09-09-1997 ~ . . e e PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in regular session on Tuesday, Sept. 9, 1997 at 7:00 p.m. in the Municipal Complex Bob Andrews Conference Room, 1400 Schertz Parkway, Schertz, Texas. Hellums James Love Michael A./Kimberly Atiee, Schertz Funeral Home 11 CALL TO ORDER: Chairman Evans called the Sept. 9, 1997 regular meeting to order at 7:00 p.m. 12 APPROVAL OF MINUTES: Regular Session August 26, 1997 Pia Jarman stated on page 3, paragraph 6 line 2 and paragraph 12 line 3 there were errors; page 4, paragraph 2 line 6, "Jr" is to be added; and in paragraph 3 a name correction to "Peterson". Page 6, paragraph 3 and page 12, paragraph 3 had some typo's. On page 11, paragraph 5, the addition of "Mr. Greenwald said that" was needed. Gary Wallace added that on page 1, his name should be added to the "Ayes" to the approval of minutes. -1- ~ ~ . e e Pia Jarman moved to approve the minutes of the regular session of August 26, 1997 as corrected and amended. Gary Wallace seconded the motion which carried unanimously. 13 STATUS OF FINAL PLATS: Chairman Evans stated the final plats were approved for the month of August: Taco Cabana, Tri-County Business & Industrial Park Block 1 Lot 9. 14 STATUS OF BOA ACTIONS: Pia Jarman stated there had been no meeting since last reported. The next BOA meeting is scheduled for Sept. 15, 1997. 15 Citizens' Input Other Than Agenda Items: There were none. 16 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Jesse M. Hellums for Specific Use Permit for Proposed Move of a Manufactured Home. (SUP #15-97) Steve Simonson stated there is a copy in the Commissioners' packets of the type of Manufactured Home that Mr. Hellums would like to place on his property, which is adjacent and fairly close to the Mobile Home Park that he owns; not far from the undeveloped area in Live. Oak Hills. The dimensions are 470' away from Schertz Parkway, approximately 480' from the property line or the city limit line; and 270' away from the Live Oak Hills Subdivision. The home will be placed on his property which is from IH 35 to the Live Oak Subdivision. Gary Wallace asked if it is a Specific Use Permit because of the current zoning. Steve Simonson stated that is correct. The current zoning is "GB". The Specific Use Permit allows Mr. Hellums to have the Manufactured Home for the time he wants it without a zone change. Gary Wallace asked if there, is a time limit. Steve Simonson stated we need to ask Mr. Hellums how long he wants it there or if the Commissioners want to put a time limit. Mr. Hellums currently owns the property, if he tries to sell it then it involves issues to be handled at a separate time. Pia Jarman stated Specific Use means just that: "for that use only". Tony Moreno asked if Fire and Safety access and egress were taken care of. Steve Simonson stated before a permit is issued this will have to be worked out; also a driveway will have to be built in order to have access to the home. Gary Wallace asked if a site plan was needed. No, Steve Simonson replied. -2- e e Ken Greenwald stated he has a question on the dimensions, there are three different dimensions (30 x 70, 30 x 60 and 30 x 68). Mr. Hellums stated the mobile home is actually 30 x 68. ~ David Richmond asked what the long range plans are for the use of the property. Mr. Hellums stated his crystal ball on time is not good. "My plan was to keep the property for a year or two. My plan now is to move a home and live on the property. The back of the property could take a while to develop. My dream is to develop a Business/Industrial Complex; as to when that might happen is hard to say." Ernie Evans asked what Mr. Hellums proposed for an access to the property. Mr. Hellums stated there is an existing road that is about 500' that goes along the property and he plans to build a caliche road off the existing trailer court road. To move the home he needs about 20' of road. It will be a wide accessible road; it will be off IH 35 not Schertz Parkway. Gary Wallace moved to forward the request from Jesse M. Hellums for Specific Use Permit for Proposed Move of a Manufactured Home to City Council recommending approval. Pia Jarman seconded the motion which carried unanimously. Steve Simonson stated "There is a ringer in the audience," as Ex-Commissioner Merwin Willman was present. . '7 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Business & Industrial Park for Final Plat Approval of Subdivision. (PC #336-97) Tri-County Taco Bell Ernie Evans stated a new plat had been handed out to each Commissioner. Steve Simonson stated this new plat shows that Lot 8, Block 2 next to the Taco Bell site is owned by Ramada. Volume and page is shown. All items have been corrected. Setback lines are clearly shown as well as a gas/sewer easement from the east. A paralleling electrical telephone/sewer easement and gas lines on Lot 3, Block 2 is shown, so it is not cutting it off by not carrying it across. The 30' utility/access easement is shown across the back. The area is available for development. Ernie Evans stated he had one comment for the record, the