PLANNING & ZONiNG MINUTES
The Schertz Planning and Zoning Commission conducted a Public Hearing on Tuesday
June 22, 1999, at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Schertz, Texas. Those present were as follows:

#1 Call to Order:
Chairman Evans called the meeting to order at 7:00 p.m. and explained the procedures
followed at a public hearing and thanked everyone for their interest and concern. The
City Council public hearing on this request will be scheduled and announced at a later
date.
#2 Public Hearing: To receive citizen input on a request from the City of Schertz
to make changes to the Unified Development Code (UDC), Article III, Section 1.2,
. Zoning Districts Established. (ZC #162-99).

Chairman Evans at this time asked Mr. Steve Simonson for staff input.
Steve Simonson stated this is a two part change previously discussed, one is to correct
an amiably to section 1.2 which did not clearly specify where manufactured homes can
be placed. The other is an editorial correction to correct 1.2 to 1.3 to complete the
numbering of the two paragraphs.
With no other comments or discussion Chairman Evans closed the Public Hearing on
the request from the City of Schertz at 7:04 p.m.

Chairman Evans adjourned the Public Hearing at 7:04 p.m.
The Schertz Planning and Zoning Commission convened in a regular session, after the
. Public Hearing.
#4 Call to Order:
Chairman Evans called the June 22, 1999 regular meeting to order at 7:05 p.m.

Approval of Minutes:
Regular session of June 08, 1999.
Chairman Evans asked if there are any correction or additions to the minutes?
Ernie Evans pointed out one correction on page 6 third paragraph, delete one of two
"request from" in the second line.
With no additional corrections Tony Moreno made a motion that was seconded by Keith
Van Dine to approve the minutes of June 08, 1999 as amended. Upon a vote being
. called, the vote was as follows:

Abstention: Joyce Briscoe (absent at said meeting).
#6 Status of Final Plats:
There were none.
#7 BOA Actions:
Steve Simonson reported the approval by the Board of Adjustment on two Special
Exceptions to the Zoning Ordinance on requests from Robert & Jayne Creasy, 3505
Gamble, and Malcom Morgan, 3816 Forsyth Park at the meeting of June 21, 1999.
#8 Citizen's Input Other Than Agenda Items:
There were none.
. #9 Consider and Take Appropriate Action: Request from the City of Schertz
to make changes to the Unified Development Code (UDC), Article III, Section 1.2,
Zoning Districts Established. (ZC #162-99).
Steve Simonson reiterated the changes to the Unified Development Code and remarked
these changes are necessary for the City to move forward.
With no comments or discussion, David Richmond moved to forward to the City Council
recommending approval and that Public Hearings are scheduled on the request from
the City of Schertz to make changes to the Unified Development Code (UDC), Article
III, Section 1.2, Zoning Districts Established. Tony Moreno seconded the motion, which
carried with a unanimous vote.
#10 Consider and Take Appropriate Action: Request from Andy Mendez,
1104 Morning Rose, Dove Meadows for a Special Exception to the Zoning Ordinance to
. encroach 9' into the 20' rear yard setback for construction of a deck.

Steve Simonson commented this request is major construction tied to the house
foundation. The deck is an extension from the house with plumbing for a spa. No
encroachment into the side yard and there are no rear yard easements.
Gary Wallace asked if "it is strictly a building setback"? Steve Simonson answered, yes.
Ernie Evans asked Mr. Mendez how far off the ground is the deck? Mr. Mendez stated
about 2' even at the rear of the house.
Tony Moreno asked if there are steps leading down onto the deck? Mr. Mendez stated
that there are no steps, the deck is right out the back door.
With no further discussion, a motion was made by Keith Van Dine and seconded by
Gary Wallace to forward to the Board of Adjustment with a recommendation of approval
the request from Andy Mendez, 1104 Morning Rose, Dove Meadows for a Special
. Exception to the Zoning Ordinance to encroach 9' into the 20' rear yard setback for
construction of a deck. With a vote being called, the motion was approved.
#11 Consider and Take Appropriate Action: Request from Tim Fetter for Site
Plan Approval of Fetter Subdivision, Ashley Oak Dr. (PC #41 OA-99).
Steve Simonson commented that in his notes to the Commission, he explained that the
building would not interfere with any trees. The tree survey provided by Mr. Fetter is
correct. The tree count and landscape information are placed, no fence and trash
container are to be used. Site plan indicates how the sidewalk would be moved to get
around the trees.
Ernie Evans asked what does the number 3600 signify that is denoted on the site plan?
Mr. Fetter stated that 3600-sq. ft. is the building footprint. Ernie asked what decision
has been made as to which sign will be used? Mr. Fetter stated he hasn't decided it will
. be either of the two: pole sign or the monument sign. Mr. Fetter explained that until the

