22-R-81 - Creating the Schertz Main Street Area Neighborhood Empowerment ZoneRESOLUTION NO. 22-R-81 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CREATING THE SCHERTZ MAIN STREET AREA NEIGHBORHOOD EMPOWERMENT ZONE OF SCHERTZ, TEXAS, AND RELATED MATTERS IN CONNECTION THEREWITH WHEREAS, The City of Schertz desires to increase the public health, safety, and welfare of the persons in the municipality; and WHEREAS, The City of Schertz City Council finds that the creation of the zone satisfies the requirements of Section 312.202,Tax Code. WHEREAS, The City of Schertz City Council finds that the Schertz Main Street Area Neighborhood Empowerment Zone should be created in the area show on Exhibit "A" — generally on the north and south sides of Main Street, between Exchange Avenue and the railroad tracks, between Schertz Parkway and Aviation Blvd.; and WHEREAS, The City of Schertz City Council finds that the creation of the Schertz Main Street Area Neighborhood Empowerment Zone benefits and is for the public purpose of increasing the public health, safety, and welfare of the persons in the municipality; and WHEREAS, The City of Schertz City Council finds that the creation of the Schertz Main Street Area Neighborhood Empowerment Zone would promote the creation of affordable housing, including manufactured housing, in the zone; increase in economic development in the zone; increase in the quality of social services, education, or public safety provided to residents of the zone; or the rehabilitation of affordable housing in the zone. WHEREAS, The program is intended to stabilize and improve property values; and WHEREAS, Foster civic pride in the beauty and accomplishments of the past, and to promote the use of the historic structures for the culture, education, and general welfare of residents; and WHEREAS, Strengthen the economy of the city by protecting and enhancing the attractiveness of the Main Street area to residents and visitors, as well as provide support and stimulus to businesses; and WHEREAS, given the aims of the Comprehensive Plan as it relates to Main Street and in particular the desire to foster commercial development that serves tourists and residents; and N -I r+ N Z CU M z cD aa' cr O O O CL m 3 a O "S 3 m r N I (OD m x 1 D N cn FD A Cn 2 m b z O o n N O =1 CD N 4 OD O O Cn 2 m WHEREAS, the Schertz Historic Preservation Committee is recommending amendment to the program to better achieve the aims outlined above; NOW THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby amends the Schertz Main Street Area Preservation Incentive Program as outlined in Exhibit "A" — Schertz Main Street Are Incentive Program Summary and authorizing the City Manager and City Attorney to amend the grant agreement accordingly. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 7. This Resolution shall be in force and effect from and after its final passage, and it is so resolved. PASSED AND ADOPTED, this 23rd day of August, 2022.
