PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a Joint Public Hearing on Tuesday, January 3, 1984 at 7:00 pr1 in the Municipal Complex Council Chambers, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Cam Beauchemin, Vice-Chairman Tom Yarling, Secretary f.1enlin Willman Ray Stanhope Lee Boswell Bob Andrews CITY COUNCIL Earl W. Krause, City Secretary #1 CALL TO ORDER Mayor Sawyer called the meeting to order at 7: 00 P.M. Mayor turned the meeting over to the P & Z Chairman, John Linebarger to conduct the Public Hearing. Chairman Linebarger advised all present of the rules for the Public Hearing. The purpose of the hearing was to receive input from the pUblic and the public would not be called upon when these items are considered by the Commission or Council after the public hearing. #2 SPECIAL PRESENTATION: Hayor Sawyer presented a certificate of appreciation to Clay McMahan for his services as a member and Secretary of the P & z Commission before the meeting officially opened. #3 PUBLIC HEARING: Zoning Change Number 45 Receive input from the public for rezoning of approximately 128 acres 'of land from Pre- Development (PD) to Single Family Dwelling Distr ict (R-l). The minutes for this public hearing is a duplication of the City Council Minutes. #4 PUBLIC HEARING: Zoning Change Number 48 Receive input from the public for rezoning of approximately 265 acres of land from Pre- Development (PD) to Industrail District (Light-l-I 1). . 1 e e e f . The minutes for this public hearing is a duplication of the City Council Hinutes. #5 PUBLIC HEARING: Zoning Change Number 49 Receive input from the public for rezoning request by George Barnard for approximately 3 acres of land from Apartment/Multi-Family Dwelling District (R-4) to General Business ( GB) . The minutes for this public hearing is a duplication of the City Council I1inutes. #6 PUBLIC HEARING: Zoning Change Number 50 Recei ve input from the public for rezoning request by Don Ryden representing the Larry Thomas Company for approximately 96 acres of land from Single Family Dwelling Distr ict (R-l) to Planned Unit Development (PUD). The minutes for this public hearing is a duplication of the City Council z.iinutes. #7 GENERAL DISCUSSION: There was none #8 ADJOURNMENT OF PUBLIC HEARING: Chairman Linebarger turned the meeting back over to the Mayor, who adjourned the public hearing at 9:00 pm. The Planning and Zoning Commission reconvened in a Special Ses- sion upon completion of the Joint Public Hearing in the Municipal Complex Conference Room. #1 CALL TO ORDER Chairman Linebarger called the meeting to order at 9:14 PM. #2 APPROVAL OF MINUTES: Regular Meeting December 13, 1983 Cam Beauchemin made a motion to accept minutes. The motion was seconded and the vote was unanimous in favor. #3 CONSIDER AND MAKE RECOMMENDATION: Zoning Change No. 45 There was some discussion on the letter from the Von Scheele Company, objecting to the R-l zoning for this property. Chairman Linebarger advised, that the Commission had made the decision to zone this area R-l, if Mr. Von Scheele wants a different zoning he should make application. 2 e Ray Stanhope made a motion to recommend approval of this zoning change. Cam Beauchemin seconded the motion which car r ied with the following vote: AYES: Members Linebarger, Beauchemin, Stanhope,Willman and Yarling. NAYS: None ABSTAIN: Members Boswell and Andrews #4 CONSIDER AND MAKE RECOMMENDATION: Zoning Change No. 48 Cam Beaushemin made a motion to recommend approval of this zoning change. Ray Stanhope seconded the motion was as follows: AYES: Members Linebarger, Beauchemin, Stanhope,Boswell, Willman and Yarling. NAYS: None ABSTAIN: Bob Andrews #5 CONSIDER AND MAKE RECOMMEIIDATION: Zoning Change No. 49 e There was a discussion on the building set back line for this project. It was agreed this would be handled during platting and Mr. Barnard would need to provide statement from adjoining prop- erty owners. The request for one on-site residential unit could be part of the zoning request as a Specific Use Permit. Ray Stanhope obj ected to the continuous change of zoning of this property. Ray Stanhope made a motion to table this request until the next P&Z meeting. Lee Boswell seconded and the vote was unanimous. #6 CONSIDER AND MAKE RECOMMENDATION: Zoning Change No. 50 There was a lengthly discussion on this project. The topics were centered around traffic on FM 3009, amount of additional run-off from the site and mixture ratio of the project. e Earl Hartzog advised the Commission that the staff has been and will continue to be in contact with the highway department about the expansion of FM 3009. The highway department has advised that the traffic count on FM 3009 at the present time does not warrant expansion of the road surface. Council has the staff working on the extension of Live Oak Road to IH-35. The on site retention pond will be required for anydevelopment on this site. FH 3009 obstructs the flood way and the natural drainage down stream connot handle the increased velocity. The developer will be held to his promise not to increase the run-off velocity or height from the site. The retention pond will be similar to the ones shown by the Department of Water Resources during their briefing in November. What should the mixture ratio be, present- 3 f' .. .. e ly the city has 1 large lot for every 12 smaller lots. Green- field has 38 large lots that have not been developed, which Larry Thomas pointed -out do not pay their share. The Commission's package has a number of letters on the market demand for large lots in our area. Chairman Linebarger advised the members he was well aware of the drainage problems in the area and the developer's project could only add to the problems. He asked the Commission to take a trip up to the area and look over the site to become familiar with the drainage problem. The increased density, would add additional streets, driveways and foundations to an area that already had a problem with run-off from this site. There was discussion on the letter sent to Council in May 1983 about the drainage and the need to stop development if some type of' action was not taken to clear the obstruction in the present system. The developer's proposal for detention ponds was one of the ways to solve the drainage problem. Lee Boswell advised the Commission that each item the citizens of Deerhaven mentioned needed to be covered. He felt the additional traffic on FM 3009 was the major complaint. Some type of assur- ance was needed from the highway department that this road would be expanded. It was noted that normally a couple of people would need to be killed on FM 3009 before any action would be taken by the highway department. e Ray Stanhope made a motion that the Commission recommendation to Council should be to deny the rezoning request. Cam Beauchemin seconded the motion which carried with the following vote: AYES: Members Linebarger, Beauchemin, Stanhope, Boswell and Andrews. NAYS: Members Willman and Yarling. Mr. Willman advised the other members that more time was needed to study and discuss each item before making a decision. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Zoning Change Request Northcliffe frontage from PD to R4,OP and NS This item was tabled since Mr. Hooker was not present. #8 GENERAL DISCUSSION: Earl Hartzog advised the Commission of Public Hearing scheduled for January 17, 1984 for the Chaparral Energy Corporation rezon- ing request. e 4 e e - J . . . Earl Hartzog ask the Commission to advise him on ,...hat to tell deelopers when they come in asking about PUD. What type of mixture ratio was needed in a PUD? -What size of homes do we. want? These items should be in the ordinance if we plan to restrict the size of homes. There was a discussion on the present zoning and the mixture ratios should be a part of the PUD. The Commission should also look at the size of homes in each district. Developers in the future should meet with the Commission, before presenting their rezoning request. Chairman Linebarger requested that traffic on FM 3009 and Busi- ness on FM 3009 be an agenda item for the next meeting. There should be some traffic counts on FM 3009 taken by the state. The Commission should meet with the highway department. #9 ADJOURNMENT: Chairman Linebarger adjourned the meeting at 10:00 PM. 5