utility/access easement across these properties. The Commission has to see to it that the road goes through and not look to the developers to continue the road. It would be a major mistake not to have the developers finalize the road. He would like to know how the' developers are working with each person that is coming before the Commission. We were given a set of words when Ramada came, now we have someone before the Commission and no word as to these existing plans. This does not complete the cycle that the Commission is looking for in the community. . -3- e e Steve Simonson stated he will call the developer for the status of the road and possibly have some information at the next meeting. ~ Tony Moreno moved to approve the request from Tri-County Business & Industrial Park for Final Plat Approval of Taco Bell Subdivision. Gary Wallace seconded the motion which carried unanimously. f8 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Don McCrary & Associates for Final Plat Approval for Berry Creek Subdivision, Unit 2, (PC #317-97). Steve Simonson stated the break-down of lots concerning different size lots in Unit 1 and 2 is furnished. The number lots as recorded do not add up to the number of lots that actually shown on the plat. The plat is not showing Dedication to the City. the of are Park Ernie Evans stated the Park Dedication issue needs to be settled before final plat is approved. He asked if someone is present to represent Berry Creek. Dan Kossl stated he is representing Berry Creek as well as Don McCrary. Ernie Evans reiterated an issue mentioned by Steve Simonson and asked for an explanation of the plat showing 63 lots in 3 blocks. Unit 2 is showing an actual count of 57 lots in these blocks. The "note" seems like it is left over from Unit 1 and was not removed from the plat. . Dan Kossl stated the note will be corrected. The correct number of lots is 57. Ernie Evans stated that on lots 60,40 and 48 he cannot tell the distance across the property at the building setback lines. This is an issue that was discussed in the Dove Meadow Subdivision. In a cul-de-sac the distances of setback lines have to be shown. Don McCrary stated it is appropriately shown on the plat and the dimensiohs that are shown are not the curve lines at the property line. The setback dimensions have nothing to do with the legal descriptions of the property. There is a drawing that was submitted that shows the distances at the setback lines. The distance is a minimal of 55' at the setback lines. Ernie Evans asked if that was based on the degree of the offset of the property lines. Ernie Evans said he had looked through the records for an answer to this issue. Don McCrary stated this information should not be found on a plat. The dimension of the property lines would be found on a plat. Ernie Evans stated this information was required in the plat for Dove Meadows Subdivision. Don McCrary stated it could be added to the plat but it might be confusing since it is not a property line. ~ Steve Simonson stated the drawing alluded to showing the distances at the setback lines is not on file. -4- e e ~ Ernie asked "What is the future issue on the Park Dedication?" Dan Kossl stated it was his understanding that the recordation of Unit I plat dedicated the park area to the City. If a separate deed is needed, that will not be a problem. Ernie Evans stated it must be shown on the final plat that it is deeded to the City of Schertz. The Park Dedication should be shown in the notes. Ernie Evans asked Steve Simonson if a deed was required in a Park Dedication. Steve Simonson replied a deed is not required. The Park Dedication is labled in the owner signature area. Ernie Evans requested that the Park Dedication be added to the notes on the plat. Steve Simonson stated a block and lot number were also needed. Ernie Evans advised that when the plat is resubmitted that the property owners' information on the plat be darkened so as to be legible. Pia Jarman moved to disapprove the request from Don McCrary & Associates for Final Plat Approval for Berry Creek Subdivision as submitted, for the items discussed. Gary Wallace seconded the motion which carried unanimously. . Pia~~Jarman stated she is not clear on the setback line issue: do the width dimensions at the building setback lines have to be on the plat? Ernie Evans commented the procedures have to be followed: i.e. the dimensions should be on the "unreadily identifiable" lots. This is the primary concern so later we don't run into problems as at Dove Meadows cul-de-sacs. In Dove Meadows the engineer provided a separate annotation for dimension at the setback line. 19 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Timbercon Construction Inc. for Site Plan Approval for Schertz Funeral Horne. (PC #339-97). Steve Simonson stated that primarily information appears to be off the existing construction plans. The landscape plan outlines all the requirements. The site location is missing. However, he doesn't think anyone is confused on the location, since it states the corner of Live Oak and FM 3009. The first plan shows the building