PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in regular
session on Tuesday, January 9, 1996 at 7:00 p.m. in the Municipal
Complex Conference Room, 1400 Schertz Parkway, Schertz, Texas.

Due to the absence of Chairwoman Pia Jarman, David Richmond,
Vice-Chairman chaired the meeting.
Chairman David Richmond called the January 9, 1996 regular meeting
to order at 7:00 p.m.
12 APPROVAL OF MINUTES:

Steve Simonson explained that there is a copy of the plat in the
Commissioners' packets with a hand drawn copy of the site plan.
This is a rather large lot but at this time they will only be
developing a small portion of it. This is an after the fact site
plan. Construction is underway due to the fault internally by
staff. Ecko Construction has been kind enough to provide the
Commission with a site plan to show what they will be doing. There
will be a privacy fence with the waste containers being behind the
privacy fence. The only question would be the outside lighting
that would be used with the sign being on the building. This is an
office building with covered parking for company trucks.
Ernie Evans asked about the flood plain. Steve Simonson advised
that this property is in Comal County and Comal County did not have
any changes.
Merwin Willman questioned what the name of the business would be?
Joy Kutz advised it would be Ecko Construction. They are concrete
contractors.
Merwin Willman asked what the big hole is on the property and also
if the building would be handicappped accessible?
Joy Kutz stated the dirt in the area has a high ph and holds a lot
of moisture so the dirt is being taken out and being replaced with
dirt that has a low moisture fill before the building can be
constructed. Also the building will be handicapped accessible
throughout. Most of their work is residential but they do have the
contract with Bill Miller's.
David Richmond mentioned he is very grateful for the site plan,
even though it is after the fact. David's concern for a commercial
venture is that a hand drawn site plan and not a professional
engineer's drawing will be going into the permanent file. This
does not follow the City's procedures for site plans. David asked
if it was too much to ask of Ecko Construction to provide a
professional site plan? Steve Simonson said that he could go back
and request that a professional site plan be submitted.
Joy Kutz advised she has no problem with this request. This is the
first she has heard that a professional site plan is needed.
David Richmond explained that he understands. The City staff has
acknowledged that it slipped through so we are coming back after
the fact to approve. David advised that in making the site plan a
matter of record for any commercial venture we approve, and have
approved in the past in the City, we should have a professionally
drawn site plan that adheres to our specifications. David
commented this is quite different from a resident coming in with a
drawing for approval of a shed, roof over a back patio, etc. This
will not in any way hold up construction. It would be for the
permanent record and could be handled at the next meeting.
Gary Wallace asked if it could be approved in principle pending

receipt of the professional site plan? Steve Simonson advised the
building permits have been issued so there would be no need as they
are under construction at this time.

Keith Van Dine asked if the request could be tabled until the next
meeting? David Richmond advised that yes, it could be tabled until
the next meeting.
Keith Van Dine moved to table the request from Jerome Uecker, from
Ecko Construction for Site Plan approval until the Planning and
Zoning Commission is presented with a professionally drawn site
plan at the next regular meeting. Gary Wallace seconded the motion
which carried with a unanimous vote.

Site Plan Approval.

Steve Simonson advised this is the third (3) rendition of the site
plan for Texaco. They have not deviated from the original signs
that have already been approved. Everything else is very self
explanatory the green areas, handicap parking, lighting etc., have
been labeled. This is a new look for Texaco and the reason for
another site plan. This new look will be the first in the San
Antonio area.
Ernie Evans questioned the discussion that was mentioned
past about the monument sign for all the businesses on FM

Steve Simonson stated nothing has become of that joint monument
sign on FM 3009. The Zemex owners have been told about this.
Until they can agree, there will not be a sign. Steve advised he
will contact Zemex again to check on what the status is. The
original agreement is that there would be a monument sign shared by
all of the businesses in the area. This would prevent all the
businesses wanting their own sign higher and higher. The
Commission could approve the site plan with a caveat on the sign.
Merwin Willman asked for clarification: on the left side of the
building there are initials QSR drive-up. What does that stand
for? Greg Korman advised it stands for Quick Service Restaurant.
Merwin Willman moved to approve the site plan from Greg Korman, for
Texaco except for the monument sign on FM 3009. Keith Van Dine
seconded the motion which carried with a unanimous vote.

