This time is set aside for any person who wishes to address the City Council. Each person
should fill out the speaker’s register prior to the meeting. Presentations should be limited
02-14-2012 Minutes
to no more than 3 minutes. Discussion by the Council of any item not on the agenda

inquiry, a recitation of existing policy in response to an inquiry, and/or a proposal to
place the item on a future agenda. The presiding officer, during the Hearing of Residents
portion of the agenda, will call on those persons who have signed up to speak in the
order they have registered.
Mayor Baldwin recognized City Manager John Kessel who wished everyone a Happy
Valentine’s Day and announced it is always nice to see everyone. Mr. Kessel stated that he
has spoken over the last few months and again will start out the meeting as he has in the past
by reiterating a couple of points.
The City’s role in this matter is primarily to facilitate that dialogue between Pulte and the
homeowners. Each meeting he has offered to meet one-on-one with the homeowners and
also with Pulte to make sure those meetings are happening and that they are being
responsive. Mr. Kessel stated again he would extend that offer to each and everyone in the
audience that has a concern with the Fairhaven situation.
Mr. Kessel reiterated that he has enjoyed having the opportunity for citizens to speak in the
public forum. It is the right of the citizen to speak. The City has always done their very best
to make everyone feel welcome and to greet you when you come to the meetings. He hopes
that everyone appreciates that and he certainly does as well. Mr. Kessel stated that he would
like the homeowner to be thinking, as you are making your comments tonight whether you
would be willing to accept the City’s offer to help you set up a one on one meeting with
Pulte. The City Management’s office stands ready to assist in this.
Mayor Baldwin recognized the following who spoke regarding their issues with their homes,
Pulte Homebuilders, new information regarding their homes, their continued request for buy-
outs from Pulte, and thanking the City for their support:
• Heather Camelio, 5224 Brookline – only speak with Pulte regarding buyout
• Janice Lapham, 5236 Columbia Drive – only speak with Pulte regarding buyout
• Ken Russell, 6034 Mule Deer – only speak with Pulte regarding buyout
• Molly Casas, 5228 Brookline – only speak with Pulte regarding buyout
• John Fitzgerald, 5304 Storm King,– only speak with Pulte regarding buyout
• Bruce Touve, 5213 Brookline – only speak with Pulte regarding buyout
• Faye Touve, 5213 Brookline – only speak with Pulte regarding buyout
• Brian Benavides, 5237 Brookline – only speak with Pulte regarding buyout
• Tricia Mattison, P. O. Box 3022, Homeowners for Better Building
• Janet Ahmad, 18 Silverhorn, Homeowners for Better Building
Mayor Baldwin recognized City Manager John Kessel who stated that each week after the
citizens comments, he has extended the offer to help initiate dialogue with Pulte. He stated
that he understands the citizens are frustrated in hearing this.
02-14-2012 Minutes
Mr. Kessel stated the City is not in a position to buy back homes on Pulte’s behalf, nor are
we in the position to go in and make any repairs. We are not in a position to subpoena Pulte
or force them to do things; perhaps if you were a judge with a subpoena this could be done.
This leaves the City with the ability to create dialogue and he is not aware of any other way
to move forward today without this dialogue.
Mr. Kessel stated that we have looked at dispute resolution; it is easy to pull any book. The
very first thing any book on dispute resolution will say is, always keep the dialogue open.
Always try and create greater opportunities to have the other party and you change your
position to reach a greater understanding and appreciation of the other side. There is not a
way to reach that place without open discussion.
The City continues to do everything we can. The City does send the DVD’s of the Council
meetings to Pulte and asks them to review them. They are aware of the comments. The role
of the City is to help with creating dialogue between the two parties and he continues to offer
his assistance in setting up meetings with Pulte and the homeowners.
Mayor Baldwin provided the following closing comments:
The City continues to allow public comments regarding the buy back of homes from Pulte,
and the City understands the homeowner’s dilemma. The City is doing what we can do to
help, including sending the DVD’s of the Council meetings to Pulte and offering the
opportunity to set up meetings with Pulte on an individual basis. He does not feel that having
a group meeting would make a difference. A one on one meeting is the best way to go.
The City cannot stop Pulte from building homes in Schertz, as long as they are not building
in Fairhaven, which is already built out. These issues will certainly play a role in Pulte
building any new subdivisions in the City of Schertz. It is a Pulte decision to buy back
homes, not the City. Homeowners need to sit down with Pulte at their office and tell them
what you want. Tell them you want your home bought back. Homeowners are doing the right
thing by putting public pressure on Pulte.
Mayor Baldwin indicated that items 2, 3, 4, and 5 have been removed from the consent
agenda for separate discussion.
Consent Agenda
The Consent Agenda is considered to be self-explanatory and will be enacted by the Council
with one motion. There will be no separate discussion of these items unless they are
removed from the Consent Agenda upon the request by the Mayor or a Councilmember.
1. Minutes - Consideration and/or action regarding the approval of the minutes of the

