PLANNING AND ZONING MINUTES

The Planning and Zoning Commission of the City of Schertz convened in
Regular Session on Tuesday, July 10, 1979, at 7:00 PM in the Municipal
Complex Council Chambers, 1400 Live Oak Road. The following members
were present:

#1 JOINT PUBLIC HEARING

The Joint Public Hearing of the Planning and Zoning Commission and the
City Council was called to order by Mayor Pro Tem Earl Sawyer at 7:00
PM. The Joint Public Hearing was held to receive the views of the
Citizens on the Proposed Zoning Ordinance and the Proposed District
Zoning Map. Mr. Sharp excused himself from participation as a member
of the Commission owing to conflict of interest. The following persons
identified themselves and asked to speak to the Planning and Zoning
Commission and the City Council:

Mesrs. Mansfield, Grainger, Froboese, Morris, and Mrs. Covert objected
to the proposed General Business zone alongF113009. Mr. Taylor, who
identified himself as speaking on behalf of Good Shepherd Church, ob-
jected to the proposed Gen~L~lBusiness zone on either side of Live Oak
Road, and he requested that the proposed zoning be changed from General
Business to Office and Professional. Mr. Harden objected to the pro-
posed General Business and Residential zones on the south side of IH 35,
and to the present MObile Home zone. Mr. Harden stated that, owing to
the lack of services to the area, no zoning other than Pre-Development

would be appropriate. Mr. Klabunde objected to the proposed re-zoning
of his property from Pre-Development to Industrial, and, subsequently
requested to meet with Mayor Bueker on Saturday, July 14. The Mayor
agreed to meet with Mr. Klabunde at Mr. Klabunde's convenience. Mr.
Chambless urged the Commission and the Council to be equitable and
fair with the zoning proposals. Mr. McCabe asked specific questions
about the Proposed Zoning Map, for purposes of clarification. Mr.
Holman urged the Commission and the Council to neither over-zone nor
under-zone. After hearing the view of all the Citizens who asked to
speak to the Commission and the Council, Mayor Bueker adjourned the
Joint Public Hearing at 8:20 PM.

CALL TO ORDER
Chairman Aguilar called to order the Regular Session of the Planning
and Zoning Commission at 8:30 PM.

Mr. Linebarger moved to accept the minutes as read. The motion was
seconded by Mr. Sharp. The motion carried unanimously.

RECOMMENDATION TO CITY COUNCIL
Mr. Linebarger moved that the Planning and Zoning Commission defer any
recommendation to the City Council regarding the Proposed Zoning Ord-
inance and the Proposed District Zoning Map until the Commission can
review objections registered by the Citizens and receive City Staff
recommendations. Mr. Linebarger further moved that the Planning and
Zoning Commission meet in Special Session on Wednesday, July 18, 1979,
at 7:00 PM. Mrs. Lawler seconded the motion. The motion carried, with
Mr. Sharp abstaining.

PC-25 NORTHCLIFFE EAST COMMUNITY, SECTION 3
The plat of Northcliffe East Community, Section 3, was submitted for
preliminary and final approval. Lots 23-25, Block 20; Lots 24-37, Block
19; and Lots 2-16, Block 24, were found to be of substandard size. Mr.
Fenton explained to the Commission the course of events leading to the
submission of the plat, and he further explained the rationale behind
the substandard lots. Chairman Aguilar stated that the preliminary
plat had been rejected during a meeting of the Planning and Zoning
Commission on August B, 1978; however, apparently the Commission's
disapproval had not been communicated to the appropriate person within
the Homecraft organization, and so.it was, he stated, that the final
plat was submitted without knowledge of the Commission's prior dis-
approval.
Owing to.the unfortunatecourse,of events, Mr. Linebarger suggested a
compromise.--Mr. Linebarger moved that the Commission disallow Lots 2-16,
Block 24, but accept Lots 23-25, Block 20, and Lots 24-37, Block 19; final
approval of the plat would not be granted until Lots 2-16, Block 24, have
been re-drawn and conform to the standard lot size. Mr. Greenwald seconded
the motion. The motion carried unanimously.

Mr. Heinen stated that the plat of Northcliffe East Community, Section 3,
could be redrawn and submitted to the Commission at the scheduled Special
Session on Wednesday, July 18, 1979, and so he shall attempt.
#6 PC-9 HORSESHOE OAKS
The plat of Horseshoe Oaks subdivision was submitted for final approval.
Mr. Graham stated to the Commission that the subdivision meets require-
ments of the City of Schertz Subdivision Ordinance, and therefore, recom-
mended approval. Mr. Greenwald moved that the Commission approve the plat
of Horseshoe Oaks. Mr. Stanhope seconded the motion. The motion carried
unanimously.
