Regular Session January 28, 1997. Merwin Willman moved to approve the Regular Session minutes of January 28, 1997. Tony Moreno seconded the motion which carried as follows: AYES: Ernie Tony Moreno. ABSTENTIONS: said meeting. Evans, David Richmond, Merwin Willman, Pia Jarman, Gary Wallace, Keith Van Dine. (Due to absence at B. Schertz Water/Wastewater Impact Fee Advisory Board January 28, 1997. . . . e e Merwin Willman moved to approve the Schertz Water/Wastewater Impact Fee Advisory Board minutes of January 28, 1997. Pia Jarman seconded the motion which carried as follows: AYES: Ernie Evans, David Richmond, Merwin Willman, Pia Jarman, Tony Moreno. ABSTENTIONS: Gary Wallace, Keith Van Dine. (Due to absence at said meeting.) #3 STATUS OF FINAL PLATS: Chairman Ernie January were; Union, and HEB. Evans stated the mylars on final plats signed for SCI Development Services, Randolph Brooks Credit #4 CITIZENS' INPUT OTHER THAN AGENDA ITEMS: There were none. #5 CONSIDER AND MAKE RECOMMENDATION: Request from City of Schertz, to Rezone 30 Acres from MHS (Mobile Home Subdivision) to RA (Residential/Agriculture). (ZC #139-97) Steve Simonson stated Mr. Johnson is present. The stipulation was that this property would be platted in six months and construction to begin within a year, otherwise the property would be rezoned back to the original zoning. Mr. Johnson has stated at this time he is unable to follow through with the stipulations. Mr. Johnson thanked everyone involved in the rezoning of the property from RA to MHS. The money to construct the project is not available to be able to follow through with this project. There were some partners that were supposed to go into this venture with him but when it came time for "the rubber to meet the road, I don't have to tell you what happened." He was unable to do the deal and wanted to come personally and thank the people that were involved and concerned on getting this request passed in the first place Mr. Johnson expressed his regret that it did not materialize the way it was planned. Pia Jarman said we appreciate Mr. Johnson coming in person to tell us this. Pia asked Mr. Johnson if he would not contest it if we are to rezone his property back to the original zoning. Mr. Johnson stated at this point no, he would not contest because he is unable to get the finances. Council for Public MHS (Mobile Home Keith Van Dine vote. Merwin Willman moved to recommend to City Hearings the request to rezone 30 Acres from Subdivision) to RA (Residential/Agriculture). seconded the motion which carried with a unanimous #6 CONSIDER AND MAKE RECOMMENDATION: Request from Thanh Phami, to rezone 5.9 Acres -2- Thuy Thi on FM 1518 e e . from GB Park) . (General Business) to MHP (Mobile Home (ZC #138-97) Steve Simonson stated he has a letter for the Chairman and Commissioners. We inadvertently took this request and put it on the agenda contrary to Article VII 5.5A of the UDC. Article VII 5.5A requires that a MHP have at least 10 acres of land. This has 5.9. Ms. Phami has been contacted explaining the situation and also a letter with a refund was sent to her. Ernie Evans stated the letter is from the City to Ms. Phami subject application MHP (Manufactured Home Park). "I wish to apologize for any inconvenience I may have caused you by accepting your request to change the zoning for approximately 5.9 acres of land adjacent to Randolph Air Force Base and West of FM 1518. Current regulations stipulate that a new MHP cannot be located on less than 10 acres of land." "Accordingly I have enclosed a check to you for a refund of the $50.00 we accepted with your application. You will not be required to attend the meeting on Tuesday night, February 11, 1997 as I stated to you on the phone this morning your request will be withdrawn from the agenda." . "Please contact me later in the week and we will see meeting to discuss your desire to have your own and other members living on the 5.9 acres in manufactured homes." about a family Ernie Evans stated this item is therefore withdrawn from the agenda. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Allen MBC Engineers, for Corridor Loop Road. Request from Dave for Final Plat Approval (PC #297-97) Steve Simonson stated the signatures are on the plat, the flood plain information is correct, as well as the statement concerning the islands. The other corrections from the preliminary plat approval have been made. This plat meets the requirements for a final plat approval. Ernie Evans stated on the easement that runs across Randolph Brooks property and prior to Bill Millers: at one point this is shown as a 16' easement and other places it is shown as a 15' easement. Steve Simonson stated that is just the way it really is, but he will double check this. Merwin Willman moved to approve the request submitted by Dave Allen MBC Engineer, for