Councilmember Edwards to approve the minutes from the February 7, 2012 regular
Council Meeting. The vote was unanimous. Motion carried.
Mayor Baldwin left the dais and asked Mayor Pro-Tem Scagliola to take over the meeting.
Discussion and/or Action Items
2. Resolution No. 12-R-11 – Consideration and/or action approving a Resolution
authorizing a Business Class Customer Service Order and Service Agreement with
Time Warner Cable and other matters in connection therewith. (J. Kessel/M. Clauser)
Mayor Pro-Tem Scagliola read the following caption into record:
RESOLUTION NO. 12-R-11
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS AUTHORIZING A BUSINESS CLASS CUSTOMER SERVICE
ORDER AND SERVICE AGREEMENT WITH TIME WARNER CABLE,
AND OTHER MATTERS IN CONNECTION THEREWITH
Mayor Pro-Tem Scagliola recognized Information Technology Director Myles
Clauser who introduced this item addressing questions from Council. Mr. Clauser
stated that action requested of Council approves the resolution approving a contract
with Time Warner Telecom for wide area network services to provide back up
connectivity to various City facilities. The contract will ensure reliable and resilient
communications between City facilities. Fiscal impact includes a one-time $1,000
installation and engineering cost as well as yearly service charges of approximately
$3,732 per facility covered. Initial costs for one location, the Public Works Complex,
are currently budgeted. Costs for additional City facilities will be added to the FY
2012-13 budget. Staff recommends approval.
Mayor Pro-Tem Scagliola recognized City Manager John Kessel who stated that we
need to be prepared for our worst case scenario days. Communication is the key
difference between success and failure on those worst days. We need to do this; it is a
smart plan. It does not tax our on going budget issues. This is a smart way to do
business and recommends Council’s approval.
Mayor Pro-Tem Scagliola recognized Councilmember Fowler who moved, seconded
by Councilmember Carpenter to approve the adoption of Resolution 12-R-11. The
vote was unanimous. Motion carried.
3. Resolution No. 12-R-12 – Consideration and/or action approving a Resolution
authorizing a Lease Agreement with Hewlett-Packard Financial Services, and other
matters in connection therewith. (J. Kessel/M. Clauser)
Mayor Pro-Tem Scagliola read the following caption into record:
02-14-2012 Minutes
RESOLUTION NO. 12-R-12
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS AUTHORIZING A LEASE AGREEMENT WITH HEWLETT-
PACKARD FINANCIAL SERVICES, AND OTHER MATTERS IN
CONNECTION THEREWITH
Mayor Pro-Tem Scagliola recognized City Attorney Katherine Tapley who stated that
the Master Lease Agreement was inadvertently left out of the Council packet, but was
provided earlier today. She stated that the City Attorney’s office has reviewed the
agreement and is very comfortable with the language of the agreement and
recommends approval. She stated the attachments that were included with the
agreement were provided in the Council packet and those have not changed.
Mayor Pro-Tem Scagliola recognized Information Technology Director Myles
Clauser who introduced this item stating that action requested of Council approves a
5-year lease agreement with Hewlett-Packard Financial Services to upgrade the City
telephone system and service agreement in the amount of $193,860 ($3,231 monthly
or $38,772 annually). The FY 2011-12 budget included $170,000 in the PEG Fund
for the project which would have covered the cost to purchase the system outright,
but did not include a service agreement.
The higher fee also includes finance charges of approximately $23,860. Staff
recommends approval of the lease and service agreement in an estimated amount of
$193,860 in which $170,000 will be paid from the FY 2011-12 adopted budget, and
$23,860 from the proposed FY 2012-13 budget. Staff recommends approval.
Mayor recognized Councilmember Carpenter who moved, seconded by Mayor Pro-
Tem Scagliola to approve the adoption of Resolution 12-R-12. The vote was
unanimous. Motion carried.
Mayor Baldwin returned to the dais.

