A RESOLUTION
CREATING A PUBLIC LIBRARY; PROVIDING FOR THE PURPOSE,
ORGANIZATION, APPOINTMENT AND DUTIES OF A PUBLIC
LIBRARY ADVISORY BOARD; PROVIDING FOR THE APPOINTMENT
AND DUTIES OF A LIBRARIAN; PROVIDING FOR THE FINANC-
ING OF THE SCHERTZ PUBLIC LIBRARY; AND PROVIDING
REGULATIONS FOR THE OPERATION OF THE SCHERTZ PUBLIC
LIBRARY.
WHEREAS, there is a need for the City of Schertz to create and
provide for the governing and operation of a city public library, NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION I
A city library, to be know as the Schertz Public Library, is hereby
created.
SECTION II
A Library Advisory Board is hereby created.
A. The object and purpose of the Library Advisory Board is to act
as an advisory, policy-recommending board to the City Manager and City
Council relating to the establishment and usage of the library, the nature
of services rendered or to be rendered by the library, the manner in which
the library service may be coordinated with other municipal services, and
other such matters as the City Manager or City Council may deem beneficial
to the City of Schertz. '-''<.C,.
B. The Library Advisory Board shall consist of twelve (12) members,
all residents of the City of Schertz, to be appointed by the City Council
for the term of two years; provided, however, that of the first twelve
(12) appointments made under this resolution, six (6) shall be appointed
for two (2) years and six (6) shall be appointed for one (1) year; and
thereafter an alternate six (6) shall be appointed each year for said two
(2) year terms. The initta1 terms under this enactment shall commence to
run from the enactment date of this resolution.

C. F011dWing the initial appointments, all appointments and removal
actions to or from the Library Advisory Board will conform with established
City policy pertaining to standing committees.
D. The Library Advisory Board shall select from among its members,
a Chairman and a Vice Chairman, said selections to be recommended to the

City Counci 1. The City Council will appoint a Chairman and Vice Chair-
man to the Library Advisory Board.
E. The Librarian shall serve as an ex officio member of the Library
Advisory Board, and shall serve as Secretary of the Board.
F. Until such time as the City Council authorizes funding in the
City Budget for a paid librarian, the City Manager shall serve as an ex
officio member of the Board.
G. The duties of the Library Advisory Board shall be to:
1. Hold meetings as they deem necessary in accordance with
the Open Meetings Laws of the State of Texas.
2. Receive suggestions and recommendations from the City
Manager and City Council respecting the library and
library service and to make recommendations to the City
Manager and City Council regarding the same if deemed
necessary and desirable.
3. Make periodic reports to the City Manager and City Council
concerning the work of the Board; submit meeting minutes
for City Council approval; and make such special reports
as may be requested by the City Manager or City Council.
4. Carry out and perform such other reasonable regulations and
requirements as may from time to time be made and adopted
by the City Council.
H. The Library Advisory Board shall have no power to obligate the
City of Schertz in any manner whatsoever; library finances shall be handled
in the same manner as any department of the City government with respect
to those departments having volunteers serving in place of paid full
staffs.
I. A simple majority of appointed members shall constitute a
quorum, and shall be necessary to conduct a meeting of the Board.
J. A City Council member, designated by the Council, shall serve
as an ex officio member of the Library Advisory Board.

SECTION III
The administrative head of the City Public Library shall be a
qualified librarian. Said position shall be filled by the City Manager
and be under the control of the City Manager, and shall draw compensation
in accordance with the City's pay plan. Said position may be filled only
when funds are appropriated in a Fiscal Year Budget by the City Council
for the position. Until that time, a volunteer librarian will be chosen
by the Library Advisory Board, recommended to the City Council, and appoint-
ed to that role by the City Council.
SECTION IV
General rules and regulations for the operation of the library shall
be left to the discretion of the Library Advisory Board, subject to approval
by the City Manager.
SECTION V
Finances for the operation of the library shall be appropriated by
the City Council, as they deem necessary, from the General Fund of the City
in a manner commensurate with the normal Fiscal Year Budget appropriations.
A separate account, to accomodate public donations, will be created by the
City Manager and entitled "Library Fund". Said account will require dual
signatures, for withdrawal, with the possible signatories being: The Mayor,
the City Manager, City Secretary and Library Advisory Board Chairman. Said
fund will be audited by the City's auditor as if a part of City funds.
SECTION VI
The City of Schertz hereby agrees to accept all gifts and donations
of books, educational material, equipment or monetary contributions that
may be made, and it is agreed that all such donations shall constitute and
form the books, equipment and Library Fund of the Schertz Public Library.
SECTION VII
If any provision, exception, section, subsection, paragraph, sentence,
clause or phrase of this resolution or the application of same to any per-
son or set of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of the re-
maining provisions of this resolution or their application to other persons

or sets of circumstances and to this end, all provisions of this reso-
lution are declared to be severable.
SECTION'VIII
This resolution shall take effect from and after its adoption by
the City of Schertz.
