The Schertz Board of Adjustment convened in a public hearing on November 25, 2002 at
6:30 p.m. in the Municipal Complex at Council Chambers, 1400 Schertz Parkway, Schertz,
Texas.

The meeting of November 25, 2002 was called to order at

Approval of Minutes:
There were none.
#3 Public Hearing: On a request from David Williams at 2821 Valencia Lane,
Greenshire Subdivision, for a special exception to the zoning ordinance for an additional curb
cut.
Mr. Youngblood stated there were 8 letters sent out:. Five were in favor and none were
opposed. At the time this home was built, they arranged the driveway to save 2 trees.
Usually second curb cuts are not approved, however staff supports this exception.
Mr. Sommers stated that this situation was a classic definition of what a hardship it is to
request a variance.
#4 Public Hearing: On a request from Edward Jones, 2616 Tree Crown, Woodland
Oaks Subdivision, for a special exception to the zoning ordinance to construct a patio cover.
Mr. Youngblood stated most homes are built without any protective covers over the back
patio area. There were 25 letters sent: five were in favor none were opposed. No utilities are
involved; staff recommends approval.
Mr. Sommers stated that it's not worthwhile to disapprove a 4-inch encroachment. Therefore
the Planning and Zoning Commission recommends approval.

#5 Consider And Take Appropriate Action: On the above request from David
Williams at 2821 Valencia Lane, for a curb cut. (BOA # 185-02)
Mr. Duigon asked if the new driveway would be used as an entrance and an exit. Mr.
Williams stated it would.
Mr. Duigon stated he would like it to reflect in the minutes that he recommends the new curb
cut should be used as an exit only. If it is used as an entrance, then the same line of sight
problem will remain.
Mr. Duigon moved to approve the request from Mr. Williams. Ms. Hill seconded the motion.
The motion carried.
#6 Consider And Take Appropriate Action: On the above request from Edward
Jones, at 2616 Tree Crown, for a patio cover. (BOA #186-02)
Ms. Hill asked if the pictures shown in the packet were inside the home. Mr. Jones stated
yes, this is a result of not having a cover from the rain over the patio door.
Ms. Hill moved to approve the request from Mr. Jones. Ms. Brown seconded the motion. A
vote was taken. The motion carried.
#7 Items by The Board and City Planner:
Mr. Youngblood stated that Mr. Potempa is at home recovering from surgery. Please keep
him in our prayers.
As of December 1, 2002, Amy Madison will be the new Community Development Director
over Economic Development, Inspections, and Planning & Zoning.
The city is currently working on the IH 35 and FM3009 intersection problem. A project is
being proposed to resolve this problem.
Mr. Duigon stated there are a large amount of cars being parked at the HEB parking lot
advertised for sale. This is causing a traffic problem on FM3009.
Mr. Youngblood stated that he has discussed this with the HEB manager. Additional signage
is being procured and enforced
December 10, 2002, The Planning and Zoning Commission will hold a Public Hearing in the
Community Center at 7:00 p.m. to change permissible use areas in our UDC for locating
Sexually Oriented Businesses.
Mr. Hartzog stated the next Board of Adjustment is set for December 16, 2002.