Final Plat for Corridor Loop Road. Tony Moreno seconded the motion which carried with a unanimous vote. . Joe Carmona stated he could answer the question about the easement. This is how it was platted originally and they are following it. -3- e e . #8 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Alfredo Silvas, for Preliminary Plat Approval for Bluebonnet Silvas Subdivision. (PC #300-97) Steve Simonson stated this is a plat that was put together as it is in our ETJ east of FM 1518 south. This was put together by Ford Engineering so another engineer was hired to review the plat. This is off Schaefer Road. The lots being platted are 1,2,3,4,5 and 6 of Mr. Silvas' subdivision. All lots have access to roads. Hill Brook Drive is a private road with this being built to go back to the apartments. Lot 6 of the 1.22 acres has a private road easement off Schaefer Road to this property which is a 30' private utility road. The block number for the lots is missing. Ernie Evans stated the surrounding property does not show the owners on the 3.32 tract or the 1.105. Steve Simonson stated that normally "yes" the property owners are shown. Councilman Ken Greenwald asked if there is water in the area? Steve Simonson stated it would probably come off John Bierschwale's road as there is a 6" line there. Merwin area? Willman asked if there would only be septic tanks Steve Simonson stated this to be correct. in this . Merwin Willman stated on Hill Brook Drive it states a non exclusive 60' wide. What does "non exclusive" mean? Steve Simonson stated the public can drive across it but it is a private road. Mr. Silvas stated the easement on Hill Brook Drive is for CPS as they have all the rights for the power lines and the future easement for gas lines. Merwin Willman asked how large the water line is that runs through here. Mr. Silvas stated there is no water line. He plans on running his own water line on Hill Brook from Scheafer to the end of his property. The apartments use well water. Merwin Willman moved to approve the Preliminary Plat submitted by Alfredo Silvas, for Bluebonnet Silvas Subdivision contingent upon inclusion of the block number and that the surrounding land owners be identified on the 3.2 acres and the 1.5 acres. Gary Wallace seconded the motion which carried with a unanimous vote. #9 CONSIDER AND TAKE APPROPRIATE ACTION: Request Engineering, for Preliminary Plat Aurea Subdivision. (PC #301-97) from Fisher Approval for . Steve Simonson stated this subdivision is split between two cities. The City of Schertz and the City of Cibolo. As stated in his notes Steve has been working with the land owner for quite some time and the project still has a ways to go. The land owners have made an -4- . . . e e effort. This is the reason it is before you. However, there are some serious problems with the plat. On each one of the plats on the bottom right hand side it shows the City Council City of Schertz to sign off. This is not true and will need to be deleted. On the left hand side it does have the chairman and secretary Planning and Zoning Commission. The city limits shown on the first page are wrong, the property in the City of Schertz is shown on the last two pages, four and five the City of Cibolo is on the remaining pages. Notice the 30' ingress at the end of the area, but it is not shown where it comes from. The 60' ingress/egress utility easement is shown running down to the line of lot 6 with the match line across it with a 60' utility and ingress/egress easement across the property for lots 3, 4, and 5. This is the back area of the property. In looking at the master plan you can see how it is set up. This has been discussed with our public works department and also Cibolo's. Mr. Keith and the Engineers for the project are well aware of the need for names of the streets. The water systems have been discussed with the appropriate public works departments. The question is the park land which they have been advised of. Mr. Keith wants to dedicate land that is not in our City limits for the parkland. There is a statement about "all weather access" but we have no mention herein to support this at this time nor have we seen plans presented to this effect. In our city limits on every single lot, a portion is in the flood plain. The UDC Article XX Section 13 states public access requires for an area surrounded by a flood zone, that the all weather access must be above the flood plan. We will need to show where the road is going from the 60' access. On page four it shows the 60' access connects to a 30' access road. The 30' access, Steve has been told is to give them access to the Borgfeld Road easement. Mr. Keith and the land owner in the front of that property have been to court over the access for this property. Steve's understanding is that Mr. Keith acknowledges that there will