22-R-18 - Supporting a Tax Bond Development from NRP Lonestar Development LLCRESOLUTION NO. 22-R-18 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SUPPORTING A TAX BOND DEVELOPMENT FROM NRP LONESTAR DEVELOPMENT, LLC FOR A DEVELOPMENT NAMED 1518 APARTMENTS LTD. TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA) TO DEVELOP AFFORDABLE MULTI - FAMILY RENTAL HOUSING, AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, NRP Lone Star Development, LLC, a Texas limited liability company (the "Developer" and, together with any current or future affiliates or subsidiaries of the Developer, the "Applicant "), has proposed a development for affordable multi - family rental housing named 1518 Apartments Ltd., generally located 2,500 feet southeast from the intersection of Lower Sequin Road and FM 1518, known as 9120 FM 1518 N, also known as Bexar County Property Identification Numbers, 309999 and 309997, City of Schertz, Bexar County Texas; and WHEREAS, NRP Lone Star Development, LLC has provided notice to the City Council of the City of Schertz that the Applicant intends to submit an application to the Texas Department of Housing and Community Affairs (TDHCA) for the 2022 or 2023 4% Housing Tax Credit allocation for 1518 Apartments, Ltd.; and WHEREAS, the City of Schertz finds the need for such affordable housing for citizens within the City's boundaries and supports the 1518 Apartments Ltd. tax credit application; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, IN ACCORDANCE WITH THE REQUIREMENTS OF TEX. GOV'T CODE §2306.67071 AND 10 TAC §11.204(4), IT IS HEREBY FOUND THAT: Section 1. Notice has been provided the City Council of The City of Schertz, in accordance with Tex. Gov't Code §2306.67071(a); and Section 2. The City Council of The City of Schertz has had sufficient opportunity to obtain a response from NRP Lone Star Development, LLC regarding any questions or concerns about the proposed Development; and Section 3. The City Council of The City of Schertz has held a hearing at which public comment may be made on the proposed Development in accordance with Tex. Gov't Code, §2306.67071(b); and Section 4. After due consideration of the information provided by NRP Lone Star Development, LLC and public comment, The City Council of The City of Schertz does not object to the proposed; Application Section 5. The City of Schertz, Guadalupe County hereby supports the application of 1518 Apartments Ltd., and confirms that its governing body has voted specifically to support the authorization of Housing Tax Credits for 1518 Apartments Ltd. Section 6. That for and on behalf of the City Council of the City of Schertz, Ralph Gutierrez, Mayor is hereby authorized, empowered, and directed to certify this Resolution to the Texas Department of Housing and Community Affairs. Section 7. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 8. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 9. This Resolution shall be construed and enforced in accordance with the lawsof the State of Texas and the United States of America. Section 10. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 11. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 12. This Resolution shall be in force and effect from and after its final passage, and it is so resolved.
