A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS IN SUPPORT OF THE NOMINATION (S)
FOR THE BEXAR APPRAISAL BOARD OF DIRECTORS AND
OTHER MATTERS IN CONNECTION THEREWITH
WHEREAS, section 6:03(k), of the Texas Property Tax Code, requires that each taxing
unit entitled nominate candidates by Resolution and submit the list of nominees to the results of
that vote to the Chief Appraiser of the Bexar County Appraisal District on or before October 15,
2024; and
WHEREAS, added in SB2 of the second special session of the 88th legislature, Section
6.0301 of the Texas Property Tax Code applies to appraisal districts established in a county with
a population of 75,000 or more and alters the make-up of the Bexar Appraisal District Board of
Directors. Three members elected by majority vote in the May 2024 general election joined the
five directors appointed by the taxing units that participate in the district in the manner
prescribed by Section 6.03, Texas Property Tax Code; and
WHEREAS, to implement the necessary term changes and as required by Section
5.13(d), Texas Property Tax Code, members appointed in this cycle shall draw lots at the first
meeting of 2025 to determine which two shall serve a term of one year, beginning January 1 st,
2025 and expiring December 31 st, 2025, and which three shall serve a term of three years,
beginning January 1 st, 2025 and expiring December 3 1 st, 2027. After that, appointed members
will serve in four-year terns; and
WHEREAS, to begin the appointment process, each taxing unit authorized to vote may
nominate one candidate for each of the five positions on the Bexar Appraisal District Board of
Directors by resolution of its governing body and submit the name(s) of the unit's nominee(s) to
the Chief Appraiser by October 15th.
NOW, THEREFORE, BE IT RESOLVED, the City Council has deternined that it is
in the best interest of the City to nominate for each of the five positions the following Dr. Roger
Booker and Ms. Tammy GIascoe for the Bexar Appraisal District Board of Directors.
Section 1. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes and are
adopted as a part of the judgment and findings of the City Council.
Section 2. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and
the provisions of this Resolution shall be and remain controlling as to the matters
resolved herein.
Section 3. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 4. If any provision of this Resolution or the application thereof to any
person or circumstance shall be held to be invalid, the remainder of this Resolution
and the application of such provision to other persons and circumstances shall
nevertheless be valid, and the City Council hereby declares that this Resolution
would have been enacted without such invalid provision.
Section 5. It is officially found, determined, and declared that the meeting at
which this Resolution is adopted was open to the public and public notice of the
time, place, and subject matter of the public business to be considered at such
meeting, including this Resolution, was given, all as required by Chapter 551, Texas
Government Code, as amended.
Section 6. This Resolution shall be in force and effect from and after its formal
passage, and it is so resolved.
