25-R-085 EMS Local Agreement AmendmentRESOLUTION 25-R-085 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING AMENDMENT 1 (ONE) TO THE EMS INTERLOCAL AGREEMENTS WITH MULTIPLE GOVERNMENTAL ENTITIES FOR THE PROVISION OF EMERGENCY MEDICAL SERVICES. WHEREAS, the City of Schertz entered into an Interlocal Agreement with multiple governmental entities effective as of October 1, 2023 for the provision of Emergency Medical Services; and WHEREAS, the City of Schertz has determined that the provision of certain emergency medical services is a public purpose and within their statutory powers of government; and WHEREAS, the City of Schertz wishes to amend the Interlocal Agreement with multiple governmental entities to cover anticipated operational budgeted shortfalls; and WHEREAS, the City Council hereby finds that the amendment is reasonable and necessary for the safety and welfare of the general public; and WHEREAS, the City Council authorizes the City Manager to enter into the amended Interlocal Agreement and take any additional action reasonably necessary to ensure such an amendment is executed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT. Section 1. The City Council hereby approves and accepts Amendment 1 (one) to the Interlocal Agreement for Emergency Medical Services as set forth in Exhibit "A". Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. CITY OF SCHERTZ, TEXAS Ra h utie , Mayor AT ST: Shelia Edmon son, City Secr as Exhibit A AMENDMENT NUMBER 1 TO THE STATE OF TEXAS § INTERLOCAL AGREEMENT BETWEEN § THE linsert political subdivision name) COUNTY OF GUADALUPE § AND THE CITY OF SCHERTZ, TEXAS, FOR EMERGENCY MEDICAL SERVICES This Amendment No. 1 (the "Amendment") is made and entered into as of the 19th day of August 2025, by and between the City of Schertz, a political subdivision of the State of Texas (hereinafter referred to as "City"), and the {insert political subdivision name}, a political subdivision of the State of Texas (hereafter referred to as "Contracting Jurisdiction"). WHEREAS, the City and Contracting Jurisdiction have entered into an Interlocal Agreement effective as of October 1, 2023 for the City to provide emergency medical services to Contracting Jurisdiction; and WHEREAS, the City and the Contracting Jurisdiction have determined that the provision of certain emergency medical services is a public purpose and within their statutory powers of government; NOW, THEREFORE, the City and Contracting Jurisdiction agree to amend the Agreement as follows: Section 3 of the Agreement is replaced and superseded by the following new Section 3 3. Consideration a) In consideration of the City's provision of the Emergency Medical Services during the Initial Term and each Renewal Tern, the Contracting Jurisdiction agrees to pay the City in four equal installments on the first day of each quarter of the Contracting Jurisdiction's fiscal year as outlined below: Fiscal Year 2026 — (Total Dollar Amount) Fiscal Year 2027 — {Total Dollar Amount) Fiscal Year 2028 — (Total Dollar Amount) b) Any party paying for the performance of governmental functions or services must make such payments from current revenues available to the paying party. c) The Contracting Jurisdiction agrees that, in addition to the fee payable by the Contracting Jurisdiction to the City pursuant to Section 3(a), patients shall be billed by the City for all services rendered to them by the Department. The Contracting Jurisdiction agrees to assist the City in developing information to permit the City to collect such charges. In no event shall the City or the Contracting Jurisdiction be responsible for payment of such patient charges. All other requirements, terms, and conditions in the Agreement that are not hereby amended are to remain in full force and effect.