authorizing a purchase agreement with U. S. Autoweapons, and other matters in
connection therewith. (J. Bierschwale/D. Taylor)

RESOLUTION NO. 12-R-13
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS AUTHORIZING A PURCHASE AGREEMENT WITH U.S.
AUTOWEAPONS, AND OTHER MATTERS IN CONNECTION
THEREWITH
02-14-2012 Minutes
Mayor Baldwin recognized City Attorney Katherine Tapley who stated this item had
been pulled from consent as there was a typo in the attachments. It should reference
that they are Colt AR 6950’s that they will be approving.
Mayor Baldwin recognized Police Captain Marc Bane who introduced this item
stating that action requested of Council authorizes the purchase of a Colt AR Long
Rifle for each City Police Officer to provide the additional tools they need to perform
their duties in protecting the community. The City Police Department currently owns
ten of these rifles and during their service life, they have performed flawlessly.
Captain Bane stated by purchasing the weapons, the Department will standardize the
firearms training program, the ammunition purchased and stocked, as well as the gun
safety lock systems within the fleet. Other advantages include the ability of officers
to share ammunition and ammunition magazines if involved in a fire fight, as well as
minimize the overall cost and reduce liability on the City and the Police Department.
Fiscal impact of approximately $35,000 will be paid for with seizure funds. Staff
recommends approval.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by
Mayor Pro-Tem Scagliola to approve the adoption of Resolution 12-R-13. The vote
was unanimous. Motion carried.
5. Resolution No. 12-R-14 – Consideration and/or action approving a resolution
authorizing the purchase of Dispatch Center Workstations, and other matters in
connection therewith. (J. Bierschwale/D. Taylor)
Mayor Baldwin read the following caption into record:
RESOLUTION NO. 12-R-14

POLICE DISPATCH CENTER
Mayor Baldwin recognized Police Chief Don Taylor who introduced this item stating
action requested of Council authorizes the purchase and installation of five
professional quality, around-the-clock performance rated, and ergonomic furniture for
the City 911 Dispatch Center. The upgraded work stations will assist personnel to
better perform their duties. Fiscal impact of approximately $36,000 will be paid for
with seizure funds. Staff Recommends approval.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by
Councilmember Antuna to approve the adoption of Resolution 12-R-14. The vote was
unanimous. Motion carried.
02-14-2012 Minutes
6. Resolution No. 12-R-15 - Consideration and/or action approving a resolution
authorizing the pursuit of a Power-up Grant from the Guadalupe Valley Electric
Cooperative, Inc. to fund the proposed Schertz Parkway and Main Street Holiday
Lighting project. (D. Harris/G. Logan)

THE GUADALUPE VALLEY ELECTRIC COOPERATIVE, INC. TO FUND

Mayor Baldwin recognized Councilmember Edwards who asked was this grant a
$5,000 matching grant? Parks, Recreation, and Community Services Director George
Logan stated that was correct.