Steve Simonson stated this is going to be a very nice addition to
FM 3009. One item to note is there are two (2) handicap areas, a
total of four (4) spaces. They do not show the little symbols but
they are indicated by the diagonal lines which is legal. Handicap
parking can be labeled either with the handicap symbol or the
lines. There is one question on how high the clock will be on the
front of the building. Joe Carmona advised he is new on the job
and does not have that information.
Gary Wallace asked if there would be an outdoor ATM? The reason he
is asking is because of all the personal security problems that are
happening around San Antonio.
Steve Simonson advised it is not indicated on the site plan but it
looks as if the ATM will probably be located in the drive through
lanes with all of the lighting.
Merwin Willman moved to approve the request from Brad Cutright, for
Seguin State Bank for the site plan. Keith Van Dine seconded the
motion which carried with a unanimous vote.
#7 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Abe
Gonzales, for Remax Subdivision for Final Plat
Approval. (PC #252-95)
Steve Simonson stated the preliminary plat was approved at the last
meeting but due to the lack of signatures the Commission would not
approve the final plat. All the information is now on the plat
other than the signatures that are required by us. Utilities and
streets are already in place. This is a very straight forward
plat.

Steve Simonson mentioned that masonry walls are used on major
thoroughfares, areas facing where there is generally heavy traffic,
and things of this nature.

McCrary, for Schertz, Cibolo, Universal City
ISD for Preliminary Plat Approval. (PC #255-96)
Steve Simonson advised that this area has already been recommended
to City Council for approval for a Specific Use Permit. City
Council has already approved. The school will be located in
Savannah Square. They are platting for the school to be on either
Savannah Drive or Inglewood Drive in Ashley Unit 2. They have put

both utilities and drainage in the 25' easement on the south end of
their property. They will slope the land to be able to get the
water moving to where it has to go.
Merwin Willman questioned the water being able to go to the
drainage the way it is noted in Ashley Place. Steve Simonson
agreed but said there is not going to be a lot of water. The
construction plans will have to prove that yes, the water will go
the way they have indicated.
Merwin Willman asked if along Savannah Drive should they not be
showing the one (1) foot non-access easement? They are going to
have to put in a drive but should this be shown?
Steve Simonson advised if the one (1) foot non-access easement is
put in then you are preventing them from being able to put in a
driveway.
Tony Moreno asked if they have indicated where the building will be
located? Steve Simonson advised not at this time. If the
Commission wishes to know where the building will be located they
will be contacted for that information to be available.
Ernie Evans stated that Inglewood Drive is not platted so how would
you determine curb cuts, etc? Merwin Willman advised when it is
platted they will have to show where the curb cuts will be.
Steve Simonson stated Inglewood Drive is not a through road like
Savannah Drive. It is a residential street. The real question is
if you put the one (1) foot non-access easement you would prevent
the school from putting in a driveway. The school will not be
putting in more that one ingress and egress. Steve suggested to
put the one (1) foot non-access on the other side of Savannah Drive
so you will not have to worry about traffic coming in from the
other side.
Gary Wallace moved to approve the request form Don McCrary, for
Schertz, Cibolo, Universal City ISD for the Intermediate School
preliminary plat. Tony Moreno seconded the motion which carried
with a unanimous vote.

McCrary, for Ashley Place Unit 3

Steve Simonson advised to review this plat you need to look at the
location map to be able to put it together.
Ernie Evans stated he went back to Woodland Oaks 6-A which it notes
on the check list. Ernie asked how to distinguish what change this
is referring to.
Steve Simonson stated on sheet 3, Unit 6-A is identified when they

