A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, REQUESTING FINANCIAL
ASSISTANCE FROM THE TEXAS WATER DEVELOPMENT
BOARD; AUTHORIZING THE FILING OF AN
APPLICATION FOR ASSISTANCE; AND MAKING
CERTAIN FINDINGS IN CONNECTION THEREWITH
WHEREAS, Texas House Bill 500 from the 89th Legislative Session appropriated
$1.038 billion in funds for water supply and infrastructure projects to the Texas Water
Development Board (TWDB); and
WHEREAS, the TWDB is implementing the Water Supply Infrastructure Grant (WSIG)
to fund eligible City water supply projects; and
WHEREAS, the WSIG is provided as 100% grant with no local match required; and
WHEREAS, the funding limit for a community the size of the City of Schertz (between
10,001 to 150,000) is $21 million and funding may be used to cover grant administration, project
management, engineering services, and construction project -related expenses; and
WHEREAS, the City's Capital Improvement Plan includes a water project to construct a
24-inch dedicated transmission main to convey water from the East Live Oak Tank to the IH 35
Tank; and
WHEREAS, the City of Schertz wishes to apply through the TWDB WSIG program to
complete the dedicated transmission main project;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS, THAT:
Section 1. That an application is hereby approved and authorized to be filed with the
Texas Water Development Board seeking financial assistance in an amount not to exceed
$21 million to provide for the costs of the water improvement project known as the
Dedicated Transmission Main from East Live Oak to the IH 10 Tank.
Section 2. That Steve Williams, the City Manager of the City of Schertz, Texas, be and
is hereby designated the authorized representative of the City of Schertz for purposes of
furnishing such information and executing such documents as may be required in
connection with the preparation and filing of such application for financial assistance and
the rules of the Texas Water Development Board.
Section 3. Theat the following firms and individuals are hereby authorized and directed
to aid and assist in the preparation and submission of such application and appear on
behalf of and represent the City of Schertz before any hearing held by the Texas Water
Development Board on such application, to wit:
Financial Advisor: SAMCO Capital Markets, Inc.
Engineer: Kimley-Horn and Associates, Inc.
Bond Counsel: Norton Rose Fulbright
Section 4. All resolutions, or parts thereof, which are in conflict or inconsistent with any
provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved
herein.
Section 5. This Resolution shall be construed and enforced in accordance with the laws
of the State of Texas and the United States of America.
Section 6. If any provision of this Resolution or the application thereof to any person or
circumstance shall be held to be invalid, the remainder of this Resolution and the
application of such provision to other persons and circumstances shall nevertheless be
valid, and the City Council hereby declares that this Resolution would have been enacted
without such invalid provision.
Section 7. It is officially found, determined, and declared that the meeting at which this
Resolution is adopted was open to the public and public notice of the time, place, and
subject matter of the public business to be considered at such meeting, including this
Resolution, was given, all as required by Chapter 551, Texas Government Code, as
amended.
Section 8. This Resolution shall be in force and effect from and after its final passage,
and it is so resolved.