CITY COUNCIL MEMORANDUM
City Council Meeting: February 21, 2012
Department: Development Services
Division: Planning and Zoning
Subject: Appeal: Hunter Estates – Denial of
Preliminary Plat - Hold an appeal hearing to
the decision made by the Planning and Zoning
Commission to deny a preliminary plat as a
result of a requested roadway variance for the
Hunter Estates Subdivision.
SUMMARY:
This item involves an appeal to the decision made by the Planning and Zoning Commission to deny the
preliminary plat of Hunter Estates Subdivision (as a result of a requested roadway variance); 24.269+
acres of land owned by Harry Hausman generally located east of Graytown Road. The property is zoned
Residential Agricultural (RA). The plat would establish 30 residential lots with 0.8090 dwelling units per
acre, which exceeds the minimum size required by the applicable zoning district. The subdivision is
required to have two points of access pursuant to UDC Sec. 21.14.1 L. The applicant requested a
variance from the minimum 50 foot ROW for a local street to provide the required secondary access from
Hunter Estates through Laura Heights Estates, Unit 5. The proposed 30 foot ROW (Ivy Moon) would
have 24 feet of pavement and a concrete header curb on both sides and would be open to the public. At
the January 11, 2012 Planning and Zoning Commission meeting, Mr. Greenwald moved to disapprove
the preliminary plat and variance request as presented based on the fact that the thirty foot (30’) right-of-
way (Ivy Moon) shown on the plat is not consistent with the street improvement standard requirements of
the City of Schertz Unified Development Code. Mr. Jacobs seconded the motion; the motion carried with
a unanimous vote 7/0.
Senior City staff had recommended that the Developer request the variance for several reasons. The
roadway system surrounding the subdivision is expected to be developed more broadly (by this
Developer) in the relatively near future, which roadway development will result in a standard-sized
secondary access street, and the proposed 24’ ROW is sufficiently wide enough to allow vehicles
(including fire trucks and EMS vehicles) to pass. The variance would safely address the secondary
access issues. The proposed preliminary plat otherwise complies with all City requirements.
GENERAL INFORMATION:
Owner/Applicant: Hold’em Investments, Harry Hausman
Project Engineer: Briones Engineering, Andy Rodriguez
LEGAL DESCRIPTION AND GENERAL LOCATION: This 24.269± acre tract of land is in the Stacy B.
Lewis Survey No. 317 and the Antonio Zamora Survey No. 36, City of Schertz, Bexar County, Texas and
is generally located east of Graytown Road.
City Council Memorandum

50499874.2
BACKGROUND:
This is the first application for this subdivision which is proposed at this time with only one unit; no master
plan was prepared.
GOAL:
The intent of the requested street variance is to provide the required two points of access pursuant to
UDC Sec. 21.14.1 L. The request for variance is to provide the secondary means of access by a
proposed 30 foot ROW (Ivy Moon) which would have 24 feet of pavement and a concrete header curb on
both sides and would be open to the public; no sidewalks.
COMMUNITY BENEFIT
By providing a secondary means of access, the City is ensuring two means of safe egress to not only the
residents within the subdivision, but also ensuring that emergency vehicles and utility vehicles have
secondary options for accessing the subdivision during construction and upon final acceptance of the
subdivision public improvements.
MINIMUM LOT DIMENSIONS:
SITE DESCRIPTION:
This site is currently undeveloped and the applicant is proposing 30 residential lots at a density of .0809
dwelling units per acre. The property is zoned Residential Agricultural (RA).
SPECIAL INFORMATION:
Public Services: This site is serviced by Schertz water; no city sewer is available, each site requires an
on site sewer facility (OSSF) which would be regulated by Bexar County.
Public Improvements: All streets will be developed to City of Schertz specifications including sidewalks
and public improvements will be bonded.
Parks: No parkland was dedicated for this subdivision. Parkland fees in the amount of $1,000 per lot will
be paid prior to recording the final plat.
Tree Preservation/Mitigation: No heritage or protected trees exist on the site.
VARIANCE:
Access and Circulation - The subject property is required to have two points of access pursuant to UDC
Sec. 21.14.1.
♦ The applicant requested a variance from the minimum 50 foot ROW for a local street to provide
the required secondary access from Hunter Estates through Laura Heights Estates, Unit 5. The
proposed 30 foot ROW (Ivy Moon) variance will have 24 feet of pavement and a concrete header
curb on both sides and be open to the public. The subject property will have access via Laura
Bluff from the Laura Heights Subdivision and the proposed 30 foot ROW known as Ivy Moon will
have access via Hallie Heights from the Laura Heights Subdivision.

