PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in a regular session on
Tuesday, November 27, 1984 in the Municipal Complex Conference Room) 1400
Live Oak Road. Members present were as follows:

#1. CALL TO ORDER

Chairman Linebarger called the meeting to order at 7:00 P.M.
#2. APPROVAL OF MINUTES: Regular Session November 13) 1984
It was noted Item #6 first variance should be amended to read: "variance on
length of cul-de-sac) with 100 foot paved turn radius with no parking on the
street". .
Ray Stanhope made a motion to approve minutes as amended. Bob Andrews seconded
the motion and the vote was unanimo~s in favor.
#3. CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Scenic Hills, Phase II) Unit I
Alan Lindskog from Dannenbaum Engineering presented the final plat to the
Commission. He also asked for a variance on the City Engineer's requirement of
200 foot radius on curve "f_y", "c_r" and ilk_nil. The Commission was advised
that the City had approved the curve radius on the preliminary plat and the
same radius is shown on the final plat. Mr. Lindskog also advised the Commis-
sion that the Texas Department of Highways and Public Transportation's "High-
way Design Division Operations Procedures Manual II the City Engineer is using is
different from the Subdivision Ordinance. He pointed out that the cover sheet
for the Manual states that:
"Thi s Manual establ i shes pol i ci es for operati ons and procedures for
preliminary project planning and development; geometric design; base
and pavement design; and preparing plans) specifications and estimates.
It is not designed as and does not establish legal standards for these
operations. The Manual is provided solely for use of the Texas Depart-
ment of Highways and Public Transportation."
Mr. Lindskog asked the Commission to grant a variance from this requirement
because he would lose a lot or two if this requirement was to be followed by
his firm.

Earl Hartzog advised the Commission that the requirements in the City Ordinances
are in conflict with State and Federal-requirements) and when this happens) the
most stringent or restrictive rules shall govern. Chairman Linebarger was pro-
vided copies of A Policy on Geometric Design of Highways and Streets 1984 by
the American Association of State Highway and Transportation Officials (AASHTO)
and Highway Design Division Operations and Procedures Manual 2-76. The Com-
mission was advised these are Federal and State design standards which estab-
lish criteria for roadway improvements, urban local. Both take precedence over
minimum requirements. ~
Chairman Linebarger advised those present that the following paragraph (on page
123) from Federal standards appears to be quite clear. The Commission does not
have the authoruty to grant the variance.
Whose responsibility is it to see that maximum safety is incorpo-
rated into our motor vehicle transportation system? On this, the
subcommittee is adamant. It is the responsibility of Government
and specifically those agencies that, by law, have been given that
mandate. This responsibility begins with the Congress and flows
through the Department of Transportation) its Federal Highway
Administration) the State Highway Departments and safety agencies,
and the street and highway units of counties) townships) cities
and towns. There is no retreating from this mandate, either in
letter or in spirit. .
It was noted the preliminary plat did not have the curb radius identified and
this item is not one of the items checked at that time. It was recommended the
final plat approval be tabled until the City Staff could advise the Commission
on the ruling by the City Engineer and City Attorney, plus input from the Police
and Fire Departments on this matter~ Merwin Willman made the motion as stated
above and James Harden seconded the motion. The vote was unanimous in favor.
The City Staff was instructed to place this item on the agenda for the next
meeting.
#4.
CONSIDER AND TAKE APPROPRIATE ACTION: Zoning Classification on area identified
as Predevelopment District on Zoning Map
Earl Hartzog advised the Commission that this item was placed on the agenda
because two different developers had been in contact last week about presenting
their proposal to the Commission. Since neither developer was present) the Staff
recommended this item be skipped unless the Commission desired to make some
recommended zoning changes.
There were no recommendations from the Commission.
#5. CONSIDER AND TAKE APPROPRIATE ACTION: Variance Seventh Day Adventist
Earl Hartzog gave the Commission a letter from Harold Bradbury, Builder - Texas
Conference of Seventh-Day Adventists. The letter was asking for some exceptions
to keep the building cost down on the project. The Commission was advised the
the Staff had not completed the study on this request and some changes could be
made) and the development would be in accordance with the Subdivision Ordinance.

The Commission agreed if any variance were required for this project, City
Council should be the party tasked with making the decision.
#6. CONSIDER AND MAKE RECOMMENDATION:'
A. Special Overlay District FM 3009
Earl Hartzog advised the Commission this Item was on the agenda based on the
request by the Commission at previous meetings. The City Staff had not-suf-
ficient time to make the changes as discussed at a previous meeting. There
was a brief discussion by the Commission on the use and restriction in the
Special Overlay District.
B. Special Overlay District AICUZ
Earl Hartzog advised the Commission that the Staff recommended the AICUZ be
added as an Overlay District. The Commission was presented a copy of the
proposed change. It was agreed the wording should be changed to reflect the
most recent study by Randolph.
#7. CONSIDER AND MAKE RECOMMENDATION:
A. Subdivision Ordinance Review
The Commission completed the review of the Subdivision Ordinance. It was agreed
the Staff needed to make approptfate changes to Section 18 and the Commission
should go over this part at the next meeting.
B. Zoning Ordinance Review

It was noted the Commission needed to get going on the review of this Ordinance.
Merwin Willman was to consolidate a list and separate committees would be
~stablished to work on each section.

#8. GENERAL DISCUSSION
Earl Hartzog advised the Commission of the scheduled public hearing for December 4.
It was noted the TV dish ordinance change has not been added to the ordinance and
the Commission has not been provided copies. Need to establish restrictions on
these on top of buildings.
Earl Hartzog advised the Commission on the status of Crime Watch and second' curb
cut for 429 Sharon Court.
Councilman Greenwald passed out copies of the Council Bellringer and .minutes.
It was agreed the Secretary would control the flow of this information.
There was some discussion on the enforcement of the Sign Ordinance - flashing
lights again on, Main and FM 78.
There was discussion on the fences in the drainage right-of-way along the
Southerly side of Val Verde Subdivision. It was asked for Staff,to provide
status on this item at the next meeting.
