A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS AUTHORIZING THE SUBMISSION
OF AN APPLICATION FOR THE LOCAL HAZARD
MITIGATION PLANS PROGRAM (LHMPP) GRANT
PROGRAM; DESIGNATING THE CITY MANAGER AS THE
AUTHORIZED OFFICAL NOT TO EXCEED ONE
HUNDRED THOUSAND DOLLARS.
WHEREAS, the City of Schertz, Texas, is vulnerable to various natural and human -
caused hazards, including but not limited to floods, severe storms, droughts, and other potential
threats, which can result in significant loss of life, injury, property damage, and disruption to
public services and the local economy; and
WHEREAS, the development and adoption of a comprehensive Hazard Mitigation Plan
is a critical proactive measure to identify local hazards, assess risks, and develop strategies and
projects to reduce or eliminate the long-term risk to people and property from future hazard
events; and
WHEREAS, a Federal Emergency Management Agency (FEMA) approved Hazard
Mitigation Plan is a prerequisite for the City to be eligible for certain federal disaster assistance
and hazard mitigation grant funding programs (such as the Hazard Mitigation Grant Program —
HMGP, and Building Resilient Infrastructure and Communities — BRIC) following a federal
disaster declaration; and
WHEREAS, the Local Hazard Mitigation Plans Program (LHMPP), administered by
FEMA and passed through the Texas Division of Emergency Management (TDEM), and the
Texas General Land Office (GLO), provides financial assistance to local governments for the
development and update of such plans; and
WHEREAS, securing federal funding through LHMPP is essential to support the
extensive research, analysis, public engagement, and technical expertise required to develop a
robust and effective Hazard Mitigation Plan, capabilities that often exceed the City's general
operating budget; and
WHEREAS, the City Council recognizes that investing in hazard mitigation planning is
a fiscally responsible approach to reduce future disaster costs, protect public assets, and enhance
the overall resilience of the community; and
WHEREAS, the City of Schertz will submit an application to the Local Hazard
Mitigation Plans Program not to exceed the amount of $100,000.00 to fund the City's update of
our Hazard Mitigation Plan.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS THAT:
Section 1.The City Council hereby authorizes the submission of an application for the
Local Hazard Mitigation Plans Program (LHMPP); designating the City manager as the
Authorized Official not to exceed the amount of ONE HUNDRED THOUSAND
DOLLARS ($100,000.00).
Section 2.The recitals contained in the preamble hereof are hereby found to be true, and
such recitals are hereby made a part of this Resolution for all purposes and are adopted as
a part of the judgment and findings of the City Council.
Section 3.All resolutions, or parts thereof, which are in conflict or inconsistent with any
provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved
herein.
Section 4.This Resolution shall be construed and enforced in accordance with the laws of
the State of Texas and the United States of America.
Section 5.If any provision of this Resolution or the application thereof to any person or
circumstance shall be held to be invalid, the remainder of this Resolution and the
application of such provision to other persons and circumstances shall nevertheless be
valid, and the City Council hereby declares that this Resolution would have been enacted
without such invalid provision.
Section 6.I1 is officially found, determined, and declared that the meeting at which this
Resolution is adopted was open to the public and public notice of the time, place, and
subject matter of the public business to be considered at such meeting, including this
Resolution, was given, all as required by Chapter 551, Texas Government Code, as
amended.
Section 7.This Resolution shall be in force and effect from and after its final passage, and
it is so resolved.