APPEAL PROCESS:
This is an appeal of the Planning and Zoning Commission’s action on January 11, 2012 pursuant to UDC
section 21.12.8.B.2. The appeal should be conducted by City Council as follows:
1. City staff will present a brief statement of the facts.
2. A Developer representative will present a statement in support of the requested variance and
appealing the preliminary plat denial.
3. City Council may discuss the matter with City staff and the Developer representative.
4. By motion and second, the City Council should take one of the following three actions:
a. deny the appeal; or
b. approve the preliminary plat and variance as requested; or
c. approve the preliminary plat with the requested variance and/or other modifications.
PUBLIC NOTICE:
Notice of the appeal was published in “The Daily Commercial Recorder” on February 1, 2012 and in the
“Herald” on February 2, 2012. There were 3 notices mailed to surrounding property owners on February
1, 2012 and, as of this date, no responses have been received.
CITY COUNCIL CRITERIA FOR CONSIDERATION:
The City Council, in considering this appeal of the Planning and Zoning Commission’s action, should
consider the same criteria the Commission was required to consider, as follows:
1. Whether the plat is consistent with all zoning requirements for the property or any approved
Development Agreement;
2. Whether the plat conforms to the general layout of the Subdivision Master Plan (if applicable)
and is consistent with the phasing plan approved therein;
3. Whether the proposed provision and configuration of roads, water, wastewater, drainage and
park facilities conform to the master facilities plans for the facilities, including without limitation
the water facilities, wastewater facilities, transportation, drainage and other master facilities
plans; and
4. Whether the proposed provision and configuration of roads, water, wastewater, drainage and
park facilities, and easements and rights-of-way are adequate to serve the subdivision.
SUMMARY OF RECOMMENDED ACTION
Hunter Estates is proposed with 24.269± acres and 30 residential lots with 0.8090 dwelling units per
acre. The request for a variance to allow the secondary street to be constructed with a 30 foot ROW (Ivy
Moon) and 24 feet of pavement, a concrete header curb on both sides; and with no sidewalk, which may
be administratively waived by the City Manager per the UDC, Article 14 Transportation, Section 21.14.6.
By providing the secondary means of access, the City is ensuring two means of safe ingress/egress to

