Mart Rellstab, Randolph Brooks CU ~ # 1 CALL TO ORDER Chairman Ernie Evans called the December 10, 1996 regular meeting to order at 7:00 p.m. #2 APPROVAL OF MINUTES: Regular Session November 26, 1996. Merwin Willman moved to approve the Regular Session minutes of November 26, 1996. Gary Wallace seconded the motion which carried with a unanimous vote. #3 STATUS OF FINAL PLATS: . . . There were none. *4 CITIZENS' INPUT OTHER THAN AGENDA ITEMS: There were none. *5 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Vickery & Associates, for Final Plat Approval for Randolph Brooks Credit Union. (PC #288-96B) Steve Simonson stated the property owners are included on the plat. On the flood plain statement they have the wrong date, it should be September 30, 1992. Other than that the required information is on the plat. Merwin Willman moved to approve the final plat request submitted by Vickery & Associates, for Randolph Brooks Credit Union. Keith Van Dine seconded the motion which carried as follows: AYES: Keith NAYS: final David Richmond, Merwin Willman, Pia Jarman, Gary Wallace, Van Dine, Tony Moreno. Ernie Evans (Due to the violation of our own rules that the plat must be completely correct). *6 CONSIDER AND TAKE APPROPRIATE ACTION: Request from SCI Development Services Final Plat Approval for the Vacate and Replat of Lots 3 and 4 in Unit 1, and Lots 5 and 6 in Unit 2, Tri-County Business Park. (PC #291-96) . Steve Simonson stated the notation of the San Antonio water system has been removed. They decided not to include city of Schertz Water system. The flood plain is correct as only 2 of the 3 panels for the City have been changed. Ernie Evans asked if the engineering seals are a requirement for a final plat? Steve Simonson stated "yes", they are. Tony Moreno moved to approve the final plat submitted by SCI Development Services for the Vacate and Replat of Lots 3 and 4 in Unit 1, and Lots 5 and 7 in Unit 2, Tri-County Business Park, contingent on the Engineer's seals on the final mylars. Gary Wallace seconded the motion which carried as follows: AYES: Tony Moreno. NAYS: Ernie Evans, David Richmond, Merwin Willman, Pia Jarman, Gary Wallace, Keith Van Dine. . Motion was lost. John Krauss stated he is with Pape Dawson and did not know that the final plat approval had to have all the signatures on them. They were under the assumption that they could have two weeks after the plat approval to submit the final mylars -2- e e . with the signatures. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Wetmore Land Surveying, Inc., for Final Plat Approval Durnford Subdivision. (PC #292-96) Steve Simonson stated he has no comments. All of the information that is required has been submitted on the final plat. Tony Moreno moved to approve the final plat for Durnford Subdivision, submitted by Wetmore Land Surveying, Inc. Merwin Willman seconded the motion which carried with a unanimous vote. #8 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Veytia Partners, Master Plan Approval for Parkway Villas Retirement Community Gated. (PC #289-96) (Tabled 11/26/96) . Steve Simonson stated as mentioned in his notes, there are several items that the Commission will need to be aware of. The fence is offset from their property line as per the request of City Council to provide for an ingress/egress pathway for anyone that would like to walk from the Village to Elbel Road. This will be a paved walkway like that at the emergency entrance and breakaway gate. There is an item that was put on here at our request. However, our public works department requests that it be deleted; and that is the 11 X 35 street dedication for the corner. The corner clip for the fencing is shown for the visual ROW that we require. There was talk about adding a right turn lane. In talking with our public works director, he stated unless there is a five or six turn lane, he doesn't want a short turn lane. He feels with this type of development, there is not going to be that much more traffic and he requests that this be deleted. Ernie Evans gate details. asked if the master plan should also be showing Or is this only to be shown in the platting? the Steve Simonson stated the gate details are shown. The distance in the shaded areas to the actual curbing is 10 feet back. Mr. Veytia and Mr. Krape are present to speak on this. As there is not the traditonal turn around as requested in the past, the developers would like to discuss this as they feel it is deep enough. Ernie Evans asked about the walkway beyond the fence line to the property line. Should this not be shown? Merwin Willman stated not on the master plan. Gary Wallace asked what the feed back was on the public hearing? . Ernie Evans stated Mr. Veytia said that he had spoken 40 people according to Mr. Veytia's information, all those residents did not want Westchester to go through. -3- with about but one of There were . . . e e approximately 23 people attending the City Council meeting who stated they were from the area and had input. Everyone of the 23 