location, parking lot, location of signs, light poles, and the dumpster location. The second plan shows the over all dimensions of the building. The third plan shows the elevation drawing. It appears it will be a good looking building. The fourth plan shows again all of the items on the first plan but also shows all the existing trees and trees they plan to plant. The only item that is not shown is the height of the sign. It does show two ground level signs with planters around them. . Ernie Evans asked are two signs authorized or one sign? Simonson replied, "two signs: one on each corner." Steve -5- ~ e . Ernie Evans asked if the exit on to Live Oak is designed to be the exit from the funeral home. Michael Atiee, representing Schertz Funeral Home, responded, yes. Pia Jarman asked if the handicap parking shown is an adequate number. Steve Simonson stated he would check but thought it is a correct number. Actually the spaces are accessible for handicap parking all around. In the building plans the City Inspectors will further refine any problems with elevation or grades. Ernie Evans commented another concern is to save the trees. It is very difficult to see from the plans what will be planted. Another concern the east/west elevation shows a garage door. Is it an extension to the building? Michael Atiee commented it is part of the main building and is of the same material as the rest of the facility. The area is a drive-thru for unloading purposes. Gary Wallace asked if this is the only time we get a shot at the sign issue. Steve Simonson stated they will not be any bigger than what is authorized. Gary Wallace asked what they have in mind for the sign. Michael Atiee stated the signs are of the same stone as on the building trim. The signs will be 4' high. The spec's on the sign is available, but a copy was not included in their submissions. Mr. Atiee said he could obtain a copy for tonight if the Commission will allow it. . Steve long shown; Simonson stated the city officials have had the plans for time waiting for final approval. The site of the sign what is not shown is the elevation. a is Gary Wallace asked if the location map is a requirement. Steve Simonson commented it is part of the checklist. This is not a plat, it is a site plan. Site plans are treated differently at times. Since this is a platted lot with a key map and because the site plan clearly labels roads that are easily identifiable that suffices. The reason he mentioned this issue is because he has been told the Commission is not approving anything without all the information needed as shown on the checklist. This will not be a problem with the Inspection Dept. Gary Wallace asked if the sign is going to be a problem. Steve Simonson commented the location is known, the sign information will be brought in with the plans. As we have been told the plans should have been at the meeting to show the elevation. Obviously, the sign will not exceed anything that is authorized. David Richmond asked what the height requirement is on 3009. Steve Simonson stated it is 18.7'. . Ernie Evans stated what is written on the site plan is what will be authorized. David Richmond asked if the overlay ordinance covers the sign on Live Oak. Steve Simonson stated that Live Oak is a residential street and what is authorized is a small sign. -6- e e ~ Pia Jarman stated in the past have we not seen designs that show the elevations and dimensions as well? Steve replied, yes. of signs Simonson Ernie Evans asked Mr. Atiee if the sign information was available for viewing tonight. Mr. Atiee replied he could have the information if allowed to go get it. Pia Jarman asked whether it would be agreeable with the Commission if approval is given tonight on condition that the sign information be brought to Mr. Simonson or does the Commission want the request brought back to its next meeting? Ernie Evans stated our option is to table the request temporarily until the information is brought. Pia Jarman stated if the information is brought in before the end of the meeting, the decision may be postponed. David Richmond stated he did not have a problem with waiting. He believed a funeral home would not put up a sign of the nature of, "Maddog Welding". Pia Jarman stated the Commission needed to comply with the Commissions own regulations. Pia commented a motion was needed to "postpone" the issue rather than "table" because we are setting a specific time. . Pia Jarman moved to postpone decision on the site plan for Schertz Funeral Home submitted by Timbercon Construction Inc. until requested signage information is made available by the close of the meeting. Gary Wallace seconded the motion which carried unanimously. .10 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Flair Homes, Inc. for a Special Exception to the Zoning Ordinance for a Rear Yard Setback (from 50' to 46.6') (BOA #95-97) Steve Simonson stated this home is in the Woodland Oaks Village Subdivision and backs up to FM 3009 which has a 50' building setback requirement. The building itself is well outside the 50' setback line. The flat cement work does not