have to be an access. Mr. Keith knows he will have to build an engineered structure to Borgfeld Road but at this time we do not have such documentation. The question about parkland has not been answered. Merwin Willman stated one item that needs to be considered is the intended use of the land. At the present time the land is zoned PD (Pre Development). If this is going to be residential it needs to be zoned residential. This needs to be done before the subdivision is constructed. This involves two cities, which will involve two water and sewer systems. This can not be combined. Steve mentioned it would be two water systems as this is not an interconnecting subdivision. Merwin asked who will do the billing? Steve stated each city would do its own billing. Also Merwin had a question about the park dedication and the limited construction on the 100 year flood plain. All of theses questions need to be answered before we can act on the request. Ernie Evans stated he agrees and he would add to it as indicated. On sheet four there is a 90 degree turn on lot 6 to go from the east side to the north side with part of the easement outside the -5- e e . property line. Ernie Evans stated there should be a requirement of two entrances and exits. Steve mentioned this is a single entry. Steve Simonson stated the reason zoning was not an issue is they did not know if they were going to build homes as this is raw land. There have been people and animals living on the land already. This land had been split up before into two different tracts. Steve Simonson stated even though this may look like a joint lined plat, it is two separate plats as Cibolo is entirely cut off. There is no inter-connecting. There will be two water systems. Our access would be different. At this point there has not been any indication of a connecting of the two. If there were to be a connection, there would have to be a 100 year bridge built to connect the two cities. This area is designated flood way, not just a flood zone. . Mr. Haynes stated these are two separate subdivisions with an attempt to be put together to be less complicated than it already is. "There are several unresolved issues that will have to be addressed and we realize this." The water systems will be separate and end at the back of the property on either side of the creek with the lines being tapped on with their respected lines on Borgfeld Road. The problem with the 30' easement has not been resolved, because of the difficulties with the land owner to be able to tie in with Borgfeld Road. Until the easement question can be resolved, the access problem on the bridge to the property cannot be resolved. Gary Wallace asked Mr. Haynes what he hoped to accomplish by bringing this before the Commission this evening? Mr. Haynes stated they had hoped to have a lot of the issues resolved before this evening as far as the easement is concerned. Merwin Willman stated these issues should be resolved before the Commission makes a decision. In the UDC it states PD is a temporary classification. This should be dealt with first on what they are going to use the property for. Frank Traus stated he is very concerned about this land as he may be a possible owner in this area. "Is there any chance that in the near future, we may be able to live out in this spot?" . Steve Simonson stated there are a multitude of problems and until these issues get resolved, we can not release the land. There have been several calls as Mr. Keith has made a lot of promises but this is the first official document we have received on this request for this property. We have been dealing with Mr. Keith for some time on these issues. These are major issues because the land that is in question is surrounded by flood water. The creek that surrounds this property does flood. The question is proper -6- e e . access to the property and also the safety of the citizens that may live out there. Steve Simonson stated in listening to the Commission it may be their requirement that the land be rezoned to fit the intended use of the land. Keith Van Dine moved to disapprove the Preliminary Plat for Aurea Subdivision submitted by Fisher Engineering. Gary Wallace seconded the motion which carried with a unanimous vote. #10 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Alan Lindskog, for the Vacate and Replat of Lot 6, Block 11, of the Northcliffe Estates Model Home Park. (PC #125-97) Steve Simonson stated the flood plain statement is incorrect. The owner of lot 6 is a signatory as only this lot is being changed. Ernie Evans stated the acreage does not add up to what is on the plat. . Alan Lindskog stated this must have been a mistake. The reason this was requested is this lot had parcels sold to convey with adjacent property back in 1994 with this having gone through the City of Schertz and Comal County