stated they did not want Westchester to go through. One lady stated there were 15 signatures on the paper she had that also stated they did not want Westchester to go through. Not knowing whose names were on the letter out of the 23 present or whether these names were in addition to thos present, Ernie could not give exact figures. The case was made at the City Council meeting that Westchester should not go through. Joe Veytia stated the size of the island has been reduced from that originally proposed in the last master plan. It has been reduced from what was the ROW, all the way back to essentially a small island where the gates can be anchored. The reason being, it is difficult to go any further back as that would essentially eliminate the access to the first unit. There will be enough room for someone to turn around and go back out without going inside the property. Merwin Willman asked what the distance is from Schertz Parkway to the gate? Ron Krape stated about two car lengths. There is enough room for two cars to be off the road in front of the gate. The car in the very front will have the ability to turn around if necessary. This is why the island is so small. Joe Veytia mentioned keeping in mind the profile of the community which will be largely retired, there won't be coming and going at 8 and 5 like a typical community. Joe Veytia asked if we could solve the problem with a greater width instead of a greater depth so essentially one car can pass up another car that is waiting to get access. Merwin Willman stated if it is 30' off Schertz Parkway this should be enough room. Ernie Evans stated the issue that was discussed previously Commission on gates was, that they should be far enough allow for cars to stack in, and for a U-turn capability. to allow vehicles that were going in, but can't because home, a way out. with the back to This was no-ones Merwin Willman asked, then, what do you think is adequate distance from the street? Joe Haynes stated the 30' is a standard dimension on an entrance gate like this. By the roadway width, it has adequate staging for the vehicles to turn from the gate. Steve Simonson stated the difference here is the houses or duplexes are facing the street. When you drive into Carolina Crossing the houses are not facing the street, so you have a long lot with over 100' in depth before you would be dealing with cutting off any access of line of sight. -4- . . . e e Joe Veytia stated the technology that they are using is not the technology that you have to press a button or push a code to gain access for the people that live there. It automatically picks up the signal as they approach so the gate is already swinging open by the time the residents are there. For the purpose of the people that are living in the community the back up should not be a problem. It will only be so for the situations when someone is coming to visit there and trying to gain access and realizes for one reason or another they cannot gain entry. They have added enough possible depth to this. They could add some more width so that cars could essentially make a turn before they get to the boulevard and do a u-turn and get back into the exit portion of the entrance. If the Commission does not feel this is wide enough, they can widen it a little. To push it back any further, will be losing units. Ernie Evans stated on Elbel a 20' breakaway emergency gate is shown. Joe Veytia stated this came about at the request of City Council. It is the July 4th compromise that was made with the neighborhood representatives that were present the other night. What was worked out with the neighborhood is that, on emergency basis only, on July 4th, or other holidays, someone could break through the gate on the Westchester neighborhood side and go all the way through the subdivision and gain access to Elbel through the break-away gate there. This is if for some reason the mechanism for allowing them to not have to break the gates should fail. Everyone thought this was satisfactory. The pedestrian walkway will be improved to the same standard as the internal walkways. The City Council did not approve the plastic coded fence so they are going to have to put in either wrought iron or masonry. Ernie Evans stated if this is to be an emergency access gate, how are the homeowners going to feel proposing access through the common area in the back, where the current purposed sidewalk is or the trail is. Unless you are going to change your plat to put the paver type issue, that was shown before to us, from Westchester to the breakaway gate, your homeowners will have to deal with the ruts that mayor may not be created by the traffic going through there in the emergency situations. Joe Veytia such a way the grass, traffic but stated they are planning on landscaping this area in that a car will be able to get by. In the research on buffalo grass doesn't stand up so well with vehicular the bermuda 419 does. So the 419 will be used instead. Ernie Evans asked if this are would be delineated in any