RESOLUTION NO. 07-R-36
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS REQUESTING THE, RELEASE OF
EXTRATERRITORIAL JURISDICTION BY THE CITY OF SAN
ANTONIO TO THE CITY OF SCHERTZ AND PROVIDING FOR THE
INCORPORATION OF THE RELEASED EXTRATERRITORIAL
JURISDICTION BY THE CITY OF SCHERTZ.
WHEREAS, the City of San Antonio's extraterritorial jurisdiction (ETJ) extends
and is contiguous to the ET J of the City of Schertz along IH 10 and FM 1518; and
WHEREAS, by this Resolution the Schertz City Council is requesting that San
Antonio City Council release the ETJ as shown in Exhibit A. so that Schertz can extend
its ET J to that area; and
WHEREAS, the ETJ as shown in Exhibit A. will have direct fiscal and land use
impacts on the City of Schertz; and
WHEREAS, the City Council of the City of Schertz respectfully requests the
release ofthis ETJ so that the City can serve this area; and
WHEREAS, the City of Schertz intends to update their Comprehensive Plan to
include any release ofETJ; and
WHEREAS, the City of Schertz understands that the City of San Antonio is in the
processes of updating their East IH 10 Corridor Perimeter Plan which includes this ETJ;
and
WHEREAS, the City of Schertz intends to develop a Comprehensive Plan for this
ET J that is consistent with the City of San Antonio's East IH 10 Corridor Perimeter Plan
in order to provide rules and regulations for development within the area and
enforcement of rules and regulations as authorized by State law to protect the health,
safety and welfare of the public.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
SECTION 1. The City Council of the City of Schertz hereby respectfully requests
that the City Council of the City of San Antonio release the area shown in Exhibit A and
described as follows:
Approximately 3,500 acres of land located north of Interstate Highway 10,
east of Farm to Market Road 1518, south of the existing city limits line
adjacent to Lower Seguin Road and west of the centerline of Cibolo Creek
and more particularly described by metes and bounds in Exhibit B.
SECTION 2. The City Council of the City of Schertz will extend their ETJ to this
area once the City Council of the City of San Antonio has released the ETJ in accordance
with Texas Local Government Code ~ 43.023.
SECTION 3. The City Council ofthe City of Schertz recognizes the significance of
the ET J that the City of San Antonio is releasing and would like to express its gratitude to
the City Council of the City of San Antonio for its cooperation in the release of said ETJ
and acknowledges the "good neighbor" efforts of the City Council of the City of San
Antonio so that the City of Schertz can serve this area.
