06-30-1981 e e e ~ PLANNING AND ZONING MINUTES The Planning and Zoning Commission and City Counci.l of the City of Schertz convened in Special Session, Tuesday, June 30,1981, at 7:00 PM, in the Municipal Complex Council Chambers, 1400 Live Oak Road, to conduct a Public Zoning Hearing. Members present were as follows: CITY COUNCIL Jack Stomackin, Mayor Earl Sawyer 'Jeff Duffield, Mayor Pro Tern Jacqueline Lawler Barbara Taylor PLANNING AND ZONING COMMISSION John Linebarger, Chairman Merwin Willman, Vice-Chairman Kenneth Greenwald, Secretary Raymond Stanhope Lee Boswell CITY STAFF Jimmy G. Gilmore, City Manager June G. Krause, City Secretary Tommy Brooks, Administrative Assistant #1 CALL TO ORDER Mayor Stomackin called the meeting to order at 7:00 PM. #2 JOINT PUBLIC ZONING HEARING Mayor Stomackin turned the meeting over to the Planning and Zoning Chair- man, Mr. John Linebarger. Mr. Linebarger requested Mr. Brooks show a map of the proposed area being discussed to those persons having interest in the proposed development by Mr. Odo J. Riedel. Mr. Riedel made a presentation about his proposed de- velopment which would consist of eleven (ll) buildings of one-story con- struction and consisting of forty-three (43) units total, with each unit consisting of 460 to 480 square feet. Chairman Linebarger then called for comments from anyone having opposition to the Rezoning Request. Mr. Rick Troberman spoke in opposition of the rezoning request. He questioned why the rezoning was being considered at all since it had been previously con- sidered, and denied, on several occasions. He further stated that he was not opposed to apartments but he thought the area in question should be for business and not for apartments. He also stated that the Planning and Zoning Commission should be looking more toward the future in its planning. Mr. Baughman then spoke in opposition. He stated that the rezoning to R-4 would establish a. precedent for that area in general that would possibly result in the entire area being inundated with apartments. He also expressed concern for children's safety as a result of the traffic. ~ e e e P&Z Minutes (6-30-81) pg. 2 Mr. John Gardner also spoke in opposition. He stated that he did not live within two hundred feet of the property in question but he did live close enough to be affected. He expressed concern that apartments would change the structure of the quiet residential area as it exists and that apartments would have an adverse effect on the property owners in the immediate area. He also expressed his concern that he did not believe the City cap effec- tively enforce the ordinances presently in existence so how could the City expect to enforce restrictions about the apartments. . #4 ADJOURNMENT There was no further discussion and the Public Hearing was adjourned by Mayor Stomackin at 7:25 PM. #5 CALL TO ORDER Chairman Linebarger reconvened the Planning and Zoning Commission at 7:30 PM, in the Conference Room of the Municipal Complex. #6 READING OF MINUTES - June 23,1981, Regular Meeting Ray Stanhope made a motion the minutes be accepted as written. Lee Boswell seconded and the vote was unanimous in favor of. #7 CONSIDERATION OF REZONING REQUEST Mr. Stanhope made a motion to meet in Special~Session at 7:00.P~1 on Tuesday, July 7, 1981, for the purpose of final consideration and recommendation to the City Council on the rezoning request of Mr. Odo J. Riedel. Mr. Green- wald seconded and the vote was unanimous in favor of. #8 ADJOURNMENT There was no. furter discussion and Chairman Linebarger adjourned the meeting at 7:45 PM.