way fashion or form. Joe Veytia stated essentially the walking trail landscaping will be built in such a way that there will be no physical impediments so that a car would only have to go over a mound with a trail by Elbel. -5- e e . Ernie Evans stated the reason he asked about the emergency access is because on the master plan it is different than on the plat. Also the 26' wide markings in the road are incorrect, it should be 30' . Gary Wallace stated that we all agree in concept but there is a lot of nikpicking. What is typically done in this type of situation? Ernie Evans stated there appears to be some mix of opinion among us in terms of whether we are particular on the final plat or the master plan. The master plan or the site plan dictates what is on the plat and it also delinates things that may not be on the plat. The master plan should be important as it is the overall drawing of the unit. Where Mr. Veytia is showing the fence, is basically what the construction plans are going to show and the developer is going to build. The plat is showing the road as 30'. Joe Veytia stated he would like to be able to submit the master plan and final plat for approval at the same time, if possible, with the corrections in place. Steve Simonson stated this would not be a problem. It needs to be made very clear what the Commission agrees upon what needs to be changed in the motion. As a suggestion you can use notes on a master plan as well as on the plat. . Steve Simonson stated the corrections are as follows: pedestrian walkway, increase width of the road, a note concerning the emergency access from Westchester to Elbe1, increase width of the entrance off of Schertz Parkway, note concerning the walkway, fence location, eliminate the turn lane from Schertz Parkway to Elbel. Gary Wallace moved to disapprove the master plan for Parkway Villas Retirement Community Gated submitted by Veytia Partners due to the inadequate width on the entrance, not delineating the vehicular ingress/egress, incorrect statement on the street width, improper location of fence, inclusion of a turn lane which will be eliminated on Schertz Parkwy, no note explaining the walkway. Tony Moreno seconded the motion which carried with a unanimous vote. #9 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Veytia Partners, Preliminary Plat Approval for Parkway Villas Retirement Community Gated. (PC #290-96) (Tabled 11/26/96) Steve Simonson stated the same item, the right turn lane will need to be eliminated as shown. There is the one foot non access easement on Schertz Parkway and Elbel. The flood plain statement is correct. There also should be on this plat several of the notes that were talked about in the master plan. The emergency vehicular traffic, pedestrian walkway, and the emergency gate. . Ernie Evans asked about the one foot non access easement on Elbel -6- e e . pointing to the dotted line that comes around to Schertz Parkway to lot 44. It is hard to distinguish if the dotted line finishes the property on the back of the drainage easement. Steve Simonson stated the one foot non access easement is only on the streets. Ernie Evans stated on the plat, on lots 22 and 23, there is a note on the inner line about the 20' building setback line. If you bring the line around to lot 37 on the opposite side of the street, it picks up and goes out to the street. Is this 20' from that side of the house that it is facing? Steve Simonson stated the only way to build with the cul-de-sac would be to face in. Ernie Evans stated by the master gate on lot 4, there is a 20' setback line that comes around by lot 7 that indicates that this is a 20' setback with a 32' line lot. Steve Simonson stated it should be a 10' building setback. David Richmond asked about the land by the main entrance being an island. If this is so, it should be noted on the plat as a common area. . Ernie Evans stated on the note that says "unimproved" by lots 30 and 31, this should be noted as City of Schertz property. Merwin Willman asked about the sidewalks on Elbel Road. Evans stated they are shown on the master plan. Ernie Ernie Evans mentioned all the items that need to be corrected: the elimination of the right turn lane on Schertz Parkway and Elbel Road, entry way to be defined, the setback lines on lots 7 and 13, change the unimproved statement below lots 30 and 31 changed to City of Schertz, note indicating the walkway from Westchester to Elbel Road, the emergency gate at Elbel Road, note to the effect of the ingress/egress area, label the common are at the entrance. David Richmond moved to approve the preliminary plat for Parkway Villas Retirement Community Gated submitted by Veytia Partners with the following changes: eliminating the right lane on Schertz Parkway and Elbel Road; widening of the master entry with the gate being a common area, changing of the setbacks on lots 7 and 13, changing of the "unimproved" to the City of Schertz, a note of walkway from Westchester to Elbel Road, the emergency gate at Elbel Road, and a note