and having stopped short of the Commissioners Court at that time. When the process was started again, Comal County had a new subdivision coordinator who stated it could not be done in one plat that it had to be done separately. The previous approval has expired. George dHenecourt requested if the Commission could approve the plats contingent on corrections, as this is going to have to have a public hearing in Comal County. This is going to be time consuming and the builders would like to get started. Merwin Block Alan lot Gary Willman moved to approve the Vacate and Replat of Lot 6, 11 of the Northcliffe Estates Model Home Park submitted by Lindskog contingent upon the corrections of the acreage for 6R, flood plain statement, and signatory and seals required. Wallace seconded the motion which carried as follows: AYES: David Richmond, Merwin Willman, Pia Jarman, Gary Wallace, Keith Van Dine. NAYS: Ernie Evans, Tony Moreno. #11 CONSIDER AND TAKE APPROPRIATE Lindskog, for Approval for The (PC #205-97D) ACTION: Request from Preliminary and Final Fairways at Scenic Hills. Alan Plat . Steve Simonson stated this was a pre approved plat from 1994. original master plan is shown with no changes being done. seals are missing, the flood plain is incorrect, there are -7- The The two e e . different flood plain panels that need to be used. The first should be 480269005C September 30, 1992 and 480266011C August 1995. This also is a private gated community. Mr. dHemecourt stated they would comply with the gated community ordinance as has been advised on the gated communities. one 16, has he Gary Wallace asked if the streets would be in compliance? Steve Simonson stated that "yes" the streets would be built to City street specifications. Any subdivisions within our ETJ have to comply to our specifications. Because of the way this is, by being partially in our City and partially outside our City, there are several compromises being made, because of what Comal County requires and what we require. We are working together so everyone is satisfied. All of the utilities are in the backyard except the telephone lines will be located in the front, and this is how Comal County wants it. The area that is in our City limits was rezoned at that time to R-5B. This is why lots are the size that they are. We do not have this zoning any more but this was the zoning at the time. The streets are called safety lanes but they will be built as streets. The water and sewer will be built to the combined specifications of the county and city. Alan St. Lindskog stated the water line in lot 4 will be abandoned Andrews and connect with Pelican Hills. on . Merwin Willman moved to approve the preliminary and final plat for The Fairways at Scenic Hills Unit 1, submitted by Alan Lindskog contingent upon the flood plain correction, signatures and seals. David Richmond seconded the motion which carried as follows: AYES: David Richmond, Merwin Willman, Pia Jarman, Gary Wallace, Keith Van Dine. NAYS: Ernie Evans, Tony Moreno. #12 CONSIDER AND DISCUSS: Cell Tower Ordinance. Steve Simonson referred to all the recent advertisements for Primco. They are the new digital cell company that is coming like a storm. They are the ones that were here for a cell site on FM 1103. These require many more cell towers than an analog system today, if you are using one. They use a much higher frequency and technology and if you are using one of these it requires more cell sites to insure you are not dropped or lost. They do not have the range. They are much more delicate as far as objects interfering with them. The information Steve is hearing from the conferences he has been attending and from other people on the internet talking about the telecommunications act; which this is a part of. . We need to have a better cell tower application form to force many of the digital cell companies to get onto existing structures or share structures. In time there will be towers everywhere if this is not stopped. One of the recommended ordinances is the one that the Commissioners now have. This is not in stone. It can be -8- e e . modified and changed in anyway the Commission feels, to fit our needs. It needs to be in the UDC soon. The ordinance that we have at this time requires that in M1 the towers can be put up anytime anywhere. The companies just have to provide a site plan. Steve Simonson stated all the land anticipated IH 35 is at present zoned M1. In looking at IH 10 with anticipated development, this could necessitate cell towers in this area also. Merwin Willman stated he would issue with Merwin having only Merwin recommends that this adopted. One part of the telecommunications act was an effort to give everyone better service but it opens the barn door as anyone can provide whatever people want. Multiple services can be provided over the lines but