A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, APPROVING THE CANVASS OF
APRIL 4, 2026 SPECIAL ELECTION FOR CITY
COUNCIL PLACE 6 AND DECLARING THE RESULTS
OF SUCH ELECTION AND OTHER MATTERS IN
CONNECTION THEREWITH
WHEREAS, a Special Election was held in the City of Schertz, Texas (the "City"), on the 0' day of April
2026 to elect a Councilmember Place 6, to serve the remainder of a three-year term that ends November
2027; and
WHEREAS, said elections were duly and legally held in conformity with the applicable election laws of
the State of Texas ("Texas"); and
WHEREAS, the Election Administrator has provided to the City, as required by applicable Texas law, the
election results, as tabulated by the Elections Administrator; and
WHEREAS, there came to be considered the returns of the Special Election held on the 4t' day of April
2026, for the purpose of electing one Councilmember for Place 6; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS, THAT:
Section 1: On December 10, 2025 a vacancy on the City Council Place 6 occurred
pursuant to Texas Constitution Article XI, Section 11(c) for any vacancy occurring such
a governing body shall be filled by majority vote of the qualified voters at a special
election called for such purpose within one hundred twenty days after such vacancy:
Section 2: That the tabulation of votes cast to elect one Councilmember for Place 6 in the
Special Election held on April 4, 2026, as shown in the official canvass of the returns of
said special election shown below reflects the following results:

Section 3. The City Council finds that the results of the special election as set
forth above reflect the reported votes, and the canvass of votes is hereby approved.
Section 4. The total votes cast during early voting was for personal appearance
and absentee is 1001 votes, and 203 votes were cast on Election Day. The total
number of votes cast in this Special Election was 1,204.
Section 5. If the canvass and tabulations of votes cast at April 4, 2026, Special
Election reflect that no candidate for Councilmember Place 6 received sufficient
votes to be elected to the city council, it is necessary in conformity with the City
Charter and the Texas Election Code Chapter 2, Subchapter B, Sec. 2.021, as
amended, to order a Runoff Election for the purpose of voting upon candidates
to fill the Councihnember Place 6 on the City Council.
Section 6. The recitals contained in the preamble hereof are hereby found to be
true, and such recitals are hereby made a part of this Resolution for all purposes
and are adopted as a part of the judgment and findings of the City Council.
Section 7. All resolutions, or parts thereof, which are in conflict or inconsistent
with any provision of this Resolution are hereby repealed to the extent of such
conflict, and the provisions of this Resolution shall be and remain controlling as
to the matters resolved herein.
Section 8. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 9. If any provision of this Resolution or the application thereof to any
person or circumstance shall be held to be invalid, the remainder of this Resolution
and the application of such provision to other persons and circumstances shall
nevertheless be valid, and the City Council hereby declares that this Resolution
would have been enacted without such invalid provision.
Section 10. It is officially found, determined, and declared that the meeting at
which this Resolution is adopted was open to the public and public notice of the
time, place, and subject matter of the public business to be considered at such
meeting, including this Resolution, was given, all as required by Chapter 551,
Texas Government Code, as amended.
Section 11. This Resolution shall be in force and effect from and after its final
passage, and it is so resolved.