of the vehicular ingress/egress through what is the common area. Tony Moreno seconded the motion which carried with a unanimous vote. . #10 CONSIDER AND TAKE APPROPRIATE ACTION: Bank and Trust on Schertz Approval. (PC #279-96) -7- Request from Schertz Parkway Site Plan e e . Steve Simonson stated the vicinity map is not shown. The only correction would be FM 3009 to Roy Richard Drive. The adjacent property owners are noted. It states the name and the architects name. It also shows what BOA approved for the 25' building setback on Schertz Parkway with the 20' landscape buffer. Mr. Golla informed the BOA that the entire length will be landscaped. Gary Wallace moved to approve the Site Plan for Schertz Bank and Trust on Schertz Parkway submitted by Schertz Bank & Trust. Tony Moreno seconded the motion which carried with a unanimous vote. #11 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Backyard Adventures for the Construction of a Chain Link Fence at the location on IH 35. (PC #294-96) Steve Simonson stated this request is brought before the Commission because the ordinance requires that an 8' privacy fence, solid non-wood must separate a business from a residence. The owner of the mobile home that is directly behind this lot feels that an eight foot fence of any kind put up will cut down on the air circulation and visible effects of her property. Pia Jarman stated the lady requesting this wants a chain link fence because she knows what type of business is going in. If it were some other type of business, would she feel the same way. . Steve Simonson stated this request for business originally was an SUP, so being a one time item this is what the land has to be used for until Backyard Adventures is to stop business. Merwin Willman stated the letter just states a chain link fence between her property and lot 22. Steve Simonson stated it has been passed down to him by phone calls what the owner of the manufactured home desires. Keith Van Dine stated the letter states a four foot chain link fence and there is supposed to be an eight foot privacy fence. Is the chain link fence going to have to be eight feet? Steve Simonson stated what is on the property right now is a four foot chain link fence. The business owner is hoping to leave it there as it is the manufactured homeowner's own private fence. David Richmond asked if we are talking about the same back property lines? Steve Simonson stated "yes, identical". Pia Jarman moved to approve use of the chain link fence in lieu of an eight foot privacy fence at the location on IH 35 submitted by Backyard Adventures. Gary Wallace seconded the motion which carried with a unanimous vote. . #12 CONSIDER AND TAKE APPROPRIATE ACTION: December 24th meeting. -8- Cancelation of the . . . e e David Richomond moved to approve the request to cancel the December 24th meeting. Pia Jarman seconded the motion which carried with a unanimous vote #13 REVIEW AND DISCUSS: Master Road Plan. Steve Simonson stated he asked for this to be on the agenda due to several items approved by this Commission and also action by the City Council. We need to study again the Master Road Plan and bring it up to date. Hillview which is in Woodland Oaks is now dead ended because of Berry Creek. There was a road that was supposed to go from Val Verde out to Maske Road but that has now changed with the development of Windy Meadow. There are several long term issues that we are going to want to look at on the roads. They can either be in conjunction with the comprehensive plan, or annexation, but it is something that will need to be discussed at a later time. Ernie Evans stated he is personally in agreement with Steve's statements and feels it has to be addressed as we do the comprehensive plan. Even if there needs to be an extra group meeting and we bring it back as a preliminary. It needs to be addressed in the 1997 year because of the comp plan issues. Tony Moreno stated he agrees with Ernie it needs to go along with the comp plan. Pia Jarman stated the comp plan committee could look at it and then bring it back to the P & Z Commission to either approve or disapprove. Steve there plan. Simonson stated there is no urgency to this right now, but have been some significant changes since 1995 with the road It was agreeded that the comp plan committee will review this issue and present it to the P & Z Commission. #14 GENERAL DISCUSSION: Tony Moreno: Tony Moreno stated he has no comments. Keith Van Dine: Keith Van Dine asked what the situation was with the school and the master road plan? Steve their has road roads Simonson stated before the school even came forward with request he was thinking about the master road plan. There been a lot of discussion in the comprehensive plan meetings on changes and there are some subdivisions that have blocked that we had said would go through. And also the Council's -9- e e . actions have caused changes. Gary Wallace: Gary Wallace stated he has a question that stems from David's presentation last week at the City Council