platted. They took th$ drainage in Unit 6-A, platted a dotted
drainage ditch, and ran it up outside of the property line. They
are doing away with that and carrying the water a different way.
They are saying that it is not needed and carrying it down to a
drain on lot 1. The water will get there by using the streets.
The back yard 10' drain is not needed. Our engineers will have to
prove that the change will work this way. Based on the preliminary
talks Steve has had on the way it is showing the water moving, it
should not be a problem.
Ernie Evans asked if this has been coordinated between the two
builders? Steve advised that yes, it has. What Unit 6-A Woodland
Oaks was doing was putting in an imaginary drain on someone else's
property. Don McCrary took a look at it and severely questioned
the calculations being used by Cude Engineers for Woodland Oaks.
Based on this, Steve advised the City Engineers to take a close
look at the situation. It does not look like a large problem doing
what they are showing, as they are carrying the 10' drain up to lot
1 through the street with the street carrying the water which will
not be a problem. Steve reiterated that this is the preliminary
plat and until he gets the engineering information back, the
Commission will not be asked to approve a final plat.
Ernie Evans asked if the water will not be going into a storm
drain? Steve Simonson advised it will be going into an open cement
drainage ditch.
Merwin Willman commented the water will be coming down Ashley Oak
Drive to Sycamore then turning right on Sycamore to hit the
drainage. Steve Simonson agreed. Merwin Willman asked what is
going to prevent the water from going straight down into Woodland
Oaks? Steve advised, the way the street will be crowned. The
construction plans will have to prove this before the final plat
will be approved. Merwin stated he would like a written O.K. from
the Engineer before this plat is given final approval. The other
Commissioners were in agreement.
Merwin Willman mentioned in the same area they are platting an 18'
drainage easement. When you get into Woodland Oaks it is a 12'
drainage easement. Would this make a difference?
Steve Simonson advised until the construction plans can be reviewed
this can not be answered. When the preliminary calculations were
run on Ashley Place for what they will be putting into this
existing drain, the free board went up only six (6) inches. The
water has already been going into the drain. It is not new water,
it is just going to get there sooner. Once you have saturation, it
will be the same amount of water. Merwin Willman commented there
would be more water because of all the ground being covered with
buildings and driveways which will prevent more run off.
Don McCrary advised that the drain is an existing drain. Basically
it will be a pickup structure that is built along the street with
the street being graded to create a sump or low point. This causes

the water to turn and come down and go into the existing drain that
has been checked out, and will carry the amount of water with no
problem.
Merwin Willman stated when Ashley Place was first started they were
authorized 30% of the lots to be 55' X 120'. Who is keeping track
of this to see if this has been exceeded? Steve advised he would
have to go back to Unit 2 and Unit 3 to get this information.
There is an extremely good mix. Don McCrary stated he would be
able to provide this information before the final approval on
Ashley Place Unit 3.
Tony Moreno moved to approve the request from Don McCrary, for
Ashley Place Unit 3 preliminary plat. Merwin Willman seconded the
motion which carried with a unanimous vote.

McCrary, for Dove Meadows Unit 4
Plat Approval. (PC #256-96)

Preliminary
Steve Simonson stated that there are a few changes needed on this
preliminary plat which Don McCrary is aware of. The reason there
are no street names is due to the fact that the owners are not sure
what names they want to use from the list that has already been
approved. The 100 year flood plain information needs to be
corrected. The proposed drainage ROW is a completed existing
drainage ROW which will be on the final plat. For the
Commissioners' information: on the proposed drainage ROW this is
1.6 acres which was platted under Greenfield Unit 3 correction,
Volume 5, page 135A, 24 October 1990 recorded in Guadalupe County.
The area that is shown dotted where the curve comes is actually an
area that used to be the ROW which is now abandoned. It is on the
same plat and is 1.34 acres reverted back to the original owners.
Along the back on Dietz Road, Don McCrary has put in a 5' common
area.
Don McCrary stated the reason behind the 5' common area on Dietz
Road is due to the fact of on-going negotiations trying to develop
all the streets. Cibolo thinks they have a problem as they have
55' and they want 60'. This developer has tried to work with
Cibolo to no avail on this problem by glvlng them the other
property. The proposal is to give the 5' of common area to the
Homeowners Association. If and when the street development takes
place, the Homeowners Association can deed that property to Cibolo
if they wish. This helps to eliminate the problem with the City of
Schertz and the other land owners involved to have to pick up the
5' from each of them. This is the easy way out by putting it in
the hands of other people to deal with at a different date.
Ernie Evans asked if this issue involves the location of the
school?
Steve Simonson stated no, this is an on-going argument with Cibolo.