project is further along would a determination be made. Visibility, aesthetics, etc., are
details that would be considered. Mr. Fetter commented he is leaning toward the
monument sign.
Steve Simonson stated that whichever sign Mr. Fetter decides, both signs are
authorized signs.
Joyce Briscoe stated that her personal preference is the monument sign and trusts the
decision would be the monument type sign.
Tony Moreno asked if there is mandatory fencing for commercial property? Steve
Simonson stated not unless it backs up or is adjacent to a residential area. The back
portion of the property (5 acres) is a considerable distance from the residential area. If
development occurs or changes, Mr. Fetter would have to meet the requirements.
. Tony Moreno asked if there are plans for the rest of the property (back portion)? Mr.
Fetter stated the area would be left in its natural state.
With no further discussion, a motion was made by Gary Wallace and seconded by
Keith Van Dine to approve the request from Tim Fetter for Site Plan Approval of Fetter
Subdivision, Ashley Oak Dr. With a vote being called, the motion was approved.
#12 Consider and Take Appropriate Action: Request from MBC Engineers,
Inc. for Preliminary Plat Approval of Arroyo Verde Subdivision, Unit 2.
Steve Simonson stated this unit would finish the subdivision. The 20' emergency exit
easement that is required has been shown. Steve commented that it has been brought
to his attention that to save a 44" round diameter tree on Arroyo Del Sol the developer
has requested the placement of an island. The required driving surface around an island
. is 15' on either side of the island, however the request is for 15' and 12' to leave enough

area around the island to accommodate the large tree. Steve mentioned the request
was received today and the Fire Department has not had time to review the driveway
issue. Concerns are the driveways that would be against the island. The fire department
would need to give the okay, and these issues would have to be worked out before final
plat. Such as, labeling the island, maintenance, etc. Steve commented that until he
receives the information from the fire and public safety departments City Staff could not
give the Commission a recommendation. An answer will be provided by final plat
presentation.
Tony Moreno commented it is commendable they are trying to save the tree, and asked
how is it determined how much room is needed, is there a "rule of thumb"? Sam
commented there is no definite rule of thumb, you always want to give the large trees as
much room as possible. In this particular plat there was 25' to play with, initially 15' was
set up for both lanes and 15' for the island. However, the tree does not fall exactly in the
middle of the island, which met cutting down one lane to 12', allowing enough room.
Gary Wallace asked if the Oak Forest Homeowners' Association (HOA) ever revisited
the potential of Golden Oak going through? Steve Simonson stated Oak Forest
homeowners are still adamant about no connection. Gary reminded everyone that Oak
Forest homeowners had objected to Golden Oak going through. At the time the
subdivision behind Oak Forest had not been presented and the homeowners' were
afraid that traffic would flow from the Arroyo Verde Subdivision through theirs. Oak
Forest homeowners are faced with their own problem. It seems that access to the
stoplight that is likely to go in at Savannah Drive could be used to their advantage.
Gary commented he didn't know if it would be worth revisiting the issue with the
homeowners', however it's worth a try.
Sam Bledsoe commented he recalls the conversations with the Oak Forest
homeowners not wanting the street to go through. Gary Wallace suggested the
homeowners' could be contacted to find out if there has been some change to their
. decision. Would it be beneficial to Arroyo Verde to have Golden Oak go through causing