meeting. In a former life, he was commissioned. In the Air Force you were not allowed to use your association with the Air Force in an outside endeavor. Nothing in our oath as P & Z Commissioners gives us a code of conduct or ethics. David made a presentation at the City Council that, up until the point that he stated he was a member of the P & Z Commission and had voted against the school proposal was a private citizen's input. "But at that point I thought it became a verbalizing of the minority opinion of the P & Z Commission. How does this play and what is expected of me outside of this room?" Tony Moreno stated this is a good point and he has also wondered about this himself. Pia Jarman stated David pointed it out that this was his own opinion. . David Richmond stated he pointed that out at the beginning that this was his own personal opinion. "I stated that I was there as a concerned citizen but also that I was on the P & Z Commission". David felt that the forum including the citizens knew that he had an interest in this request as a citizen. He was aware of the information that as a citizen he wouldn't have been aware of that same information. What he stated was what he knew by virtue of being on the P & Z. He felt this needed to be made public knowledge. Gary Wallace stated he felt betrayed because a minority opinion was verbally represented at the meeting when the majority of the opinion of the body was on a piece of paper. "I would be willing to bet that some members of the City Council thought that the P & Z had recommended disapproval". David Richmond stated he did not intend to represent it that way. "I represented it mainly that I was not there for or against, but that I did happen to vote against in the session. All I wanted to do was to make sure that facts were understood clearly by the Council in regards to the road. This was the only thing I was there to talk about and that is the only thing that I addressed. Gary Wallace wondered if his parallel of the P & Z Commission to the Air Force is not then, a valid parallel. . Ernie Evans stated he is not going to say that this is entirely a true statement. There is a section in a book from the APA Conference that directly addresses ethics of a planning commissioner. While it does not necessary deal with the direction of this issue, it does deal on how we present ourselves to the Councilor City staff. "I believe there is probably directions -10- . . . e e that exist out there for us to consider, that say there are grounds for us to present ourselves as Commissioners. I cannot believe it is an unlimited issue. On the other side of the coin, I would also point out, if you were there, we had a distinguished member of the community present, as a citizen, but at the same time that citizen acknowledged he had a relationship on a very professional level as the judge representing this City. But the listeners were to ignore that point. In fact, regardless of their opinion or his opinion, he went to extreme lengths to ensure they understood him as Mr. Citizen. I am not going to sit here and wager if what he said had an opinion on the council because of their proximity or relationship with him or as a Mr. Citizen. I did, however, take this into note. So I am not sure if I have a cut and dry answer. My concern is that the facts be known. Out of the forest fire the other night, very little of it seemed to be factual information of real concern to City Council. Some of the things I heard were personal issues of the "Not In My Back Yard" variety. Each citizen has a right to his opinion and Council has to listen to them. Keith Van Dine stated he agrees with Gary that we ought to keep our personal opinions and professional status separate. Someone may feel this was an influence. Pia Jarman addressed the point about influencing City Council. It already knew about this Commission's approval on a four to three vote. So they new the P & Z as a Commission had voted approval. What David was saying there for the record was simply the reason some were opposed, not against the site, but a clairification on the road issue. The public does not have a whole lot of information on what was said or done prior to the hearing. Gary Wallace stated his only point is, he thought the minority view was aired before the City Council and the majority was not. Ernie Evans stated perhaps we could acquire a copy of David's document which he took to the podium and he read from. Gary Wallace stated his point is: if someone is going to represent the minority or majority opinion, as a Commissioner the opposite side should also be represented. David Richmond stated he has no objection to that "You may read my statement differently than what I had intended". I did not intend it to be a representation necessarily of the minority opinion. Rather I intended to convey to City Council the concern which I felt as a citizen, as well as a P & Z Commissioner. The principal concern; is the roadway I even acknowledged that in August we agreed basically that the