The Schertz Planning and Zoning Commission convened on May 23, 2007 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

CALL TO ORDER/ROLL CALL
Mr. Richmond called the meeting to order at 6:31 P.M.

CITIZEN COMMENTS
Pat Quinn, 509 Schertz Parkway, questioned letter mailed to him on the public hearing. He is concerned with
the improvcmcnt on Schertz Parkway.
Mr. Richmond advised him to speak during the public hearing, and referred him to Sam Willoughby at
Public Works.

Consider and act upon a request for final plat of Laura Heights Estates Commercial No.1, Lot 15
Block 2. This 3.259::1: acre tract is located at the southeast comer of Ware-Seguin Road and Hallie

3 (GB-3) restrictions.

Following reading of agenda items 3A, 3B, and 3C, Mr. Greenwald moved to approve the Consent Agenda.
Mr. Sommers seconded the motion. Vote unanimous. Motion carried.

Hold a public hearing and consider and act upon a request for a master parks plan.
Owner/Applicant: City of Schertz
Representative: Gail Douglas, Parks and Recreation Director
Public hearing was opened at 6:38 pm.
Ms. Nichols reviewed staff comments and advised the commission that Gail Douglas was present.
Public hearing WdS dosed at 6:39 pm.
Mr. Richmond stated that the plan was excellent, forward thinking, and a lot of information and time was
spent putting the plan together with attention paid to the citizen survey. The plan is a grcat tool that amplifies
and supplements what already exists in the comprehensive land plan, and he recommends the plan for
approval.
Mr. Richmond extended a thank you to the Parks Board.
After discussion, Mr. Haddock moved to recommend approval to City Council. Mr. Greenwald seconded
the motion. Vote unanimous. Motion carried.
B. SUP2007-003
Hold a public hearing and consider and act upon a request for specific use permit for a manufactured
home to be used for a storage building in the Air Installation Compatible Use Zone (AICUZ) Air
Potential Zone-2 (APZ-2). The property is generally situated one-half mile west of FM-1518 and is
zones Residential/Agricultural (RIA).
Owner! Applicant: Ruben Saldana
Representative: South Central Surveyors
Public hearing was opened at 6:42 pm.
Ms. Nichols reviewed staff comments and advised the commission that the applicant was present.
Stacy Padgett, 12120 Ware Seguin Rd., opposed the manufactured home being placed on the property.
Ms. Padgett was conccrncd with thc manufacturcd homc bcing uscd as a homc instcad of storagc. Ms.
Padgett requested that the commission protect property rights.

Ruben Saldana, 12213 Ware Seguin Rd., stated that his true intent for the manufactured home is not to
use it as a home. He intends to use it as storage until it can be sold or the property can be replatted.
Public hearing was closed at 6:47 pm.
Mr. Richmond stated his concerns with the location and the use of a manufactured home as a storage
unit. He stated that if a storage shed is needed the applicant should place a storage shed on the property.
Mr. Haddock was concerned with Mr. Saldana stating that the manufactured home would be used for
storage until sold.
Mr. Sommers questioned staff about the code and what it requires.
Ms. Nichols advised the commission that electric was hooked up and there is no sewer or plumbing to the
manufactured home.
Mr. Truitt advised the commission that Mr. Saldana was informed of all his options. Mr. Truitt also
advised the commission that permits are not issued for manufactured homes to be used for storage and could
not recommend approval.
Mr. Richmond stated that he was concerned with a positive recommendation due to future implications in the
AICUZ.
After discussion, Mr. Haddock moved to recommend disapproval to City Council. Ms. Greenwald seconded
the motion. Vote unanimous. Motion carried.
C. ZC2007-006
Hold a public hearing and consider and act upon a request to amend the Unified Development Code
Article VII (Special Districts), Section 3.1 Schcrtz Parkway District-SPD extending the limits of thc
overlay restrictions from Live Oak Road to FM-78 at a depth of 500-feet.
Owner/Applicant: City of Schertz
Representative: Chris Gabbard, City Planner
Public hearing was opened at 6:58 pm.
Ms. Gabbard reviewed staff comments and advised the commission that the applicant was present.
Mr. Patrick D. Quinn, 509 Schcrtz Parkway, questioncd rcquirements, what depth mcaDS on thc lettcr mailed
and if there is an existing overlay district.
Mr. Richmond addressed the questions.
Mr. Truitt stated that existing busincsses will not be affected and the set backs will be for new
development.
Mr. Quinn stated that there is a big difference in Schertz Parkway from one end to the other.
Mr. Charles Luther, Masonic Lodge, expressed concern with the impact this will have on his property,
future development and eminent domain.
Mr. Truitt suggested that concerned residents call Sam Willoughby, Public Works Director, about the
proposed changes.
Public hearing was closed at 7:23 pm.
Mr. Sommers stated he feels this would be a positive impact and improvement.
Ms. Tutschke agreed with Mr. Sommers.
After discussion, Mr. Sommers moved to recommend approval to the City Council. Ms. Tutschke seconded
the motion. Vote unanimous. Motion carried.

D. ZC2007-008
Hold a public hearing and consider and act upon a request to zone 195.42:l:: acres from Pre-
Development District (PD) and General Business District (GB) to General Business District-2 (GB-2)
The property is generally located at the on the east and west site ofFM-1518 from Maske Road to the
intersection of FM -1518 and Oak street.
Owner/Applicant: City of Schertz
Representative: Misty Nichols, City Plmmer
Public hearing was opened at 7:26 pm.
Ms. Nichols reviewed staff comments and adviscd the commission 117 notices wcre mailed and thc applicant
was present.
Public Hearing closed at 7:31 pm.
After a short discussion on the changes and ACUIZ, Mr. Sommers moved to recommend approval to the City
Council. Mr. Haddock seconded the motion. Vote unanimous. Motion carried.
5.
ITEMS FOR INDIVIDUAL CONSIDERATION
A.
PC2007-039
Consider and act upon a request for preliminary plat of the SPV, LLC. Subdivision. This 7.659:l:: acre
tract is located on Schertz Parkway, north of Wiederstein Road and is zoned General Business District
(GB).
Owner/ Applicant: Jesse Hellums, Hellums Properties, Ltd.
Representative: Arnold Martinez, Martinez Engineering, Inc.
Ms. Nichols reviewed staff comments and advised the commission that the applicant was present.
Jesse Hellums, Hellums Properties, Ltd., explained that they had a hard time getting utilities to the
property and that was the reason the preliminary and final plat expired.
After a short discussion, Mr. Sommers moved to approve the item. Mr. Haddock seconded the motion. Vote
un:mimolls. Motion carried.
B. PC2007-021
Consider and act upon a request for preliminary plat of the Satellite Shelters. The property is located
approximately 951 feet east of thc intcrsection of FM 2252 on FM 482 and zoned Manufacturing
District Light (M-l).
Owner! Applicant: Travis Payne, Travis Payne Family Partnership, Ltd.
Representative: Don McCrary & Associates, Inc.
Ms. Nichols reviewed staff comments and advised the commission that the applicant was present.
After discussion, Mr. Sommers moved to approve the item. Ms. Tutschke seconded the motion. Vote
unanimous. Motion carried.

Mr. Truitt introduced members of Mitchell Planning Group and advised the commission that they will be
helping with the UDC, Comprehensive Land Plan, and staff planning. He reminded the commission of

Discussed the BOA meeting that he attended in April, reminded the commission of the joint meeting on
May 29,2007, and requested an email reminder to commissioners to follow.