It has to do with when the road is widened what the size of it will
be. Originally the developer gave 10' of the ROW before this was
brought before the Commission. IF and when Dietz Road gets worked
out, this is the best way for the Homeowners Association.
Merwin Willman asked for clarification with this being the last
unit for Dove Meadows. Will the recreation area that they have
proposed take care of their requirement for dedicated park land?
Steve Simonson 'advised that yes, because they get 1/2 credit along
with the 2 acres that was given in Unit 1. Between the two parcels
they have met the park land requirement.
Merwin Willman asked about the paper work for the drainage flood
area? Steve Simonson stated it has not yet been received. Don
McCrary is still working on this. Don McCrary stated that there
was a mistake made by the Federal Government and they are trying to
work things out.
Merwin Willman moved to approve the request from Don McCrary, for
Dove Meadows Unit 4 preliminary plat. Tony Moreno seconded the
motion which carried as follows:

Ernie Evans asked Steve if he had an answer from the question the
other day on the Paragon Cable Boxes being put into the sidewalks.
Steve Simonson advised that it is being checked into at this time.
They will have to do one of two things; maintain the four (4) foot
sidewalk or reestablish the sidewalk and put the boxes back to the
original location. This work is being done in the Savannah Square
area.

ahead of time a meeting could be the following week. Merwin said
maybe just a draft. Steve stated when there is not a problem in
the timing of the minutes being approved, this would not be a
problem. We do not want the citizens waiting a lengthy time just
for the minutes having to be approved.
After a lengthy discussion it was agreed to continue with sending a
letter of recommendation to BOA as has been done in the past. If
the minutes from the P & Z have been approved then they will be
used in the packets for information purposes.
Steve Simonson:
Steve Simonson advised the Commission to mark their calenders for a
joint meeting with City Council on January 31, 1996 to discuss the
UDC. The UDC books for the Commission will be distributed at the
January 23, 1996 P & Z meeting.
. Councilman Ken Greenwald:
Councilman Ken Greenwald mentioned in the newsletter there is a
copy of the recycling schedule for 1996. In the current newsletter
you will notice that 800,000 lbs. has been kept out of the waste
stream. For a small city this is a very significant amount.
Councilman Ken Greenwald handed an article out from Mr. Bill West,
GBRA. Mr. West has come to the conclusion that selling a lot of
water out of Canyon Dam makes a few bucks but selling treated water
will make them a lot more money.
Merwin Willman asked about the portable sign on Main Street and
Randloph Blvd. for the karate business. Do they still have a
permit? Steve said he would check with the Inspection Department
on how much longer they have.
David Richmond:
David Richmond asked Steve if there is any word on HEB. Steve
advised there is no word at this time. He has heard that HEB will
build in 1996 at our site. Contractors have been calling the City
questioning what our building codes are. HEB does their
construction plans by telling contractors what they want and then
reviewing proposals. By the end of 1996 we should have our HEB.

David Richmond mentioned that at this evening's meeting we had some
complete and not so complete applications. Some come in at the

last minute but all applications should be complete when they come
before the Commission.
David Richmond stated Pia Jarman made him aware of the following.
On behalf of the Commission he would like to thank Denise for
coming back early from her vacation so she could get our packages
ready and available to us on time.
David Richmond reminded everyone that at the previous meeting it
was mentioned about naming something for Bob Andrews. We do not
want to let this drift too long. We should take appropriate action
by the next meeting to make a recommendation to City Council. If
you recall we talked about the conference room being dedicated.
Pia had another thought to think about the xeriscape park out at
Dove Meadows. This is going to be a very nice park with a lot of
planning taking place.

the motion, which carried with a unanimous vote.
Chairman David Richmond adjourned the meeting at 8:45 p.m.
The next regularly scheduled meeting is January 23, 1996.