site was a good site. Early on I even stated that it should not have taken five months to get to City Council. The fact that the road issue was never resolved, I felt, needed to be reiterated and I am not sure I could have said what I said without letting them know that I was involved with the P & Z." Merwin Willman stated "You would have never been able to make that -11- e e . speech if you hadn't been a member of the P & Z. In actuality, you were representing P & Z and their negative view on it." David Richmond stated he does not see it that way. "I gained a broad factual knowledge by being a Commissioner. But I attempted to ensure that the Council was aware that I gave a significant fact: and that was that there was not going to be a second access with the completion of the school because there was no commitment from a developer. I could not have been aware of that if I had not sat on this Commission. Stating this fact doesn't represent the minority opinion." Gary Wallace stated four of us felt that the developer will construct the road. Ernie Evans stated this could go on all night, so the discussion is duly noted. David Richmond stated "My statement is available. Would we consider it to have been appropriate, if I had not stated that I was a member of the P & Z, made a statement similar to the one I made, said everything but that I was a member and the vote was four to three. Would this have made a difference? If any member of the Council had asked how I came upon this information, then let them know I am a member of the P & Z." . Gary Wallace stated he would have had no problem with that. It was the fact that it was done voluntarily up front that he objected to. Pia Jarman: Pia Jarman wished everyone a very Merry Christmas and Happy New Year. Merwin Willman: Mewin Willman stated he will hold his comments just before adjournment. David Richmond: . David Richmond stated he would like to make a request as we will most likely have to deal with the school issue again. Maybe Steve could determine for us if Captex Developer does really own the property in question as it seems the reason we could never get a commitment from Captex is because he doesn't own the property. This is an interesting situation in view of some of the attempts at commitment made to this Commission during the course of our meetings from June to November. It would be interesting to this Commission to know if Captex does own the property or he has options on the property that he has failed to exercise. If he does, at what point of time did he purchase the property? Steve stated he would do his best to have this question answered. -12- e e . Councilman Ken Greenwald: Councilman Ken Greenwald stated that at the public hearing there were excerpts of the P & Z minutes, with the vote tabulation. "I don't feel there was any kind of influence. It was how the Commission voted and how you all thought. The public hearing was to receive any other information that neither side had heard yet. There was none made. The vote went down. The school has the opportunity to reconstruct the letters of intent. It has been said that they are going to Cibolo." Councilman Ken Greenwald stated as far as Mr. Veytia's property, he sent out scare tactic letters over the week end. One was sent to Ken's house as he lives at the opposite end of Westchester. It was stated in the letter that by opening up the road, all the school children are going to come running through your property. Most of the people who spoke to keep Westchester closed have only lived in the area 5 to 7 years. The one lady who did speak has lived in the subdivision 23 years but doesn't even live on Westchester. Mr. Veytia was given a two year time limit on building. Councilman Ken Greenwald asked if the Commissioners had checked their calendars and if another night for the P & Z meetings would be a conflict. Some of the Commissioners indicated there would be a conflict. "Then this is a dead issue" Mr. Greenwald said. . Councilman Ken Greenwald stated the Christmas lighting on Thursday was a star spangled show. The ROTC did a wonderful job and he hopes they can help again next year. Councilman Ken wonderful show and better. Greenwald stated the City Christmas party was a done by the employees. Every year it gets better Councilman Ken Greenwald wished everyone a very Merry Christmas and Happy New Year and to be safe. Steve Simonson: Steve Simonson wished everyone a very Merry Christmas and Happy New Year. Ernie Evans: Ernie Evans stated one item that he had asked Steve about was the fencing issue across the drainage ditch along Schertz Parkway by Carolina Crossing. . This is, so you can see what the over-all developments will look like. There is nothing in concrete that tells us what we have to do. But tonight was a good example: a plat only requires certain things, whereas a site plan or master plan gives you a much broader idea on the over-view. In effect you are stating precedence and legal issue on a plat. . Ernie Evans stated, Gary's earlier question