't~ MINUTES OF THE ORGANIZATIONAL MEETING OF THE SC';HERT7.JSEGUIN I.O<;AL GOVERNMENT CORPORATION THE STATE OF TEXAS ~ COUNTY OF GUADALUPE ~ SCHERTZlSEGUIN LOCAL ~ GOVERNMENT CORPORATION ~ On tbis, the 17th day ofJ~ 1999, the Board of Directors (the Board) of the Schertz/Seguin Local Government Corporation (the Corporation) convened at 1 :35 o'clock p.rn. in the City Council Chambers located at Seguin City Hall, 210 East Gonzales, Seguin, Texas, with the following members being present and in attendance: ~bin ~r Ramon J. Wolverton 1 constituting a majority of the persons appointed to the Board and a qUOIUm for the uansaction of business, and notice of such meeting having been duly given in ~ with the provisions of Texas Law. Also, in attendance were Ken Greenwald, Eric Vordenbawn. Kerry Sw~ and Jack Hamlett. The meeting was ca.I1ed to order by President Robin DwYer. The second order of business was to consider and take action regarding Minutes of May 20, 1999 meeting. Director Gloria Rivera stated on Page 3, last paragtapb, the year "2005" be corrected to read "2050." A motion was made by VICe-President Cook and seconded by Director Gloria Rivera to approve the Minutes oCthe :May 20, 1999 meeting with the noted correction. Upon a vote being called. such minutes were approved. The third order of business presented to the Board was an engineering report by Clay Romming. Mr. Romming advised he bad completed the projections of the amount of water needed ror both cities aDd they are currently under review by the individual cities. The projections generally represent those amounts of water that were included in Senate Billl Pltlnning Document which is being developed for the region. I obtained those projections so there would be no conflict. The projectioDS correspond very closely with what we bad in the past. We could argue with some of their figures but: at this time its irrelevant because some of the projections are in the early years, 2000 & 2010. This does not impact our planning because our planning for service would extend to at least twenty or thirty years into the future. Also, 1 concluded what I believe is the pipeline route from beginning to end. At this time it is still in paper form. Now we move into environmental considerations, permitting considerations, and the hydraulics, but it's going to be very close to this route. This allows a beginning. The next step will be to start on the hydraulics which will give us pipeline si7..ing and the ultimate cost. This will take a few weeks to complete. 1 ..... Mr. Ramming stated, we have a very preliminary design of the water treatment. The water does have varying amounts of iron in it in solution form. The iron must be removed through treatment process. This has always been an anticipated treatment of the water. The process does require us to obtain a wastewater discharge permit. Once treated we will not have iron delivered to the user. The founh order of business presented to the Board was a legislative report regarding underground water district matters. Mr. Crockett Camp stated the Guadalupe County amendments did pass the 1egis1ature. It is significantly good news that they were not included in what became the package bnl of the other districts that were created at this time. The next hurtle is to get the word out so that it can pass at the confirmation election. Kerry Sweatt advised be bad spoken with Tun Wolverton and it was his understanding that Guadalupe County is working bard to develop the census data that would be used to draw up the various wting districts. 1be infonnation was DOt readily available through AACOG. Commissioner Wo1verton is working with the County to obtain the information and get it drawn up rather quickly in order to meet election deadlines. .. President Dwyer stated on Monday. June 14, 1999. the mitia1 Directors one of whom is Gloria Rivera met at the Commissioners Court in Seguin for an organizational meeting and elected officers. The group basicaJly discussed the situation and clearly the biggest stUmbling block we have is the collection ofme data. One of the things we need to think about is do we provide assistance to obtain a legal staff to perform the legal analysis of the census work completed and get the election information sent to the justice Department in a timely manner so we can be on the November ballot. It is important we be on the earliest ballot possible. .~~.: I understand Becker staff of Austm recen.dy performed census work for the Seguin School District and a lot oftbe demographic information is apparently current and ready. There may be a way to piggy.back on the school districts completed information to assist the County and AACOG. As a board there have been discussion,s how we may provide 8dmini~trative service to this underground district at some point. Mark Wallock and Hilmar Blumberg will be going to AACOG on Friday, June 18, 1999. to determine what data and service is available. Kerry Sweatt asked ifwe bad any idea what cost we are looking at. President Dwyer stated Dot as this time but someone is looking into it. J.R. Perez has prepared maps and raw census data. What we do not have is the block by block demographic particulars. Pat Lindner advised we may want to contact Russell Persyn with Texas Agricultural Extension Service to provide information to the public and assist in the education of the public concerning this isS\1c. 2 ... ,J ~l>"~ President Dwyer stated the message is you have a property right and the state has a concept called the law of capture. That can be regulated by this underground water district. WIthout the underground water district the law of capture allows them to such your well dry. If you want that protection we need to get this district in place. As long as the public understands regulation is their 1iiend. not an enemy. Because what the public is afraid ofis losing their property rights. It is the lack of education which puts them in danger of losing the property rights. It is an education situation. Jack Hamlett said the City of Seguin spent approximately $20,000 to redis~ last year. Vice-President Cook questioned the outline of the voting districts. President Dwyer advised the district is bound by Hwy 90) ill-tO and Hwy 90 off toward Lulling to the east, aU the way to the Guadalupe County line. It's drawn now into seven district, three actually in the City ofSeguiD, one partially in Seguin going west and one big district that goes out to where most of the Carrizo Aquifer is and the Gonzales County line. The two other districts take out toward the Olmos Area and going that direction in the county. Director Rivera stated when these districts are determined and identified it might be a good idea if this corporation would endorse three people to nm for the election. We would be assured that there will be a voice. .' President Dwyer responded with we are certaiDly going to have to be involved. Everyone benefits from an underground water district in Guadalupe County. Even Gonzales County benefits from a water district in GUJdalupe County. Everyone's interest is the same, that is that we want this resource to be preserved so that it can be utilized by Schertz. Seguin. other citizens of Guadalupe County from now and into the unforeseeable future. Keith Pate made the remark that education is the key and we have the key to educate the public. The fifth order of business was a report by consultant on status of test well proposals. Mr. Bin Klemp advised we have been working with Gonzales District to obtain locations of the wells they have been registering. I think we are pretty much up with them in the project area. With regards to the test wells we went out to bid the first time with eight drillers. We received a total of four bids from the eight prospects. All four bids were out of budget. After talking with Crockett Camp a revision was made to the specifications. Specifications have been remailed. We will be working very close with the drillers. Bids are due June 29, 1999. The two wells we want to drill will be used as water level obseIVation wells in the pumping test. They should provide us with outstanding data that we can estimate the transmissivity of the formation and the storage. With regards to the Lott wen we will have electric logs running so we will be able to look at the thickness oftbe aquifer and be able to perform a sand count. On the Blumberg well we already have an excellent log. In summary, we may be disappointed again but one of the options that is open to us is to eliIninate the gravel pack on the Lott well and we will come within the budget. 3 ..... A" President Dwyer asked if the gravel pack is necessary for producing water in this kind of sand. Mr. Klemp stated that about six out often wells in the Carrizo will do better with a gravel pack. There is a difference of opinion between drillers. We are not required to gravel pack and it will not effect the testing data. President Dwyer called for an adjournment of the regular session at 2:22 p.rn. with Board members going into an executive session. The executive session adjourned and the regular meeting was resumed at 3 : 10 p.rn. President Dwyer advised there would be no action taken as a result of the executive session.