a second entrance? Sam stated they could try to contact the Oak Forest homeowners'
and see if they would be interested.
Ernie Evans asked who is the property owner behind the subdivision? Sam Bledsoe
stated he wasn't sure. Steve Simonson questioned whether it's Besch or the Harborth
property? Sam stated he didn't think it was the Harborth property. Steve stated this
information would be needed for the final plat.
Ernie Evans asked if the preliminary plat was approved and construction plans were
approved could construction commence? Steve Simonson replied, yes.
With no further discussion, a motion was made by Gary Wallace seconded by Tony
Moreno to approve the request from MBC Engineers, Inc. for Preliminary Plat Approval
of Arroyo Verde Subdivision, Unit 2. With a vote being called, the motion was
approved.
#13 Consider and Take Appropriate Action: Request from M.W.Cude
Engineers, LLC for Preliminary Plat Approval of Woodbridge Subdivision Unit 2.
Steve Simonson stated this is the continuation of the second unit to the subdivision. The
landscape non-access easement of 10' along Schertz Parkway has been placed. Steve
Simonson asked Mike Cude if the GVEC electrical easement through lots Lot 17 and 18
would be removed before final plat? Mike Cude replied, yes. Steve stated he wanted
mention of this issue to insure that the easement would be removed before final plat
presentation.
With no further discussion, a motion was made by Tony Moreno and seconded by Gary
Wallace to approve the request M.W.Cude Engineers, LLC for Preliminary Plat Approval
of Woodbridge Subdivision Unit 2. With a vote being called, the motion was approved.

Ken Greenwald:
Ken mentioned he was thankful for the rain, the city was getting close into entering
Stage 1 of Water Conservation. Ken reported that the water project is continuing and
will be making announcements next month on land acquisitions etc. A Preliminary route
has been layout and we are looking at other city participation. Everyone has to
understand that the days of cheap water are long gone.

Steve Simonson:
Steve mentioned a correction on the total number of homes for the housing
development proposed by the City of Cibolo as mentioned in his notes. The number
stated was 1800 homes, the correct number is 900 homes. The proposed development
will not have a stub out from Oak Trail Subdivision. He has received calls from the Oak
Trails developer proposing turning some of the area of the property into park area
instead of a major road to buffer the area. If Cibolo's housing development goes through
the City's master plan of connecting Greenvalley Road to IH 35 by Wiederstein Road is
meaningless. Steve suggested the Commission take a good look at the master road
plan for the City because if this development it would but a lot of pressure in the area.
Cibolo has ignored letters, talks and any suggestions from this City, and mentioned that
he was publicly humiliated at a meeting in Cibolo. Jim Wolverton was present at said
meeting and was the only person that stood up for the City of Schertz.
. Tony Moreno suggested meeting with the Cibolo Planning & Zoning Commission in a
joint meeting to share concerns between our two communities.
Gary Wallace asked if Greenvalley Loop was in the city limits of Schertz or Cibolo and
was it advised it was in the City of Cibolo. If the residents of Greenvalley Loop are not
aware of the proposed development they will know soon.
Steve mentioned that if this development occurs the City of Schertz has a mutual land
agreement with Cibolo for Fire protection. Cibolo's Fire Department is some distance
from this area, if there is a fire, "who do you think they will call first"? Cibolo's Fire
Department is strictly volunteer.
Joyce stated that she is in favor of Tony Moreno suggestion; to meet with the Planning
and Zoning Commission and build a base of support to counter act any movement that
is QoinQ on in Cibolo.