encroach into the building setback line because it is not part of the building, but in enclosing it, it will become part of the house and will then encroach into the building setback line. It is the FM 3009 overlay building setback line and the request will encroach 3.6' into the 50' setback line requirement. Pia Jarman commented that the application states the house is also screened from FM 3009 because of the numerous trees. ~ -7- . . . e e Gary Wallace moved to forward the request from Flair Homes for a Special Exception to the Zoning Ordinance for a rear setback from 50' to 46.6' to the BOA recommending approval. Inc. yard Tony ill CONSIDER AND TAKE APPROPRIATE ACTION: Request from Jack Brown Cleaners dba/Slater White Cleaners for a Special Exception to the Zoning Ordinance of Restroom Requirements of Two (2) to One (1). (BOA #96-97) Steve Simonson stated a sheet has been passed out to the Commissioners explaining the remainder of the statement on item #5 which had been inadvertently left out. The building code requirements: #407.1.4 has been outlined and a table of mlnlmum plumbing fixtures for retail stores shows that the requirements are 1 male and 1 female. All bathrooms need to be accessible for the handicapped or a separate one needs to be built. Gary Wallace asked, "Is there any history in Schertz for requests of this nature"? Steve Simonson stated there is no recent history and we are very strict on upholding the building code requirements. Pia Jarman asked if the building code has requirements on the size of the bathrooms. Steve Simonson replied, yes. Pia Jarman stated the approval or disappoval let them make their disagreed. Gary Wallace moved to disapprove the request from Jack Brown Cleaners dba/Slater White Cleaners for a Special Exception to the Zoning Ordinance of Restrooms Requirements and forward it to BOA with such recommendation. Pia Jarman seconded the motion which carried unanimously. '12 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Kaufman Broad for a Variance to the Overlay Ordinance for Bandit Signs (FM 3309/Schertz Parkway) (PC #242-95) Steve Simonson stated he had very little to say on this issue. The request is in front of the Commissioners. The request is for 4 signs to be placed on 3009 and the remaining 8 to be placed on Schertz Parkway. Ernie Evans stated the existing policy cannot be enforced. We have signs now that are not authorized. I think we will make a bad situation worse. I see no reason for additional signs on FM 3009 since the model homes are for Schertz Parkway and to get there from 3009, you either need a road map or lots of signs. There is no way to turn into the retirement home and find the model homes; there is not a straight street between the two. Tony Moreno concerns on discussion? asked had they been notified about the the bandit sign issues by a formal Commissions letter or . Steve Simonson stated they were aware and that is why the Commission has the request. We now have a car load of signs from 3009 from Ashley Place and if it keeps up we will have to come back to the Commission and ask to withdraw authority for all signs. After the last meeting when the Commission requested the problem be resolved with Ashley Place, the city inspectors went out to Ashley Place and the situation was brought to their attention. He would like two signs, a left one and right one at Ashley Oak and 3009 and one between IH 35 and one at FM 78. The other eight signs will be on Schertz Parkway. Pia Jarman added the entrances are clearly marked stating, "Ashley Place". Her concerns about bandit signs is that the only thing you see is a lot of small things on the side of the road. The big signs are the ones people will actually see. Pia Jarman moved to deny the request from Kaufman variance to the Overlay Ordinance for Bandit 3009/Schertz Parkway. Gary Wallace seconded the carried unanimously. Broad Signs motion for a on FM which '13 CONSIDER AND MAKE RECOMMENDATION: Reappointment for Two-Year Terms of Planning and Zoning Members: . 1. Pia Jarman 2. David Richmond 3. Gary Wallace Ernie Evans stated that during the discussion at the last meeting each Commissioner indicated they would like to continue to serve on the Planning and Zoning Commission. Pia Jarman stated she had understood that the Chairman had asked if they would be present at the next meeting. She added, the Chairman still needs to ask each Commissioner. Pia Jarman stated she had a request: now that she is the oldest member of the Commission, she would like to move to the chair vacated by the former oldest member. Ernie Evans stated with the move comes the historical responsibilities that the chair maintains. Steve Simonson added the chair is traditionally the secretary's chair. Ernie Evans asked Gary Wallace, Pia Jarman and David Richmond each in turn if he/she would like to continue on the Commission. Each Commissioner replied, yes. Ernie asked for a vote on each individual Commissioner. Everyone is in agreement to make a recommendation to City Council for the reappointment of the three Commissioners. . -10- e e . Ernie Evans stated due