The Schertz Planning and Zoning Commission convened on April 25, 2007 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

CALL TO ORDER/ROLL CALL
Mr. Richmond called the meeting to order at 6:31 P.M.

CITIZEN COMMENTS
Pete McNamee. 3817 Overlook Dr., thanked the Planning and Zoning Commission, Economic
Development, and Mr. Wieder and the developer for sitting down with the community and working out a
resolution for the use of the property on Country Club Drive. As President of the Scenic Hills Community
Association he fully supports the application for zoning.

CONSENT AGENDA:
A.
Consider and act upon the March 28, 2007 and April 11, 2007 Planning and Zoning Commission
meeting minutes.
Following reading of the agenda item, Mr. Sommers moved to approve Consent Agenda item 3A. Ms.
Tutschke seconded the motion. Vote was unanimous with Mr. Greenwald abstaining from March 28, 2007
minutes and Mr. Haddock abstaining from March 28, 2007 and April 11 , 2007 minutes. Motion carried.

Hold a public hearing and consider and act upon a request to replat the Mark Roberts Subdivision,
Block 1, Lot 1 and establish Mark Roberts Subdivision II, a 2.658:1: acre tract, establishing Lots 2 and
3 of Block 1, generally located approximately 152 feet west of the intersection of FM 3009 on
Borgfeld Road. The property is zoned General Business (GB).

Public Hearing was opened at 6:35 pm.
Ms. Nichols briefed the commission that twelve notices were mailed. One notice was retumed with a
concem on access on Borgfeld Rd. Ms. Nichols advised the commission that the applicant was present.
Public Hearing closed at 6:37 pm.
After some discussion, Mr. Greenwald moved to approve this item. Mr. Sommers seconded the motion.
Vote unanimous. Motion carried.
B. PC2007-023
Hold a public hearing and consider and act upon a request to replat the Schertz Fire/EMS Station
No.2, Block 1, Lot I and establish Schertz Fire/EMS Station No.2, a 10.518:1:: acre tract,
establishing Lots 2 and 3 of Block 1, generally located at the northeast corner ofFM 482 and
Interstate Highway 35. The property is zoned General Business (GB).

Ms. Nichols briefed the commission three notices were mailed with one reply in favor and advised the
commission that the applicant was present.

Hold a public hearing and consider and act upon a request to zone 5.403:1: acres from Garden Home
Dwelling District (R-5) to General Business (GB). The tract is situated out of the T. Herrera Survey,
No. 68, Abstract 153, Guadalupe County, Schertz, Texas. The property is generally located at the
northwest comer of Schertz Parkway and Live Oak Road.

After a short discussion the applicant withdrew the item.

Hold a public hearing and consider and act upon a request to zone 5.534:1:: acres from Pre-
Development District (PD) to Manufacturing District Light (M-l). The tract is situated out of the
Calvin P. Abbott Survey No. 262, Abstract No. 18, Comal County, Schertz, Texas. The property is
located approximately 951 feet east of the intersection ofFM 2252 on FM 482.

Ms. Nichols briefed the commission three notices were mailed with no replies and advised the commission

Mr. Don McCrary briefed the commission on the application.
After some discussion, Mr. Greenwald moved to recommend approval to the City Council. Ms. Tutschke
seconded the motion. Vote unanimous. Motion carried.

Hold a public hearing, and consider and act upon a request to zone 5.13::1:: acres from Pre-
Development District (PD) to Office and Professional (OP). 3.68::1:: acres are out of the Rafael Garza
Survey, Abstract No. 138, and 1.45::1:: acres are out ofthe James W. Gray Survey, Abstract No. 144,
Guadalupe County, Schertz, Texas. The property is generally located at the southwest comer of
Portage Lane and Country Club Boulevard.

Ms. Gabbard briefed the commission thirty-one notices were mailed with 3 replies and advised the

Mr. Todd Burek spoke to the commission briefly.
After discussion on the use of the property, Mr. Haddock moved to recommend approval to the City Council.
Ms. Tutschke seconded the motion. Vote unanimous. Motion carried.
F. SUP2007-004
Hold a public hearing, and consider and act upon a request for Specific Use Permit of Block I, Lot
28, in the Schcrtz Busincss Park. The proposed commcrciallot for a speculativc building: is within
the Air Installation Compatible Use Zone (AICUZ). The .578::1:: acre tract is zoned General Business
(GB). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe
County, Schenz, Texas. The prope11y is located approximately 238 feet east of the inlersection of
FM 1518 on Commercial Place.

Consider and act upon a request for site plan of the Schertz Business Park Subdivision, Lot 28 of
Block 1. The 0.578::1:: acre tract is generally located 238 feet east ofFM-1518 and Commercial Place
containing a 7,500 square foot warehouse building. The property is zoned General Business District-
(GB). (This item was postponed at the 3-28-07 meeting)

Mr. Sommers moved to untable this item and Ms. Tutschke seconded the motion. Vote unanimous. Motion
carried.
Ms. Nichols reviewed staff comments.
After discussion on zoning, Mr. Greenwald moved to approve the item. Ms. Tutschke seconded the motion.
Vote unanimous. Motion carried.
B. PC2006-101
Consider and act upon a request to for preliminary plat with variance of Bindseil Farms Subdivision.
The 22.669:1: acre tract contains 85 Single-Family Residential lots. The property is zoned Single-
Family Residential-7 (R -7) generally located at the intersection of Schertz Parkway and Live Oak
Road.
Owner: Burkett Live Oak Limited

Ms. Nichols reviewed staff comments and advised the commission that the applicant was present.
Mr. McCrary, Don McCrary & Associates, made a short presentation.
After discussion on yard setbacks and lot sizes, Mr. Sommers moved to approve the item. Ms. Tutschke
seconded the motion. Vote unanimous. Motion carried.
7. ITEMS FOR DISCUSSION
A. City Council
Mr Carpenter reviewed Council decisions on the new Library and Recreation Center that will be
located on the comer of Elbel and Schertz Parkway and voiced his concems on the traffic
congestion. The Council approved funding for the builder on Country Club Road to help upgrade
the fence and bring it up to standard.
B. Director's Report
No comments - not present.
C. Planning Commissioner Comments
Ms. Tutschke:
No comments.
Mr. Sommers
He would be unable to attend the BOA meeting on Monday, April 30, 2007 and stated that there were
eight items requesting variances to setbacks with respect to lots that have already been planned and
approved and he requested someone from the commission be present.

Reminded everyone of the ground breaking for the new Post Office at 9:30 am on Friday, April 27, 2007.

He advised everyone that the previous owner ofthe property Felix Leon's wife passed away.

Commented on Schertz Parkway overlay district and requested staff get public notices out so item can be
on the agenda for the second meeting in May. Expressed concems with traffic impact on Schertz
Parkway and Elbel Rd. Commented on zoning category and AICUZ.
