING:
The proposed rezone is for approximately 9 acres of land from General Business District (GB) and Pre - Development District (PRE) to
General Business District (GB) and General Business District -2 (G132).
CONFORMANCE WITH THE COMPREHENSIVE PLAN:
The Comprehensive Land Use Plan (CLUP), through the Future Land Use Plan and Northern Schertz Sector Plan, designates this subject
property as Commercial Campus and Agricultural Conservation. The objective of the Commercial Campus land use designation is intended
to accommodate the development of lower intensity commercial and office uses that utilize a variety of mostly office, flex - office, light
industrial, and creating a campus like environment. Agricultural Conservation land use designation is to have the rural /agricultural type
development and minimum open space of 70 %. In the Schertz Sector Plan it states under the Agricultural Conservation land use designation
that "The community's vision for this area may also evolve over time and should be reevaluated based on market trends and community
desires during future planning efforts ". The property is 1,100 feet deep with an approximately 750 feet of Commercial Campus land use
designation and approximately 350 feet of Agricultural Conversation land use designation. This creates a challenge with the property owner
that the land is spilt between two land use designations as it poses the issue of how they are able to develop the property. If we held firin to
the land use designation boundaries then the back portion that is under Agricultural Conservation would not be developed and how would it
be accessed as it will be cut off from I -35. The boundary between the two land use designations are often generalized locations unless there
is a physical feature that sets the boundary such as a roadway or a drainage area. The intention with the current land use designations is to not
have a hard, fast line on the property, but to instead flex the property lines, which is good planning practices to things like property lines, built
features or natural features.
• Comprehensive Plan Goals and Objectives: The proposed rezoning of this property to General Business District (GB) and General
Business District -2 (G132) is in conformance with the Comprehensive Land Use Plan as it will support the office and light industrial
uses set forth in the General Business District (GB) and General Business District -2 (G132). Within the 2002 Comprehensive Land
Use, under Key Features of the Land Use Plan, it states that "Classifying significant acreage within the ETJ as rural development
to preserve environmental resources and maintain a reserve of vacant land and open space outside the incorporated City. As
development matures in this area higher density land use may be considered ". In keeping that in mind the property only has 350 feet
of agricultural conservation land use identified on their property, but when looking at the overall picture when looking beyond the
property boundary, there is still 2,200 feet of agricultural conservation remaining.
• Impact of Infrastructure: The proposed zone change would have to route water and sewer from Schwab Road to their property. There
is water and sewer located along the right -of -way of Schwab Road and would be taken from this area to the subject property.
• Impact of Public Facilities /Services: The proposed zone change would have minimal impact on the public services, such as schools,
fire, police and parks, and would have an increase in service area for water and sewer.
• Compatibility with Existing and Potential Adjacent Land Uses: The subject property is surrounded by several parcels that are zoned
General Business District (GB), which in line with maintaining the lower intensity along the frontage of 35 and pushing the light
industrial away from 35.
STAFF ANALYSIS AND RECOMMENDATION:
The property has the land use designation under the Schertz Sector Plan for Northern Schertz as Commercial Campus land use designation
and Agricultural Conservation. The Commercial Campus land use designation encourages the development of lower intensity commercial,
office, flex - office, and light industrial uses. The Agricultural Conservation land use designation is intended to maintain the rural /agricultural
uses. The land use designation lines that illustrate approximately 750 feet of Commercial Campus land use designation and approximately
350 feet of Agricultural Conservation land use designation has created this hard and fast line on the property, which leaves the property owner
to determine how to develop accordingly. However, this line is not intended to be a hard and fast line to split a property the way that it has.
The concept for this area, where you take the railroad tracts and Interstate Highway 35 and notice the trend of commercial along the frontage
and agricultural conservation along the back, but then determining whether we want it to be 400 feet, 700 feet, or 1,000 feet. Good planning
practices are that we generally try to use property lines, built features, or natural features instead of using hard fast lines. Therefore, with the
information provided the rezoning to maintain the General Business District (GB) along the IH -35 frontage and have the General Business
District -2 (G132) in the back meets the intention of the Comprehensive Land Use Plan as identified under the Commercial Campus land use
designation.
Staff feels that the rezoning the portion of the property to General Business District -2 (GB2) does not negatively impact the larger area left
Agricultural Conservation nor does adjusting the zoning boundary line of the General Business District (GB) to still maintain that lighter
intensity commercial along 35. Therefore, staff recommends approval of the approximately 9 acres to General Business District (GB) and
General Business District -2 (G132).
* While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC.
The Planning and Zoning Commission is making a recommendation to City Council on the proposed zoning application in considering action
on a zoning application, the Commission should consider the criteria within UDC Section, 21.5.4 D.

DEVELOPMENT INFORMATION
The following is being provided for information purposes only so that the Planning and Zoning Commission is aware of the current status of
new site plan applications, status of applications heard by the Commission and recommended for final action by the City Council, and the
status of administratively approved applications.
NEW SITE PLAN APPLICATIONS:
There were no new site plan applications submitted to the Planning and Community Development Department between January 22
and February 4.
CITY COUNCIL RESULTS: The following development applications were recommended for final action to the City Council:
• Ord. 22-S-0 1: A Comprehensive Land Use Plan for approximately 363 acres of land from Estate Neighborhood and Agricultural
Conservation land use designation to Single - Family Residential land use designation.
• Recommended for denial at the December 8 P &Z Meeting (4 -0 vote)
