A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AUTHORIZING THE PURCHASE OF LAND FOR
WATER PROJECT TANK.
WHEREAS, the City Council of the City of Schertz, Texas,
has determined that it is necessary to construct a new water
tank; and
WHEREAS, the City Council has determined that it is
necessary to acquire land to complete this water proj ect; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT the City Manager be directed and authorized to
negotiate the purchase of land from Ruth M. poirier as follows:
A 1.0 acre tract of land in the T. Herrera Survey No. 68,
Abstract No. 153 out of that certain 2.249 acre tract conveyed to
Edgar J. poirier and Ruth M. poirier by Robert C. Bueker and wife
Mary J. Bueker by assumption warranty deed recorded September 25,
1974 in Volume 491 page 179 deed records of Guadalupe County,
Texas and being part of that certain 12.37 acre tract conveyed to
F. Gutierrez by Robert Seiler Et Ux by deed dated April 10, 1946
recorded in Volume 216 page 183. deed records of Guadalupe
County, Texas and being more partiCUlarly described as follows:
BEGINNING at the East corner of the aforementioned 2.249 acre
tract said point being 1368 feet from the center line of F.M.
3009 for a point of reference; THENCE N 30 degrees 00' 00" W
393.80 feet to the point of beginning, being the East corner of
this 1.000 acre tract;
THENCE, cutting across the 2.249 acre tract S 69 degrees 13' 00"
W 135.66 feet to a point on the southwest line of the 2.249 acre
tract;
THENCE, with the Southwest line of the 2.249 acre tract N 30
degrees 00' 00" W 318.90 feet to the North corner of this 1.00
acre tract and the 2.249 acre tract;
THENCE, with the Northeast line of the 2.249 acre tract N 59
degrees 18' 00" E 135.64 feet to the northeast corner of this
1.000 acre tract and the 2.249 acre tract;

degrees 00 I 00" E 323.44 feet to the point of beginning and
containing 1.000 acres of land.

Edgar J. poirior and Ruth M. poirier from Robert C. Bueker and
wife Mary J. Bueker by assumption warranty Deed recorded
September 25, 1974 in Volume 491 Page 179, deed records of
Guadalupe County, Texas and being a 12 foot strip to be used by
the City of Schertz as an ingress/egress easement and being more
particularly described as follows:
BEGINNING at the South corner of the 2.249 acre tract said point
lying on the right-of-way line of Live Oak Road, a 55 foot right-
of-way, and being 1504 feet from the center line of F.M. 3009;
THENCE, leaving the right-of-way of Live Oak Road and following
the Southwest line of the 2.249 acre tract N 30 degrees 00' 00" W
397.85 feet to the South corner of the aforedescribed 1.000 acre
tract and the West corner of this tract;
THENCE, following the Southeast line of the 1.000 acre tract N 61
degrees 13' 00" E 12.00 feet to a corner;
THENCE, leaving the Southeast Property line of the 1.000 acre
tract and paralleling the Southwest line of the 2.249 acre tract
S 30 degrees 00' 00" E 397.85 feet to a point in the right-of-way
of Live Oak Road;