Steve Simonson stated that he has talked to some people in Cibolo and they are aware
of our maps and concerns and know what the City of Schertz has done. Steve also
mentioned that Greenvalley Road is a County Road. The county original was going to
fund money to help build the road but because they are not working with the county the
county back out. The City of Cibolo is going behind their back.
Ernie Evans asked if Greenvalley road is an officially county road and if the
development is approved will the County bound to improvements to the road? Steve
Simonson replied he did not have an answer. Tony Moreno stated he believed so,
because it is designated as a county road.
Ernie Evans stated that if the development occurs, the Commission should express
concern both from the Commission and possibly the City Council. The Commission can
not speak for the City Council however; I can speak for this Commission. If this
development is allowed to go through, the road is not capable of carrying half of the
. proposed housing and Cibolo ought to improve the road. We as the Commission
should go on record voicing our concerns. Steve Simonson mentioned that the
Commissioner for this area is Jim Wolverton.
Ernie Evans asked if it is the consensus of this Commission to send a letter to the
Planning and Zoning Commission of Cibolo expressing concerns from our Planning and
Zoning Commission asking for a joint meeting to discuss mutual development issues.
The Commission was in agreement to send the letter. Ernie Evans asked if the
Commission wanted to express our concerns also to the County Commissioner, Jim
Wolverton? The Commission was in agreement to do so and felt this was where the
Commission should start to work with instead of the City of Cibolo. It was agreed to
send the letter to County Commissioner Jim Wolverton.
Ernie Evans stated that he would work on drafting letters to the Planning and Zoning
. Commission of Cibolo and the County Commissioner, Jim Wolverton this week.

Steve Simonson mentioned receiving a call from Mr. Joe Veytia, who is proposing a
module home subdivision. Mr. Veytia would like to know if the Commission would
consider this type of development at the corner (Elbel & Schertz Parkway) lot for single
family lots.
Gary Wallace asked if this would require a zoning change and was advised that a
zoning change would be needed. Steve Simonson mentioned that the zoning was
changed to a specific use for what was going to be developed. This did not occur and
the City of Schertz reversed the zoning change. Mr. Veytia would like to know if it is
worth coming in to talk with the Commission. Would the Commission consider this type
of development or would the Commission want it to stay as a business corner and not
have any home development?
Gary Wallace asked if a masonry fence all around the development would be placed.
Steve answered yes, wood fencing would not be allowed.
Joyce Briscoe asked if a cost of home was given and was advised between 50 and 60
thousand dollars. Steve Simonson stated that once the home is placed and skirted it
resembles any house on any subdivision. The home is a direct competition with
manufactured home complexes.
Ernie Evans asked if there have been inquires for the corner lot being used for (NS)
Neighborhood Services or Commercial use? Steve Simonson stated there have been
no inquires for that area, commercial inquires for the FM3009 area only.
Gary Wallace stated that this type of development would be better than the "little huts"
along Schertz Parkway in that the development would be fenced in.
Ken Greenwald stated that his main concern is to carry Westchester Street through.
This subdivision is land locked.

Gary Wallace stated that he didn't think Mr. Veytia would carry the street through. It
would be a financial killer to his proposed development.
The Commissioners were in agreement that Westchester ought to go through and
agreed that if a proposal was presented to the Commission it should include the street.
The Commission is welling to hear the proposal if Mr. Veytia agrees up front to carry
Westchester Street through.
Steve reported that as of January 1, 1998, the census reported that the City of Schertz
population is 15, 364, Universal City 14,914; officially in the state numbers the City the
Schertz finally passed Universal City.
Steve mentioned the information on the AP A Conference for October is part of the
Commissioners packet. City staff would like to know fairly quickly who would be
attending so reservations could be made. We will fly to the conference; the trip is over
. 500 miles.
Ernie Evans asked who would be attending and would the Commissioners like to arrive
on Wednesday and what day would they like to come back? Steve mentioned that there
would be sessions on Saturday. The Commissioners were in agreement that they would
like to arrive on Wednesday evening and leave sometime Saturday afternoon. Steve
asked that the registration form be returned as quickly as possible.

Ernie Evans:
Ernie commented on a magical sign on Schertz Parkway that appeared in the last two
weeks that says, "Future home of the Lutheran Mission". Where did that sign come
from? Steve answered that the Lutheran Mission out of Austin has been negotiating for
10 acres of land for quite sometime and the purchase has been finalized. The sign is an
authorized sign similar to a development sign. A request for a Specific Use Permit
would be needed to build in the area. The area is not an authorized area for a church.
Steve added that the plans are for a large complex including schools, etc. Officially, no
plans have been provided at this time.
#15 Adjournment:
David Richmond moved to adjourn the meeting. Keith Van Dine seconded the motion.
