The Schertz Planning and Zoning Commission convened on October 14, 2003 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway, Schertz, Texas.

Chairman Richmond called the meeting to order at 6:30 p.m.
PUBLIC HEARINGS
2. SUP37-03
Public Hearing on a request for a Specific Use Permit for a second residential dwelling unit on
one parcel. The property is located at 411 Curtiss.
Applicant: Harold and Linda Reno
Ms. Linda Reno addressed the Commission asking for a specific use permit to allow for a second
dwelling unit on her property for her ailing mother. She also stated that she understood that her mother
would be the only person allowed to use the residence.
There being no one else to speak, Chairman Richmond closed the Public Hearing.
3. Convene into Regular Session of the Planning and Zoning Commission
Chairman Richmond reconvened into regular session at 6:35 p.m.
4. Board of Adjustment Actions:
. The next Board of Adjustment meeting is scheduled for October 27,2003.

Discuss and take appropriate action request for a Specific Use Permit for a second residential
dwelling unit on one parcel. The property is located at 411 Curtiss.
Applicant: Harold and Linda Reno
Ms. Madison reviewed staff comments. Mr. Evans asked the applicant why her mother couldn't live in
the main house, and Ms. Reno responded that her mother was very independent and refuses to move into
the main house.
Following discussion, Mr. Sommers moved to forward this item to City Council with a recommendation
of approval to allow for the Specific Use Permit. Mr. Haddock seconded the motion. Motion carried.
Vote unanimous.
7. PC569-03
Discuss and take appropriate action on a request for final plat of Northcliffe II Subdivision,
Unit 2. The request is for 82 residential lots on 14.89:t acres located at the intersection north of
Cherry Tree and Whisper Haven.
Applicant: 1103 Land Development Ltd.
. Ms. Madison reviewed staff comments.
Mr. Haddock inquired if Cherry Tree would be opened to allow access to the entire subdivision. Mr.
Kerry Koehler, W.F. Castella and Associates, answered yes. Mr. Evans asked for a clarification of note
number 8: "All common areas, greenbelts, and drainage easements will be owned and maintained by the
homeowners association", and asked for a legal opinion. Ms. Madison stated she would notify the City
Attorney.
Following discussion, Mr. Wallace moved to approve the final plat. Mr. Sommers seconded the motion.
Motion carried. Vote unanimous.

Discuss and take appropriate action on a request for a preliminary plat of the Nell Deane
Subdivision. The request is for 15 commercial lots on 20.094:t acres located on FM 1518
approximately 131::t feet south of Commercial Place.
Applicant: MBC Engineers
Ms. Madison reviewed staff comments. Mr. Sommers asked if Lot 7, Block 3 was land-locked and Mr.
Robert Copeland stated no. Mr. Evans asked that a note on the plat be added to reflect that the only curb-
cut along FM 1518 will be Lot 31 on Block 1.

Following discussion, Mr. Wallace moved to approve the preliminary plat. Mr. Haddock seconded the
motion. Motion carried. Vote unanimous.

Applicant: MBC Engineers
Following review and discussion, Mr. Haddock moved to approve the final plat subject to the following
changes:
1. Note added reflecting all driveway locations will comply with the Unified Development Code
requirements.
2. Note added reflecting a solid masonry fence will be installed adjacent to the residential district.
Mr. Wallace seconded the motion. Voting Aye: Mr. Richmond, Mr. Haddock, Ms. Briscoe, Mr. Wallace
and Mr. Sommers. Voting Nay: Mr. Evans. Motion carried.
10. PC587-03
Discuss and take appropriate action on a request to replat Block 2, Lot 5 of the Tri-County
Business & Industrial Park, Unit 1 and establishing Block 2, Lot 15 of the G.D. Bar Subdivision
II containing 3.845 acres. The property is located at the northeast intersection of Tri-County
Parkway and IH 35 North.
Applicant: Don McCrary & Associates Inc.

Ms. Madison reviewed staff comments. Mr. Evans requested that acreage be noted on the remaining
portion of Lot 5, Block 2, as well as the acreage for Lot 2, Block 14. Mr. McCrary stated he would make
the necessary changes. Mr. Richmond suggested that a nice landscape plan would be beneficial to the
applicant due to the high visibility of this lot.
Following discussion, Mr. Sommers moved to approve the rep1at. Mr. Wallace seconded the motion.
Voting Aye: Mr. Richmond, Mr. Haddock, Ms. Briscoe, Mr. Wallace and Mr. Sommers. Voting Nay:
Mr. Evans. Motion carried.
11. PC590-03
Discuss and take appropriate action on a request for site plan approval of Schertz Industrial
Park, Block 1, Lot 16. The request is for one industrial lot on 1.94:t acres located on Bell North
Drive with 20,400 square feet of professional office/warehouse space.
Applicant: J.M. Properties
Ms. Madison stated the applicant had requested this item be withdrawn from the agenda. Chairman
Richmond accepted the applicant's withdrawal.
12.

Discussion regarding a request for a site plan of the Legacy Oaks Apartments. The request is
for 256 units on 19.588:t acres located at Schertz Parkway and Legacy Oaks Parkway,
approximately 760 feet south of IH 35.

Ms. Madison reviewed staff comments and noted this item was placed on the agenda for discussion only.
Mr. Copeland reviewed the proposed site plan with the Commission. Discussion included: parking
variance, parking in the Schertz Parkway Overlay District, fencing at the rear and side of the property,
tree mitigation, driveway locations, sidewalks, and drainage.
Discussion only. No action taken.
13. Items by Commissioners and City Staff
a. Discussion of items to be presented to City Council at future joint workshop.
Ms. Madison: Announced her appointment to the Executive Board of the EDC Institute. The
Commission congratulated her.
Ms. Briscoe: Inquired about the sign on the ProLogis building and asked if it complied with the Unified
Development Code. Ms. Madison stated that the building code compliance item would be on the next
agenda to update the Commission.
Mr. Sommers: Thanked City Council for allowing the Planning and Zoning Commission to attend the
AP A conference. The information from the conference is very helpful.
Mr. Haddock: Voiced concerns on parking space requirements. He stated that larger vehicles
(trucks/SUVs) outsize the current standard and suggested enlarging the width to 10-feet.

Mr. Richmond: Also thanked City Council for allowing the Commissioners to attend the AP A
conference. Mr. Richmond asked staff to place the following items on the next agenda: update of
building code enforcement issues, election of officers, update for zoning maps and overlay districts. Mr.
Richmond also asked for a joint workshop with City Council to review the Commission's objective.
14. Adjournment.
There being no further business, Ms. Briscoe moved to adjourn the meeting at 8:35 p.m. Mr. Sommers
seconded the motion. Motion carried. Vote unanimous.