Ms. Sanchez explained the location of the site and surrounding properties. She commented that the Future
Land Use Plan designates the subject property for Industrial/Business Park uses and that staff feels that the
proposed rezoning request is generally consistent with the goals and objectives of the Comprehensive Plan
and the Unified Development Code. The applicant is requesting General Business District-2 (GB-2); the UDC
states that GB-2 is intended to provide suitable areas for the development of non-residential and light
industrial uses that offer a wide variety of retail and service establishments that are generally oriented toward
serving the overall needs of the entire community. The Master Thoroughfare Plan identifies the expansion of
Maske Road to a 60 foot right-of-way (ROW) and as this property develops, the property owner will be
required to dedicate the associated ROW to the City of Schertz. The subject property is located in the Air
Installation Compatible Use Zone (AICUZ) and is specifically located within the AICUZ – APZ II area;
which has the lowest potential for accidents according to the study. Many of the uses found in the GB-2
district are approved uses found within the AICUZ study such as shopping districts, recreation, trade, business
and offices. Randolph Air Force Base has been notified of the proposed zone change and is aware of the
City’s timeline in forwarding this request to City Council.
Mr. Richmond recognized the following:
· Robert Watts, CWS Architects, explained the possible uses for the subject property, but there are no
concrete plans as of the meeting.
The public hearing closed at 6:13 pm.
Discussion followed between Commission, Staff and the Applicant related to traffic safety, widening of
Maske Road, drainage and the approval process with Randolph Air Force Base.
Mr. Jacobs moved to forward a recommendation of approval to City Council with the condition that Randolph
Air Force Base provides a letter of no objection. Mr. Greenwald seconded the motion. Vote was unanimous.
Motion carried.
6. ITEMS FOR INDIVIDUAL CONSIDERATION:
A. PC2011-034 Hunter Estates Subdivision – Preliminary Plat
Consider and act upon a request of a preliminary plat of Hunter Estates Subdivision, consisting of
24.269+ acres of land containing 30 buildable residential lots located east of Graytown Road. This
property is currently zoned Residential Agriculture (RA).
Ms. Sanchez explained the request for preliminary plat. She commented that the site is currently undeveloped
and the applicant is proposing 30 residential lots. This site is serviced by Schertz water; no City sewer is
available, each site requires an on site sewer facility which is regulated by Bexar County, and no parkland was
dedicated for this subdivision. The Master Thoroughfare Plan identifies a proposed 86 foot right-of-way that
stretches from Lower Seguin Road to IH 10, which will be adjacent to this property to run north to south. The
applicant is providing a dedication for the 86’ right-of-way and landscape buffers for the proposed Boeck
Blvd; the alignment has been adjusted based on an agreement with the City Engineer, Director of
Development Services and City Management. The MTP also identifies a 60 foot proposed right-of-way that
connects Ware Seguin Road to Binz-Engleman Road through the subject property; however, review of the
MTP by staff has determined that the 60 foot right-of-way is proposed to be omitted during the next MTP
revision since the 86 foot ROW (Boeck Blvd) has been re-aligned and will provide for a connection to
Graytown Road and IH-10. She explained that the applicant is requesting a variance from the minimum 50
foot right-of-way for a local street to provide the required secondary access from Hunter Estates through
Laura Heights Estates, Unit 5. The proposed 30 foot street right-of-way (Ivy Moon) will have 24 feet of
pavement and a concrete header curb on both sides and be open to the public. The subject property will have
access via Laura Bluff from the Laura Heights Subdivision and the proposed 30 foot right-of-way known as

Ivy Moon will have access via Hallie Heights from the Laura Heights Subdivision.
Mr. Evans asked if the proposed 30’ right-of-way will be temporary and omitted upon the construction of the
proposed 86’ right-of-way.
Mr. Briones explained that the 30’ right-of-way will be a permanent City street.
Mr. Richmond asked if the lot dimension for lots 11 and 12 could be realigned to widen Ivy Moon.
Mr. Briones explained that they would consider the suggestion.
Mr. Richmond expressed his concern with the frontage on Lot 17, Block 11.
Mr. Briones explained that he would pass the suggestion on to the developer.
Mr. Dahle requested more information on note number 12 related to the drainage easement and fences within
the easement.
Mr. Briones explained that the Home Owners Association would be the enforcement authority for note
number 12 to ensure compliance.
Mr. Crawford expressed his concern with the variance request of the 30 foot right-of-way. He explained that if
the road was for emergency use what would prohibit parking on the street. This could become a health and
fire safety problem if an emergency arises.
Mr. Briones suggested no parking signs.
Discussion followed between the Applicant, Commission and Staff related to the variance request of the 30
foot right-of-way and the concerns for safety of the residents and the drainage into the adjacent pond.
Mr. Briones commented that everything including State Laws related to drainage had been taken into
consideration.
Mr. Richmond summarized the discussion for the record and concluded that the proposed 30 foot right-of-way
would be permanent.
Mr. Briones confirmed that the 30 foot right-of-way is being proposed as a permanent street dedicated to the
City of Schertz.
Mr. Greenwald moved to disapprove the preliminary plat and variance request as presented based on the
criteria that the thirty foot (30’) right-of-way (Ivy Moon) shown on the plat is not consistent with the street
improvement standard requirements of the Schertz Unified Development Code. Mr. Jacobs seconded the
motion. Vote was unanimous. Motion carried.
B PC2011-055 Verde Enterprise Business Park – Amended Master Plan
Consider and act upon a request for an amended master plan of the Verde Enterprise Business Park,
a 209.713± acre tract of land in the Torbio Herrera Survey No. 68, City of Schertz, Guadalupe and
Comal County, Texas and is located south of Tri-County Parkway on IH 35. The property is zoned
Planned Development District (PDD).
Ms. Sanchez gave a short presentation of this master plan amendment. She explained the purpose of the
amendment is to provide updates and clarification for the additional Units (lots) proposed. Units 14-A and
14-B are proposed changes to this master plan including the addition of Unit 16, 17 and 18. A new phasing
and development schedule has been added. The Master Plan was revised and approved by the Planning and
Zoning Commission on June 13, 2007, August 25, 2010 and October 13, 2010. The proposed drainage
channel for this project will remove parcels from the floodplain.
Mr. Evans explained his observations of the existing drainage channel and the erosion that is taking place
within the Subdivision.
Mr. Jacobs moved to approve this item. Mr. Greenwald seconded the motion. Vote was unanimous. Motion
carried.

