' .... -A - ~e ~e ", PLANNING AND ZONING MINUTES The Planning and Zoning Commission and the Schertz City Council convened in a Joint Public Hearing on Tuesday, March 2, 1982, at 7:00 PM, in the Council Chambers at the Municipal Complex, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Kenneth Greenwald, Vice-Chairman Clay McMahan, Secretary Merwi n Will ma n William Courtney Lee Boswell Ray Stanhope CITY COUNCIL Mayor Jack Stomackin Richard Howe Barbara Taylor Earl Sawyer Jackie Lawler CITY STAFF Jimmy G. Gilmore, City Manager June Krause, City Secretary Tom Brooks, Assistant City Manager #1 CALL TO ORDER Mayor Stomackin called the Meeting and Public Hearing to order at 7:00 PM, and turned the Public Hearing over to Clay McMahan, Secretary of the Plan- ning and Zoning Commission. #2 PUBLIC HEARING Secretary McMahan advised the audience and the members of the hearing that the purpose of the Public Hearing was to consider a request submitted by Dr. Kermit Harborth to rezone approximately eleven {ll) acres of land from R-l, Single-Family Residential District to OP, Office and Professional District. Secretary McMahan then asked if there were any comments from the audience that offered objections to the request for rezoning. Mr. Spurkowsky and Mr. Stewart, residents of Oak Forest, offered the comments opposing the rezoning. Their main concern was that the rezoning would provide the opportunity for certain types of businesses to build close to their property, that increased crime would be the result in that area, and that additional drainage problems would be created. About this time of the meeting, Chairman Linebarger and Vice-Chairman Greenwald joined the meeting and Chairman Linebarger presided over the remainder of the meeting. One of the Oak Forest residents asked what types of businesses are authorized in OP zoning and Tom Brooks advised the audience about some of the authorizati6ns. He also advised that apartments and certain types of businesses are not automatically authorized but must be approved by Specific Use. ~~ e e e P&Z MINUTES, dated: 3-2-82, pg. 2 (Joint Public Hearing) Dr. Harborth addressed the audience and advised that he could not at this time state specifically what would be built on his property, but he believed the businesses would be well received by the community. He also advised that any constructi~n on his property would probably benefit the drainage problem in Oak Forest. P&Z m~mber, Bill Courtney, advised the audience that he lives in Oak Forest and that he fully supports the rezoning request and that he believes that Office and Professional development along FM 3009 are the types that are desired and that it would benefit, rather than be a detriment to Oak Forest residents. Dr. Harborth further advised that' he plans to build his own home behind the OP zoning and that he would not do so if he did not feel that the OP businesses would be respectable. #3 GENERAL DISCUSSION Chairman Linebarger reminded the audience that this hearing would be the last opportunity for persons to be heard on this issue and that the Com- mission would submit their recommendation to the City Council within ten (10) days. He further advised that at the conclusion of this meeting, the P&Z would reconvene in a Special Session in the Conference Room across from the Council Chambers. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Kenneth Greenwald, Vice-Chairman Clay McMahan, Secretary Me rw i n Will ma n Wi 11 i am Courtney Lee Boswell Ray Stanhope CITY STAFF Tom Brooks, Assistant City Manager #1 CALL TO ORDER Chairman Linebarger reconvened the meeting at 7:35 P~. #2 CONSIDER AND MAKE RECOMMENDATION, IF APPROPRIATE, TO THE CITY COUNCIL ON A REQUEST FOR REZONING SUBMITTED BY DR. KERMIT G. HARBORTH, WHICH WAS DISCUSSED IN PUBLIC HEARING Chairman Linebarger reminded the Commission Members that they have ten (10) days to submit a recommendation to the City Council, but they may make their recommendation at this meeting if they desire. He also advised the members that Dr. Harborth had previously appeared before the Commission requesting rezoning to General Business, but that the Commission had recommended to him that Office and Professional Zon- ing would be more appropriate and more acceptable. The Commission Members discussed the comments that were made in the Public Hearing and the consensus was that the opposition comments were not sufficient to warrant a disapproval recommendation by the Commission. Each member also stated that a vote on the proposed rezoning should be taken at this meeting. Bill Courtney stated that since he is a resident of Oak Forest, he wanted to "Bite the Bullet" and make a motion that the request for rezoning submitted by Dr. Harborth be submitted to the City Council recommending approval.
