1983R14- EASEMENTS FOR SEWER PURPOSES .' RESOLUTION NO. 83-R-14 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING AND DIRECTING THE INSTITUTION OF PROCEEDINGS IN EMINENT DOMAIN FOR THE PURPOSE OF ACQUIRING EASEMENTS FOR SEWER PURPOSES. * * * * * * * * * * * * * * * * * * * * WHEREAS, the City Council of the City of Schertz, Texas (the "City") has determined that it is necessary to construct a new sewer main to serve certain areas of the City not presently served by municipal sanitary sewer facilities; and WHEREAS, the City has been unable to secure necessary easements for sewer purposes on and across the landshereinafter described in this resolution; and WHEREAS, the City Council has determined that it is necessary to institute proceedings in eminent domain to acquire such needed easements; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS 1. That the City acquire by proceedings in eminent domain, sewer easements on and across the following de- scribed lands: PARCEL NO. 1 25 FOOT WIDE SANITARY SEWER EASEMENT EASEMENT DESCRIPTION for a 25 foot wide Sanitary Sewer Easement out of the John Saladin Survey No. 404, Abstract No. 299, Guadalupe County, Texas, and being 1.45 acre tract of land out of that certain 160.00 acre tract of land conveyed by Hilda Kreusler Gesche, et aI, to Evelyn Kramme Ripps, recorded in Volume 262, page 168 of the Deed Records of Guadalupe County, Texas; BEGINNING at a point on the South line of a 35.906 acre tract of land conveyed by Robert Dean to Dean Family Real Estate Partnership recorded in Volume 654, page 775 of the Deed Records of Guadalupe County, Texas, said point being North 60021'19" East, 284.00 feet from an iron pin and corner post for the South corner of said 35.906 acre tract and being the Southwest corner of the herein described easement; THENCE, with the South line of said 35.906 acre tract, North 60021'19" East, 25.79 feet to a point set for the Northwest corner of this easement; THENCE, leaving said South line of referenced 35.906 acre tract as follows: South 43052'16" East, 1.95 feet; thence, South 7011'45" East, 964.97 feet; thence, South 16003'15" West, 1182.82 feet; thence, South 28056'44" East, 384.68 feet to the North line of the Robert Martin and John T. Walker Survey No. 118, Abstract No. 245, said point being the Northeast corner of the herein described easement; THENCE, with the North line of said Robert Martin and John T. Walker Survey No. 118, South 61003'16" West, 25.00 feet to the Southeast corner of the herein described easement; said point being North 61003'16" East, 130.00 feet from the intersecting point of the Southwest corner of the John Saladin Survey No. 404 on the Northeast boundry line of the Torrebio Herrera League Survey No. 68; THENCE, leaving the North line of the referenced Robert Martin and John T. Walker Survey No. 118 as follows: North 28056'44" West, 395.04 feet; thence, North 16003'15" East, 1188.03 feet; thence, North 7011'45" West, 949.97 feet to the PLACE OF BEGINNING and containing 1.45 acres of land. . PARCEL 2 25 FOOT WIDE SANITARY SEWER EASEMENT EASEMENT DESCRIPTION for a 25 foot wide Sanitary Sewer Easement out of the John Saladin Survey No. 404, Abstract No. 299, Guadalupe County, Texas, and being 0.601 acre tract of land out of that certain 35.906 acre tract of land conveyed by Robert Dean to Dean Family Real Estate Partnership by deed recorded in Volume 654, page 775 of the Deed Records of Guadalupe County, Texas; BEGINNING at a point on the South right of way line of I.H. 35, said reference point being North 37040'52" East, 126.17 feet from a Texas Highway Department Concrete Monument, and also being North 37040'52" East, 39.96 feet from the original West corner of the above described 35.906 acre tract; THENCE, with the South line of LH. 35, North 37040'52" East, 25.28 feet to a point set for the Northwest corner of this easement; THENCE, leaving said right of way line, South 43052'16", 1047.29 feet to a point located in the North line of a 160 acre tract of land conveyed by Hilda Kreus1er Gesche to Evelyn Kramme Ripps by deed recorded in Volume 262 page 168 of the Deed Records of Guadalupe County, Texas, said point being the Northeast corner of the herein described easement; THENCE, with the North line of said 160.00 acre tract of land South 60021'19" West, 25.79 feet to the Southeast corner of this easement; THENCE, leaving said North line of the 160.00 acre tract, North 43052'16" West, 1037.24 feet, to the POINT OF BEGINNING and containing 0.601 acres of land. . , ) II. That the City Council hereby finds and determines that the acquisition of such easements will serve a valid and needed public purpose, to-wit the furnishing of sanitary sewer services to residents of the City. III. That the City Manager and City Attorney are hereby authorized and directed to institute proceedings in eminent domain and to carry such proceedings through to final disposition.