Workshop Discussion Agenda No. A
CITY COUNCIL MEMORANDUM
City Council Meeting: February 21, 2012
Department: Development Services
Subject: Discussion regarding the intent to revise
Article 10, Parking Standards of the
Unified Development Code
BACKGROUND
The restated and amended Unified Development Code was adopted on May 24, 2011 and
includes Article 10 – Parking Standards.
With the development of recent office/warehouse/distribution facilities including Sysco and
Caterpillar and with the anticipation of other similar facilities, staff and management have
discovered that the parking standards for these types of facilities are not entirely accurate to the
operations they may conduct.
Other developments that have been faced with parking challenges and that have either opted for
or have the option of requesting a variance to the UDC include school projects, church projects
and the senior’s multi family apartment facility. Other developments have requested an
allowance for compact cars, which the current UDC does not offer.
Current parking standards either allow for too few or require too many parking spaces resulting
in “over or under parked” facilities.
Current parking standards for the types of projects mentioned above are as follows:
Section 21.10.4 Schedule of Off-Street Parking Requirements
Off-street parking shall be provided in sufficient quantities to provide the following ratio of
vehicle spaces for the uses specified in the districts designated:
Table 21.10.4 Schedule of Off-Street Parking Requirements

other common place of assembly
School, High School And
Vocational
1 space for every three (3) students, faculty and
staff plus 1 space for every four (4) seats in any
auditorium, gymnasium or other common place of
assembly (based on maximum design capacity)
Warehouse
1 space for each 2 employees or 1 space for each
1,000 square feet of total floor area, whichever is
greater
GOAL
The City’s intent and desire is to encourage more industry that is focused on technology and self
automation such as that of the Caterpillar Machine Head Facility. These types of industry uses
bring in expensive high dollar equipment with their operations and production which provides
for sustainable warehouse and manufacturing business. And with self automation, the need for
fewer employees/staff and visitors results in the need for fewer parking spaces.
COMMUNITY BENEFIT
To provide aesthetically pleasing and beautifully landscaped parking lots that do not provide an
over-abundance of unnecessary parking spaces, and to provide safe and effectively functional
parking lots catered to the type of operation or development on the property. Yet, to have the
ability to require additional parking as business and occupancies change or expand.
SUMMARY OF RECOMMENDED ACTION
To authorize staff and management to begin the revision process to provide suggested changes to
the Planning and Zoning Commission and City Council on UDC Article 10, Parking Standards.
FISCAL IMPACT
None.
RECOMMENDATION
To authorize staff and management to begin the revision process to provide suggested changes to
