YI-R...:tj A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, ACKNOWLEDGING THE DESIGNATION OF WASTE WATER TREAT- MENT MANAGEMENT AGENCY FOR THE OPERATION AND MAINTENANCE OF THE SEWAGE COLLECTION SYSTEM OF THE ASSIGNED SERVICE AREA AND CARRY OUT SUCH APPROPRIATE SECTIONS OF THE AREAWIDE WASTE WATER TREATMENT MANAGEMENT PLAN FOR THE SAN ANTONIO 208 PLANNING AREA CONSISTENT WITH THE CITY'S FINANCIAL CONDITION AND NEEDS IN RESOLVING WASTEWATER COLLECTION CONCERNS. WHEREAS, the City as the designated management agency must have the authority and capability to carry out applicable portions of the San Antonio 208 Areawide Waste Treatment Management Plan; and WHEREAS, the City as the designated management agency must indicate its willingness to proceed to carry out its responsibilities as identified in the Areawide Waste Treatment Management Plan; and WHEREAS, requirements demand that eligibility for federal funding is contingent upon designation as a Management Agency for opera- tion and maintenance of sewage collection system, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT the City of Schertz accepts designation as a management agency for operation and maintenance of sewage collection system for its service area, consistent with the City's financial condition and needs in resolving wastewater collection concerns. SCHEDULE: Continued present operations, including standard'operation and maintenance of .the City's'collectioTl system: COSTS: The City will pay their proportionate share of future treatment facilities. AUTHORITY: Article XI, Section 5 of the Texas Constitution and Article 1165, et. seq., Vernon's Texas Civil Statutes. FINANCIAL ALTERNATIVES: 1. 201 grant, 2. FMHA grant and loan 3. Loan from TDWR plus local tax bonds CONTINUING PLANNING: The City will participate in the continuing planning process through Cibolo Creek Municipal Authority's direct representation of the area.