to the formal resignation of Merwin Willman effective as of August 26, 1997, we no longer have a recording secretary. We need to appoint a recording secretary. Pia Jarman stated the Commission had a recording secretary, what is needed is a secretary for the Commission. Gary Wallace asked what are the secretary's duties? Steve Simonson responded, the secretary's duty is filing plats for the Commission. Ernie Evans stated he would like to open the floor for nominations for secretary to the Planning and Zoning Commission. There are three people present that can be nominated. Two of the present are exempt from nominations. Chairman Evans stated the floor was open for nominations. Gary Wallace moved to nominate Pia Jarman. Tony Moreno seconded the motion. Pia Jarman accepted the nomination for secretary to the Planning and Zoning Commission. The motion carried. Ernie Evans stated Keith Van Dine is absent from this meeting due to business. '14 GENERAL DISCUSSION: . Tony Moreno: Had no Comments Gary Wallace: Gary Wallace commented, there is a video sign on the back of the Berry Creek sign on FM 3009. Does this sign need an approval? Steve Simonson stated they had not come in for one. Berry Creek does have approval and he will check on the video sign. Pia Jarman asked about the ABC Storage sign. Steve Simonson stated they are still checking. The same sign is also in the Industrial Park. Pia Jarman: . On the listing of the members for Planning and Zoning Commissioners there is a mistake; Gary Wallace 11-95, that is when he was appointed, the date of expiration term should read lO-97. Pia Jarman stated on the Berry Creek signature block, it only reads the "Planning Commission of the City of Schertz", shouldn't it read the "Planning and Zoning Commission of the City of Schertz?" Steve Simonson replied, yes. He will see that it is changed. -11- e e David Richmond: . David Richmond commented about an article in the "Northeast Sun", where it was quoted that a future elementary school was designed to go on the corner of Roy Richard Dr. and Live Oak Road. Do we know this to be a fact? It would be in the City of Cibolo. Steve Simonson stated the elementay school would be located on Dietz Road in the Deer Creek Subdivision. Ken Greenwald: Ken commented on an article in the Sunday paper that deleted the "grandfathering" provlslons. To delete all the "grandfathering" will never happen, it won't stand up in court. . At the last City Council meeting there was a discussion on properties for the Police, EMS, Fire etc. At the executive session tomorrow night the council and the land selectees will try to make a decision. They have settled on 5 properties. Johnny Bierschwale and Mr. Greenwald attended the Canyon Region Water Authority and they have voted to accept County Line Water Supply Corp, Maxwell Supply Water Corporation. They have started the bond process to build a water treatment plant and more new lines. They still have not made any headway coming in this direction. A better process is to have our own and supply ourselves. We are still working with GBRA to get a 1,000' of Canyon water. If New Braunfels does not want to participate in treatment and pumping we can line about 2 or 3 miles down IH35 and tie right into the treatment plant. Another option would be to build our own package plant and treat our own water. We will look at all options, we will not be held to the Edwards or Canyon for a sole source of water supply. We will have water one way or another. Steve Simonson: Steve Simonson stated there are rumors about what is going to happen to the rest of Greenshire. What is going to happen is what the Master Plan planned. The road issue is dead, there will be no road. Steve commented to David Richmond that he did not know if the Home Owner's Association was aware or not but they have requested to move the development sign which is at the entrance on the right hand side to the middle island. We do not have any authority in telling them not to move it, they can move it from one place to another place without any authority. 19 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Timbercon Construction Inc. for Site Plan Approval for Schertz Funeral Home. . Tony Moreno seconded the motion which carried 114 GENERAL DISCUSSION: Steve Simonson: Steve Simonson stated there is some speculation on the Industrial area, they are moving along. We are getting the entrance to Tri-County Business off the access road to Tri-County Blvd.. That lot has been platted and recorded and will be Slim's Automotive. Things~are continuing to "pop pop pop". David Richmond asked if there was any news on Greenshire Unit 8. Steve Simonson stated they are finalizing Unit 8 plat. They are well aware of the fence issue along Woodland Oaks Dr.. There has to be a note on the plat and Hallmark is moving along with that. Hallmark is the parent company of Dover Homes. Pia Jarman: Pia Jarman stated on filling the vacancy for a Commissioner she is aware of the water bills going out with the information about the vacancy and there are also flyers on the counter at City Hall announcing the vacancy.