you can only be charged a franchise fee for only one of the services. The cellular tower people are saying you can't charge us a franchise fee, because I am only a tower. This tower has to tie into a line somewhere. . Ernie Evans stated before the towers came about in the last five or six years, the only towers you saw in this country were AT & T. Yet at the same time you could buy long distance services from a different company which did not own the dishes, or the satellites, or the towers, that are bouncing the signal around. Ernie Evans stated he agrees with Merwin and Steve. Also on page two the safety issue is very interesting. Steve Simonson stated if this ordinance is passed or something of this effect, there is going to be a screeching halt to the tower issue. The property is going to have to be bought or rights to the property, which will restrict the building of the towers. Merwin Willman situations and 6,of Article IV: suggested this ordinance be rewritten adopted into the UDC. This could go into Permissible Uses. to our Section It was agreed upon by the Commission that the ordinance for Cell Towers will be looked at and rewritten to be brought back before the Commission for adoption into the UDC. #13 CONSIDER AND DISCUSS: Future Development of Schertz Parkway. . Ernie Evans stated there will be a joint meeting of TIF and the P & Z Commission on March 13th at 7:00 p.m. The Commission needs to discuss the future development of Schertz Parkway among its members so that when the meeting comes up, everyone is going to have the same consensus. -9- . . . e e Merwin Willman stated there has been a lot of discussion about walkways, hiking and biking trials along Schertz Parkway. The question Merwin has is if there are business along there, how are the two of these going to work together? It seems like it would cause a safety problem. If this area was all residential, it would be different but with business it is going to be crowded. The other question is the zoning along Schertz Parkway which mandates a 500' set back. It should be changed to either 150' or 100' as there doesn't seem to be a need for the 500'. Gary Wallace stated he has a concern from the traffic flow stand point. John Bierschwale talked to the Comp Plan Committee about the only potential thoroughfare between IH 10 and IH 35 being Schertz Parkway. FM 3009 will require about a 300' off-set to get around Lone Oak Subdivision; and buying out homes would be too expensive. Added to that, the potential for the east west thoroughfare that would have come with the development of the school, is gone. We do not have the east west thoroughfares that Gary feels is needed to support future development. The jogging trails and hiking trails would be nice but there are other priorities. Pia Jarman stated she is concerned about Schertz Parkway's topography because if you are going to widen it as the discussions seem to be, with the recommendation Schertz Parkway be a five lane, you maybe able to curve the road a certain way so it is not so curvy but you can not do anything about the hills. Steve and Ernie were in agreement that it would be easier to level the grade than to do the curves. Steve Simonson stated we are extremely fortunate to have FM 3009 and Schertz Parkway which parallel each other. What we need is a few more roads that interconnect each other. If we work to insure that Schertz Parkway is ready there may not be a need for a FM 1518 A. The biggest thing with Schertz Parkway is, it will never be like FM 3009 as it was not designed for it. The speed on Schertz Parkway was designed for a limit of 45 mph. If you look how it is built currently, there are two very wide lanes. We have constantly moved development back at least 10 feet. If it is going to be a five lane road there is still room between the ROW for pedestrians and bicycles in the existing green area which would be about 20' off the road. Ernie Evans stated he hoped that there can be another means besides Schertz Parkway as the only road to interconnect IH 35 and IH 10. If something could be done with FM 3009 because it is much wider and better and the state is taking care of it at this time. Pia Jarman stated with all the questionaires that went out we cannot ignore the answers we have received. We need to take into consideration what has been said by the citizens in regard to their concerns for recreational areas, open spaces etc. Steve Simonson stated what we need to keep in mind is that Schertz -10- . . . e e Parkway is not designed as a high speed highway. opportunities for things that can be done with which would set the city apart from others. There are unique Schertz Parkway After some discussion the Commission agreed to put this item on the next agenda for more discussion. #14 GENERAL DISCUSSION: Tony Moreno: Tony Moreno stated he had no comments. Keith