A RESOLUTION REQUESTING THE U.S. ARMY, CORPS
OF ENGINEERS TO PROVIDE A DETAILED PROJECT
STUDY OF THE CIBOLO CREEK FROM THE M.K.T.
RAILROAD TO THE CRESCENT BEND.
WHEREAS, there have been major floods along the Cibolo
Creek causing heavy loss of municipal and private properties,and
WHEREAS, the area lying between the M.K.T. Railroad and
the Crescent Bend area which embraces the cities of Selma, Schertz,
Universal City, and Cibolo receives the brunt of such flooding; and
WHEREAS, the low alluvial plain of the Cibolo Creek lies
within the boundaries of the cities of Selma, Schertz, and Cibolo and
whose families are subject to such flooding; and
WHEREAS, there is strong indications that both man-made
and natural obstructions may impede or redirect the natural flow of
water and may in fact, increase the severity of flooding, NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
That an immediate and detailed project engineering study
should be conducted by the U.S. Army Corps of Engineers on that portion
of the Cibolo Creek lying between the M.K.T. Railroad and the Crescent Bend
area;
That, the Mayor of the City of Schertz, Texas be authorized
to sign a letter of intent, marked as Exhibit "A", hereto, expressing an
interest or intent for the City of Schertz, Texas to participate in flood
control and recreational development of the Cibolo Creek, and
That, special emphasis be placed on physical flood control in
and around the City of Schertz, and
That this requested study propose measures that can be taken
to alleviate the severity of flooding, and provide a written report to the
City of Schertz of these findings.

EXHIBIT "A"
LETTER OF INTENT CITY OF SCHERTZ
The City Council of the City of Schertz, State of Texas, after
consultation with representatives of the residents of the affected area
of the Cibolo Creek vicinity and in accordance with your request of a
letter of intent executed by this Council, state: That the City Council
of the City"of Schertz would, when requested, furnish a resolution of
assurance to sponsor the project and assure timely construction by com-
plying with the provisions of Section 205 of the 1948 Flood Control Act
as amended. These provisions are summarized and set forth below:
1. Provide without cost to the United States all
lands, easements, and rights-of-way necessary
for project construction.
2. Bear the cost of all alternations and relocations
to utilities, roads, bridges, cemeteries, and other
community services, except railroads.
3. Hold and save the united States free from damages
due to construction, operation, and maintenance of
the project, does not include damages due to the
fault or negligence of the United States or its
contractors.
4. Maintain and operate the project after completion
in accordance with regulations prescribed by the
Secretary of the Army.
5. Assume full responsibility for all project costs
in excess of the Federal cost limitation.
6. Make cash contribution for project costs assigned
to project features other than flood control.
7. Contribute toward construction costs where substantial
land enhancement or similar type benefits will accrue
in accordance with existing pblicies for regularly
authorized projects.
8. Prevent encroachment which could interfere with
proper functioning of the flood control project.

9. Prevent encroachment on any ponding areas, or if
ponding areas are impaired, provide a substitute
storage capacity or equivalent pumping capacity
promptly without cost to the United States.
10. Agree to consider the adoption of such flood plain
regulations necessary to insure compatibility be-
tween future development and the degree of flood
protection provided in the project area.
