A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS SUPPORTING AN APPLICATION FOR 2022 HOUSING TAX
CREDITS BY SCHERTZ HIDDEN OAKS, LP NAMED HIDDEN OAKS IN
SCHERTZ TO THE TEXAS DEPARTMENT OF HOUSING AND
COMMUNITY AFFAIRS (TDHCA) TO DEVELOP AFFORDABLE
RENTAL HOUSING, AND OTHER MATTERS IN CONNECTION
THEREWITH
WHEREAS, Schertz Hidden Oaks, LP has proposed a development for affordable rental
housing named Hidden Oaks in Schertz at 204 Schertz Parkway, in the city of Schertz, Texas; and
WHEREAS, Schertz Hidden Oaks, LP has advised it intends to submit an application to
the Texas Department of Housing and Community Affairs (TDHCA) for 2022 Housing Tax Credit
funds for Hidden Oaks in Schertz; and
WHEREAS, the City of Schertz finds the need for such affordable housing for citizens
within the City's boundaries and supports the Schertz Hidden Oaks, LP tax credit application; and
WHEREAS, this resolution confirms the City of Schertz has approved permit fee waivers
for the benefit of the development; in accordance with § 11.9(d)(2) of the 2016 Qualified Allocation
Plan; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS:
Section 1. The City of Schertz, Guadalupe County hereby supports the application of
Avanti Canyon, and confirms that its governing body has voted specifically to support the
authorization of Housing Tax Credits for Hidden Oaks in Schertz.
Section 2. City supports the proposed Hidden Oaks, and confirms that as the governing
body of Schertz, Texas, that it approves construction or rehabilitation of the Development and to
authorize an allocation of Housing Tax Credits for the Development pursuant to Tex. Gov't Code
Sec. 2306.6703(a)(4).
Section 3. That for and on behalf of the City Council of the City of Schertz, Ralph
Gutierrez, Mayor is hereby authorized, empowered, and directed to certify this Resolution to the
Texas Department of Housing and Community Affairs.
Section 4. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings of the City Council.
Section 5. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 6. This Resolution shall be construed and enforced in accordance with the laws
of the State of Texas and the United States of America.
Section 7. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application of
such provision to other persons and circumstances shall nevertheless be valid, and the City Council
hereby declares that this Resolution would have been enacted without such invalid provision.
Section 8. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Government Code, as amended.
Section 9. This Resolution shall be in force and effect from and after its final passage,
and it is so resolved.