was pertinent because as you look back through, in the last year, we have not as a Commission paid as much attention to the site plan or the master plan as we should have. "I believe there are things that go on either the site plan or the master plan, having read the UDC that we are ignoring that determines what that site is to look like down the road and it will never be on the plat. As tonight, on the fence, it was on the master plan and will not ever be on the plat. We need to reread the UDC in terms of taking a look at how we look and treat the site plan or master plan and maybe not treat them with as much of a grain of salt as we do with the preliminary plat. We treat the preliminary plat as preliminary and let it go with mistakes because they will be corrected at the final plat. But there is no correction on the master plan once it is approved. Maybe as a Commission we have not taken the time that we should. Merwin in the changed. Willman stated there are some changes that need to be done UDC and we should not wait too long to get these things Ernie Evans stated there was a note on the agenda that before we got to items 8 and 9 these items should have been "taken off the table" and he apologized that he had neglected to do so. Ernie Evans stated he has several of the books from the latest Planning and Zoning Conference. If anyone is interested, they will be available in the office. Ernie Evans asked if Steve ever answered the issue about the mobile home that Keith brought up a few meetings ago? Steve stated that he did send someone out there to check it out he will look into it again. . Ernie Evans asked if a letter to Cliff Johnson has been sent to remind him his plat is due here by February. Steve stated he has a note to send it to Mr. Johnson for the first of January. Keith Van Dine stated there could be a change of plans in the area -14- . . . e e as Mr. Johnson has talked with him and asked about putting in a Juvenile Home. Steve Simonson stated this would be a different type of zoning as it would be a different type of use. Ernie Evans asked if we have any new information on HEB? stated it should be here in January for our first meeting. Steve Merwin Willman: Merwin Willman stated he has a letter that he would like Ernie to read to the Commission. Ernie Evans stated he could not read the letter. A couple of months ago one of his cohorts declined something, "I assume I have the authority to decline." Merwin Willman stated you can decline but it won't do Ernie Evans read: "3 December 1996, To the P & Z Letter of Resignation: I hereby submit my letter of from the Commission effective immediately." any good. Commission: resignation Ernie Evans stated "Is there anyway we can convince around for a while?" Merwin stated he has been doing 17 years and feels this is long enough, and maybe needs to get their feet wet. you to stay P & Z work for someone else Gary Wallace mentioned that Merwin has it almost perfected. Merwin stated during the last 3 or 4 years, his interest has been declining. "I always said if I got to where it was not fun any more that I would quit. I don't have the desire to do the work on the Commission that I used to do. I feel I should quit." Ernie Evans stated he hates to have Merwin go and he felt he speaks for some of the other people at the table. "Your comprehension that come before us are valuable. I really hate to see you go and don't want you to go. Whether you write for us or not, the things that you come up with, are things I can't even find in the book yet. These are invaluable inputs when we are sitting here discussing issues." Merwin Willman mentioned "you make it hard, Ernie." Ernie Evans stated there is a lot to be said about experience. Merwin has the knowledge and the history that we are never going to have; the knowledge we have not yet lived. "I really hate to see you do this and I don't want you to do this. Would you consider thinking about this for six months? You do a wonderful job keeping us straight, reminding us of the pro's and con's, the rule book etc." Merwin Willman stated he would give it another six months of -15- e e . serious thinking. "I enjoy it when I am here but the minute I get away from here I have no desire to do the work." Pia Jarman stated "Don't worry about keeping up with all the you have been doing, just come to the meetings and keep Commission informed. work the Ernie Evans stated you could use the six months to tutor some of us. We could all benefit in asking you questions and taking your input. Councilman Ken Greenwald stated on the comment made by Judge Cinnamon: whatever the decision is made, he is going to live with it and break bread with us and be a friend. This is the truth: LeRoy was giving his opinion. "Merwin, it is the same way with you. In speaking for the City Council we value your opinion. Corporate knowledge is hard to replace. Your records are better than City records and it helps. I hope that you will reconsider." Merwin Willman stated he will go ahead and give it six months.