Van Dine: Keith Van Dine stated he noticed the surveying going on by Pfeil Road. Are they putting in the water line? Steve stated that is what is going on. Keith Van Dine asked what the status was for Ware Seguin Heights? Steve stated they have never come back for final platting. Gary Wallace: Gary Wallace stated he had no comments. Pia Jarman: Pia Jarman stated she had no comments. Merwin Willman: Merwin Willman asked the Cqmmissioners, if anyone uses the monthly calendar that is put into the FYI portion of the packets? All the Commissioners felt this was not needed. The concensus was to drop this item. Merwin Willman stated it looks like there is an auto repair activity going on at 413 Mitchell in the carport area. Merwin Willman stated and which has moved, there are some new restaurant. There is deal with the railroad the art shop that was located on Main Street has never removed the signs. Steve stated owners that are looking at putting in a no parking so they are trying to work out a for the parking lot across the street. Merwin Willman stated on FM 3009 outside the Greenshire wall, there is a Buffington sign for Thistle Creek and the development into Greenshire. This sign seems to be illegal but was authorized at one time before the wall was up. Steve stated the inspection department said they did not move the sign, the fence went up and the sign ended being outside the wall. There was an approval for a sign for Thistle Creek on July 13, 1994 for three years. The time frame has almost expired but the sign should come down. -11- . . . e e David Richmond mentioned with it being so close to the expiration for the authorization for the sign, it would be best to leave the sign alone for now. David Richmond: David Richmond stated he had no comments. Councilman Ken Greenwald: Councilman Ken Greenwald reminded everyone of the Public Hearing on the widening of FM 78 Thursday night February 13th, at 6:00 p.m. Steve Simonson: Steve Simonson stated there is a letter for the Forest Ridge Subdivision on the maintenance in the FYI section of the Commissioners' packets. This has been approved by our Public Works. Steve Simonson stated there is also a letter on Wiederstein Road because there was a question on when Wederstein Road would be completed. There is a letter about the Corridor Loop Road also that goes along with this. We need to keep this information available for the next unit of Forest Ridge, so on the final plat there is the posting of the necessary funds. Steve Simonson asked if the Commission still wished to receive the Planning Commissioners Journal? The Commissioners advised they would still like to receive this booklet. Steve Simonson stated he has received a letter from Dennis Warner, Project Manager for Plantation Homes, that he does not like the discussion from the Planning & Zoning Commission on his request for signs on FM 3009. Steve Simonson stated he has a letter from Leonard Truitt, Building Official, City of Schertz to him referencing bandit signs on FM 3009. This is a request that Planning and Zoning put this on their next agenda revoking Scott Felder's approval for bandit signs on FM 3009 as he has not been in compliance. There have been several violations of signs off FM 3009. Steve Simonson referred growth since 1982. This getting into. We know it now. The Commission has the last four years. to an information sheet on the housing shows the population crush that we are is coming but we don't see it all right master planned over 2,000 homes in just Steve Simonson stated there has been a new ruling on manufactured homes. For a long time we thought we could not keep manufactured homes out of an existing subdivision if it was put on a permanent foundation. The last ruling out of the legal people is that -12- . . . e e manufactured homes can go into an existing permanent foundation. This should be able to little better than in the past. subdivision on be controlled a a Steve Simonson stated the last item he has is information that has been taken off the internet on cities that are beginning to demand and put in their ordinance for developers, that for every tree they take out they have to plant two more. On every lot they have to offer the homeowner two different types of trees that would be acceptable to the City of Schertz. The homeowner will have an option if they want the trees or not. This is something that will need to be put into the UDC so that trees can be brought back in. Steve will condense the information and bring it back. Ernie Evans: Ernie Evans reminded everyone of the meeting with the TIF on March 13th. Also the FM 78 meeting on Thursday February 13th. There will be a comp plan meeting on Tuesday February 18th. Ernie Evans stated in The Journal there are two articles: one on capital improvement that was very good and there is one on signage.
