RESOLUTION NO.

A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING A SERVICES AGREEMENT WITH
AMERICAN TRAFFIC SOLUTIONS, INC.
WHEREAS, the City Council of the City of Schertz, Texas (the "City") has amended
Chapter 86 of its Code of Ordinances to adopt a Photographic Traffic Enforcement System (the
"System"); and
WHEREAS, the City Council desires to contract with an experienced company to assist
the City in administering the System; and
WHEREAS, City staff recommends that the City implement a photographic enforcement
system that, among other attributes is (i) a single camera system that captures two 12.4
megapixel digital color images (scene images) on a 4-lane roadway with the ability to extract the
license plate image solely from one of the two scene images; (ii) capable of simultaneous cross
lane multi-violation detection and capture; (iii) capable of live remote video viewing, connection
of up to 4 individual video cameras, long term (30 to 60 da~) streaming video recording, and
subsequent recall from storage and variable timeframe violation video clip capture and retrieval;
and (iv) capable of video recording with sound; and
WHEREAS, City staff has determined that American Traffic Solutions, Inc. is the sole
source for a photographic enforcement system described in the preceding recital; and
WHEREAS, the City is not required to seek bids or proposals when one vendor is the
sole source for the equipment and technology required by the City; and
WHEREAS, the City Council has determined to enter into a Services Agreement with
American Traffic Solutions, Inc. in substantially the form attached hereto as Exhibit A for such
purpose.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
Section 1. The City Council hereby authorizes the City Manager to execute and
deliver a Services Agreement with American Traffic Solutions, Inc. in substantially the form set
forth on Exhibit A hereto, with any additions and modifications which are not inconsistent with
such terms and with all Schedules thereto completed in a manner acceptable to the City Manager.
Section 2. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings ofthe Council.

Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 4. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section 5. Ifany provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the Council
hereby declares that this Resolution would have been enacted without such invalid provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Government Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final
passage, and it is so resolved.
