03-08-1983 '{~- 'l e e e PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in Regular Session on Tuesday, March 8, 1983, at 7:00 PM, in the Conference Room of the Municipal Complex, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Ken Greenwald, Vice-Chairman Clay McMahan, Secretary Merwi n Willman Ray Stanhope Lee Boswell MEMBERS ABSENT Cam Beauchemin CITY STAFF Earl Hartzog, Planning and Zoning Coordinator OTHERS PRESENT Coy Simmons #1 CALL TO ORDER Chairman Linebarger called the meeting to order at 7:00 Pf1. #2 READING OF MINUTES: Regular Meeting February 22, 1983 Mr.Willman corrected Item 16, Paragraph 3, to read: August 31, 1981 versus 1982. Ray Stanhope made motion to accept minutes, as corrected, Lee Boswell second the motion and vote was unanimous in favor. #3 CONSIDERATION AND TAKE APPROPRIATE ACTION: Preliminary Plat Oak Forest, Unit IV Mr. Coy Simmons advised the Commission he no longer plans to develop Oak Forest, Unit IV, as shown on plats provided. LOCATION: Front of Oak Forest Subdivision along FM 3009. Appears the cost to modify the floodway to per.mit encroachment of the Flood Plain would be to costly. Mr. Simmons asked for an alternate approval for Garden Homes in this area outside the flood plain. Chairman Linebarger explained proper procedure for submitting proposal for Garden Homes to the City and that City Engineer would have to review and submit recom- mendation to Planning and Zoning Commission. e e e - .-.--" -........... "" - --, . nUL- '- .. f' #4 CONSIDERATION AND TAKE APPROPRIATE ACTION: Final Plat Greenfield, Unit IIA The Commission was provided a copy of City Engineers letter approving Greenfield, Unit IIA, as built. LOCATION: Gardeo Homes in Greenfield Subdivision along FM 3009. After a discussion on whether this project as already past the final approval or not, Ray Stanhope motioned to confirm our intent to approve the final plat on Greenfield, Unit IIA. Ken Greenwald second and vote as unanimous. #5 ANIMAL CONTROL ORDINANCE REVIEW: Review Animal Control Ordinance to determine changes required Each member was provided a copy of the Animal Control Ordinance and Mr. Willmans' letter recommending changes to the existing ordinance. There were some difficulties in lining up the revisions to ~he original ordi- nance. After a lengthy discussion, it was determined the review or update of the Animal Control Ordinance was outside the Commission responsibilities. It was determined a change in the ordinance was necessary to prevent the type of development proposed by Mr. Ruebsahm a couple of months ago. Mr. Ruebsahm had plans to subdivide an area within the city limits into large acreage tracts and use livestock to control the grass. Ray Stanhope made a motion to recommend to Council that the Animal Control Ordinance be revised to include the following: a. No fowl, other small animals as defined in Article III of Ordinance No. 74-H-7 or livestock, will be kept or raised within the city limits. b. Citizens with fowl, other small animals or livestock, within the city limits, will dispose of such within 6 months from the date of this ordinance change. The only exception will be farmers or ranchers with fowl or live- stock. c. A special permit will be required to raise fowl, other small animals or livestock with the city. The motion was second and the vote was unanimous in favor. #6 REVIEW AND TAKE APPROPRIATE ACTION: ,General Business Zoning along FM 3009 . from FM 78 to IH 35 Mr. Willman presented the Commission with his findings from his research of Zoning Meetings held in 1979 when the new Zoning Map was proposed. Chair- man Linebarger had a copy of the proposed zoning map of 1979 and the minutes of those meetings, were reviewed by the Commission. After a lengthy disc- cusion, it was determined the area in question was not zoned General Business in 1979. It was determined the next time a Public Hearing is required for zoning, this area should be included. --7 -...--. - - --, ..._.... _ tit #7 CONSIDER AND TAKE APPROPRIATE ACTION: Variance from Schaefer Homes number of apartments per acre The Commission was advised that Schaefer Homes was trying to arrange financing for an apartment complex across the street from the high school in the area zoned R-4. They have asked for a variance to in- crease apartments per acre from 24 to 25. Ray Stanhope motion to grant variance, Ken Greenwald second and vote was unanimous in favor. #8 CONSIDER AND TAKE APPROPRIATE ACTION: Greenfield III Street Names The Engineer for Greenfield Unit III, submitted "JIM BRADY" and "Ell WHITNEY" as the proposed names to the two cul-de-sac in thi s project. It was agreed these streets should be addressed as "COURTS". There was a discussion over the Jim Brady, assuming the name is that of James Brady, President Reagan's Press Secretary. The Commission reconized Jim Brady, however" consistant with pol icy of not recom- mended to naming streets after living persons. Appears the trend has been to name streets after inventors; Cyrus McCormick was recom- mended or a former Mayor of the City. Ken Greenwald made the motion that we accept Eli Whitney and advise them of our disapproval of Jim Brady. Ray Stanhope second the motion and all agreed. #9 GENERAL DISCUSSION e Earl Hartzog told the Commission about a p.lanned 42 acre Mobile Home Park south of FM 78, between Lone Oak Subdivision and Dietz Creek, back to Cibolo Creek. Chairman Linebarger felt there would be a lot of opposition to a zoning change from homeowners in Lone Oak on this planned development. The individual should be advised of these con- ditions before the prope~ty is purchased. The Commission was advised that a Mr. Grisham plans to attend the City Council Workshop tomorrow night to give a presentation on a Planned Mobile Home Park along FM 3009. Chairman Linebarger advised that a zoning change will be required and a decision from the Commission is not necessary the night of the Public Hearing. There was a discussion about a development by Doug Wise of 229 acres on the other side of the Cibolo within the City limits. This area is zoned Pre-Development District and zoning has not been changed to Residential Units. This development has been titled a "Single Entity Private Residential Unit Development", which a zoning classification within the City is not available. Appears this is a means to avoid the cost of streets, water lines, fire hydrants and other city requirements. The flood map does not show this area, but it appears this area is in the flood plain. The Commission has been concerned about development in this area and are willing to work with the Developer, but the project must comply with the city ordinance. e ----- --"-""- ..-............-, ...'............. - - --, I"\.A~ , ~ e Mr. Willman advised the Commission that the City Plan was accepted by Council. He reminded them of the requirement to review the Plan each November and required ordinance review. It was suggested a schedule be establ i shed. The Commi ssion was advi sed about the areas to be annexed and the time schedule. #10 Chairman Linebarger adjourned the meeting at 9:25 PM. e e
