PLANNING AND ZONING MINUTES
The Planning and Zoning Commission of the City of Schertz convened in
Special Session on Tuesday, July 7, 1981, at 7:00' PM, in the Municipal
Conference Room, 1400 Live Oak Road. The following members were present:

#1 CALL TO ORDER
Chairman Linebarger called the meeting to order at 7:00 PM.

#2 READING OF MINUTES: June 30,1981, Joint Public Zoning Hearing and
Special Session
Ray Stanhope made a motion to accept the minutes as written. Merwin
Willman seconded and the vote was unanimous in favor of.
#3 FINAL CONSIDERATION AND RECOMMENDATION TO CITY COUNCIL ON REZONING REQUEST
OF MR. ODO RIEDEL
Chairman Linebarger opened the meeting to comments by the Commission Members.
lee Boswell stated he favored the growth of Schertz and thought that apart-
ments would help the CitY.', He stated his belief that apartments are needed
due to the high cost of housing.
Ken Greenwald stated he was against the rezoning to permit apartments because
it would create increased traffic next to the elementary school and because
the adjoining neighbors of the property in question are opposed to the apart-
ments and that there is an excess of apartments in that area of the town.
Merwin Willman stated that he was not opposed to the apartments but believed
there should be some specifications, such as a road through the property that
would connect Pfeil Street and live Oak Road, be specifically attached to
the rezoning request. He further stated he was not in favor of a Specific
Use Permit for the apartments, he just believed there should be some specific
recommendations attached to the rezoning request to insure that the apartments
would be in conformance with the plans that have been discussed. He also
believed that the rear yard setback and off street parking required further
verification.

Ray Stanhope questioned whether or not a precedent would be established if
the rezoning was approved that would encourage additional apartments in the
acreage near the property in question.
Chairman Linebarger stated that the Commissian had three options available
to them. They were:
1. Approve the rezoning as requested,
2. Disapprove the rezoning request,
3. Submit an alternate recommendation based on R-4
Zoning that would be more advantageous to that
area of town.
Chairman Linebarger called for a motion. Lee Boswell made a motion to rezone
the property in question from R-2 to R-4. Merwin Willman seconded the motion.
The vote was as follows:

Chairman Linebarger broke the tie vote by voting against the motion to rezone
from R-2 to R-4. Therefore, the recommendation to the City Council by the
Planning and Zoning Commission is:

The Planning and Zoning Commission, by a vote of two for and
three against, recommends disapproval of the rezoning request
of Mr. Odo J. Riedel to change from R-2, Single-Family Dwell-
ing District, to R-4, Apartment/Multi-Family Dwelling District,
of the first 508 feet from Pfeil Street out of G. Malpaz Survey
67 and out of Koch Addition, Lots 13-16, Block 6.
#4.. GENERAL DISCUSSION
Chairman Linebarger asked Mr. Riedel if he had any comments he would like to
make.
Mr. Riedel gave a short briefing about the proposed apartment project. He
advised that a thru street would' not be advisable because it could not be
controlled for the traffic and that it would become a race track. He further
stated that the "Circle R" Corporation was going to invest in the project for
the good of the City. He further stated that if the City Council disapproved
his request for rezoning, then he was going to turn the land into farm land
and plow it with a jackass if he had to. He further stated that he would
not be concerned about the loss of income if his rezoning request is dis-
approved because 70% of his income is derived from outside of Schertz any-
way. He also stated that he had always tried to do what he thought was best
for the City of Schertz.
Chairman Linebarger and Ray Stanhope expressed their appreciation to Mr.
Riedel for many good things that he has done for the City.

#5 STAFF BRIEFING
Mr. Brooks advised the Commission that several developers have displayed
interest in home development in the City but that it is all in the plan-
ning stages at this time. He also advised that the City Staff is consid-
ering ways to ex"tend water and sewer lines that would benefit industrial
development in the City.

Chairman Linebarger adjourned the meeting at 8:50 PM.
