FAX (210) 658-9627 BOARD OF ADJUSTMENT MONDAY, MARCH 26, 2007 MINUTES The Schertz Board of Adjustment convened a public hearing on Monday, March 26,2007 at 6:00 p.m. in the Municipal Complex Council Chambers, Building #4, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman James C. Harden, Jr. Joe Potempa Norman Slocum Donald McQueen, Alternate Leonard Weinand, Jr. Alternate William Sommers, P&Z Commissioner CITY STAFF Leonard Truitt, Director of Development Services Debbie Perrone, Administrative ASsistant MEMBERS ABSENT Ted Duigon, Vice Chairman OTHERS PRESENT Mr. Daniel Tebon, 3900 Cherry Tree Drive Mr. Wade McGinnis, Barshop & DIes Company William VandenBosch, Barshop & DIes Company Mr. Brockman, 1000 Elbel Rd 1. CALL TO ORDER: Mr. HamoS! called the meeting to order at 6:00 pm. 2. CITIZEN COMMENTS: Citizen comments on items other than those listed on this agenda. None 3. Consider and act upon approval of the minutes for February 12, 2007 Mr. Potempa motioned that the minutes for February 12, 2007 be approved. Mr. Harden seconded the motion. Vote unanimous, motion carried. 4. PUBLIC HEARING: A BOA2007-002 Hold a public hearing and consider and act upon a request to encroach 5.5 feet in to the 10- foot rear building setback to construct a 12-foot by 40-foot deck located at 3900 Cherry Tree Dr., Lot: 12, Block: 30, Whisper Meadow Sub-division. Applicant: Mr. Dan Tebon *Note: 7 letters were sent out 1 reply back. Mr. RamoS! closed the public hearing at 6: 10 pm. Mr. Truitt said that because the irregular shaped lot located in a R-5 zoning district that requires a ten (10) foot building setback staff approves the variance to encroach five-foot, five-inches (5'5") into the rear yard-building setback. Mr. Potempa made the motion to approve the request to encroach five-foot, five-inches (5'5") into the 10-foot rear building set back to construct a 12-foot by 40-foot deck. Mr. Slocum seconded the motion. Vote unanimous, motion carried. B BOA2007-004 Hold a public hearing and consider and act upon a request for one wall sign on the front of proposed hotel, facing 1-35, with individual illuminated letters, with a total area of 145 square feet located at Conidor Loop Road, Lot: 8, Block: I, Schertz-Fairfield Inn & Suites Subdivision. Applicant: William VandenBosch, AlA, Vice-President - Conidor Properties, Ltd Mr. HartzoS! closed the public hearing at 6:30 pm. Mr. Truitt said staff has reviewed this request and recommends approval. Mr. Harden made a motion to approve the variance request for a 145 square foot illuminated wail sign to be placed on the front of the proposed Fairfield Inn & Suites hotel, which will face 1-35. Mr. Potempa seconded the motion. Motion carried. Mr. Potempa, Mr. Harden, Mr. McQueen and Mr. Hartzog voted in favor of the request. Mr. Slocum voted against the request. C B0A2007-005 Hold a public hearing and consider and act upon a request for one wall sign on the south side of proposed hotel, facing FM 3009, with individual illuminated letters, with a total area of 101 square feet located at Conidor Loop Road, Lot: 8, Block: I, Schertz-Fairfield Inn & Suites Subdivision. Applicant: William VandenBosch, AlA, Vice-President - Conidor Properties, Ltd Mr. HartzoS! closed the public hearing at 6:45 pm. Mr. Potemoa made a motion to approve the variance request for a one hundred and one (101) square foot illuminated wall sign facing in the direction ofFM 3009. Mr. Harden seconded the motion. Motion canied. Mr. Potempa, Mr. Harden, Mr. McQueen and Mr. Hartzog voted in favor of the request. Mr. Slocum voted against the request. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: There were no individual items for consideration. 6. ITEMS FOR DISCUSION by Board of Adjustment-None City Staff-None 7.
