PLANNING AND ZONING MINUTES
The Planning and Zoning Commission of the City of Schertz convened in
Regular Session on Tuesday, July 28, 1981, at 7:00 PM in the Municipal
Conference Room, 1400 Live Oak Road. The following members were present:

#1 CALL TO ORDER
Chairman Linebarger called the meeting to order at 7:00 PM.
#2 READING OF MINUTES: Joint Public Zoning Hearing and Special Session,
July 21, 1981

Ray Stanhope made a motion to accept the minutes as written. Merwin
Will man seconded the moti on and the vote was unanimous in favor.
#3 Chairman Linebarger rearranged the Agenda and Agenda Items #4 and #5
were considered prior to Agenda Item #3.
#4 CONSIDERATION OF CURB-CUTTING REQUEST: Submitted by Mr. Chester Miller
Mr. and Mrs. Miller were present for the consideration. The application
for the curb-cut was discussed and the map and diagram was reviewed.
Mr. Willman made a motion to recommend approval of the request to the
City Council. Mr. Stanhope seconded the motion and the vote was un-
animous in favor.
#5 PRELIMINARY CONSIDERATION ON HEIMER-PREUSSER REQUEST FOR A TWO HUNDRED
ACRE PLANNED RESIDENTIAL UNIT DEVELOPMENT

Preliminary discussion indicated a consensus of opinion by the Commission
Members that there was a good mix of districts within the PRUD. The ar-
chitect for the developer suggested that the !'green area" along Dietz
Creek would possibly be donated to the City for maintenance. Chairman
Linebarger stated that the Commission was unable to accept that recommen-
dation, that the City would have to make that determination at a later
date as to whether or not it wanted to accept that area for maintenance.
Chairman Linebarger also expressed his concern that there would possibly
be unequal distribution of the various types of dwellings within the PRUD
and he advised the developer to submit an acceptable percent of mixture
of the various types of dwellings to the Planning Commission in the form
of a Master Plan. Mr. Willman made a motion to approve the preliminary

concept of the PRUD with the stipulation that the developer add to
his Master Plan the percentage of mixed dwellings, apartments, garden
homes, condominiums, and single-family dwellings. Mr. Greenwald
seconded the motion and the vote was unanimous in favor.
#6 FINAL CONSIDERATION AND RECOMMENDATION TO REZONING REQUEST OF MR. LESLIE,
DAVID, AND STEPHAN BAKER

Chairman Linebarger advised that he had driven over the property being
considered and he thought that ten or eleven acres of the land could be
properly developed and that he saw no reason why not to zone the entire
tract of land as General Business. He also stated that one of the Baker
brothers had indicated the possibility of donating a portion of the re-
maining property that is in the flood zone area to the City at a later
date and that he believed that statement should be included in the recom-
mendation to the City Council. Mr. Stanhope stated that he h~d no objec-
tions to the ten or eleven acres being zoned General Business, but he ob-
jected to the remaining acreage being zoned General Business. Mr. Green-
wald made the following motion: Recommend approval to the City Council
that 54.25 acres out of the Ma1paz Survey, located along FM 1518, being
in the general location across from the Schertz City Park and presently
zoned Pre-Development, be rezoned to General Business, and acknowledging
the statement made at the Public Zoning Hearing on July 21,1981, by Mr.
Baker that a portion of the acreage would possibly be donated to the City
of Schertz at some future date. Mr. Willman seconded the motion. The
vote was three in favor for the motion and one opposed. Therefore, the
motion as approved. The vote is recorded as follows:

#7 STAFF BRIEFING
Mr. Brooks advised that he has received an additional subdivision request
to establish "Lost Meadows, Unit #4", and provided copies of the plats
for the Commission to review. Mr. Ed Ford, the City Engineer, advised
that he had reviewed the plats and had no objections. The consensus of
opinion of the Commission was in favor of the request and that it would
be approved as an Agenda Item on the next scheduled Planning and Zoning
Commission meeting.
#8 GENERAL DISCUSSION

Chairman Linebarger stated that he wanted to include in the minutes the
appreciation of the Planning and Zoning Commission toward Mr. Brooks
for his expertise, professionalism, and exceptional contributions to the
Planning and Zoning Commission. He further commented that the City
Manager had made a wise selection in his selection of Mr. Brooks for his
position.

meeting at 8:45 PM.
