A RESOLUTION
ACCEPTING THE PROVISIONS OF STATE DEPARTMENT OF
HIGHWAYS AND PUBLIC TRANSPORTATION COMMISSION
MINUTE ORDER
WHEREAS, in Guadalupe County, the City of Schertz has requested
assistance in reconstruction and widening on Live Oak Road from Farm to
Market Road 3009. West and South to Pecan Avenue, a distance of approxi-
mately 1.2 miles; and
WHEREAS, it is anticipated that Live Oak Road will be included
in the Urban System; and
WHEREAS, it is the desire of the State Department of Highways
and Public Transportation to assist the City of Schertz in such work;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT the City Council of the City of Schertz, Texas accept the
provisions contained in Minute Order No. 81169-00121, passed by the
State Department of Highways and Public Transportation on August 25. 1983,
for the improvement by the State Department of Highways and Public Trans-
portation of the street or streets described below:
Live Oak Road from Farm to Market Road 3009, West
and South to Pecan Drive, a distance of approxi-
mately 1.2 miles.

the improvement by the State Department of Highways and Public Transportation of
the street or streets described below:

to Pecan Avenue, a distance of approximately 1.2 miles.

proposed.work for finandll8 with said funds, the State Department of Highways awl Public
Transportation will:
1. Prepare construction plans awl specifications.
2. Provide for Reconstruction and Widening Grading, Structures and Surfacing at an
estimated cost of $185,000 as authorized in the 1983-1986 Urban Syatem Program.

Upon acceptance of the provisions of thia Order by the appropriate officials of the City
of Schertz, the Engiaeer-DLrector is directed to enter iato any necessary agreement. with
the Cit)' covering the detaU. of the proposed improvements, to proceed with the engineer-
ing development of the project aDd with construction in the most feasible andecoDOlllical
manner.
Thls Cb:der shall become operative upon acceptance by th8 Cit)' of Schertz awl if not accepte
within 90 days of the date hereof, the action herein contained shall be automatically can-

City of Schertz:
Provided the City will:
1. Furnish all required right of way clear of obstructions with acquisition proce-
dures to be in accordance with applicable Federal aod State laws governing the
acquisition policies for acquiring real property.
2. Provide for the adjustment of utilities as may be required.
3. }laintain all of the work constructed as part of the project and agree to regu-
late traffic and prevent encroachment on the right of way, all in accordance
with governing policies and regulations of the Department,
