PLANNING AND ZONING MIMUTES
The Schertz Planning and Zoning Commission convened in Regular Session
on Tuesday, June 14, 1983 at 7:00 PM, in the Conference Room of the
Municipal Complex, 1400 Live Oak Road. Members present were as follows:

Merwin Willman made motion to accept minutes, Ray Stanhope second the
motion and vote was unanimous in favor.

Oak Run Unit #1

The Commission considered the Final Plat for Oak Run Unit #1. Location
along Green Valley Road between Dietz Creek and another drainage to the
east; seventeen lots planned. The City Engineer had approved construction
plans. Mr. Heimer was advised: Deed Restriction must inform owner of
drainage easement and prohibit fencing, permanent structures, parking of
vehicles, or any other encroachment that could reduce the flood carrying
capacity and increase flood hazards in area beyond the encroachment
itsel f.

Restriction should identify owners responsibility to maintain the area
in a park like condition, mowing, removal of debris and underbrush from
this area.
The street name "Summit" \'/ould also need to be changed and Commission
would have to agree. The approved varianceo.n Lot 16 frontage was also
discussed.
Ray Stanhope made motion to approve Final Plat, consistant with deed
restriction be provided and approved by the City. Cam Beauchemin
seconded and vote was unanimous in favor.
Mr. Heimer was advised the Final Plat would not be signed until after
construction was completed and approved, or the required bond was posted.

#4 CONSIDER AND TAKE APPROPRIATE ACTION: Northcliffe East Community
Variance on Lot Size and
Building Size
Ray Wiltshire from US Homes presented slides of the trip to Tuscon,
inorder to give the rest of the Commission an idea of the building lay-
out on these proposed smaller lots. This variance was to build on lot
size 37 by 90; with all utilities in front and zero lot line with 6 foot
side yard. After a quite lengthy discussion on 3 and 4 bedroom plans,
Ray Stanhope made a motion to grant variance on lnt size and building
size for Phase 1. approximately 90 units and does not bind City to
future variance approvals. Merwin Willman seconded, vote was Ken Greenwald,
Ray Stanhope, Merwin ~Jillman, and Clay Hd.1ahan for and Cam Beauchemin
against; motion passed. US Homes Representatives were advised their
Proposed First Phase is partly in Cibolo ETJ and they should change the
location or get Ctbolo approval also.
#5 CONSIDER AND TAKE APPROPRIATE ACTION: Schertz-Hoffman Commercial Park
Preliminary Plat
Lot Variance
Don Decker presented a Preliminary Plat on the Planned Commercial
Park. The variance which were previously approved were reviewed. Location
along Farm to Market Road 1518 on east side just north of the City Animal
Shelter. Site will back up to the Parkland Subdivision along the City's
20" water main from Universal City. Cam motioned to accept Preliminary
Plat and Lot Variance with copy of Plat attached. Ken seconded and vote
was unanimous in favor.
#6 CONSIDER AND TAKE APPROPRIATE ACTION: Drainage Study
The Commission has discussed the drainage problem related to development
taking place for a number of meetings. A letter was prepared to send to
City Council recommending action to be taken.

The contents of the letter was discussed and it was agreed by the Com-
mission that development will have to be curtailed until solved. The
Commission unanimously agreed to the content of the drainage letter
(copy attached) and shoul d be forwarded to Council.
#7 CONSIDER AND TAKE APPROPRIATE ACTION: Business Permit Study
The Commission was advised that Don Brodeur from the Inspection Depart-
ment had researched this area and it was recommended the Business Permit
should be dropped. Windcrest is the only City in the Area that requires
these permits; and checking with TML and they recommended we forget about
the idea. The only business that affect public health (bars, restaurants,
etc.) are required to be licensed and we could be opening ourselves up to
a law suit if we required and charged for a license. After a short dis-
cussion, the Commission asked the Staff to do some more research, look at
Certificate of Occupaney and provide information.

#8 CONSIDER AND TAKE APPROPRIATE ACTION: Subdivision Ordinance Review
Mr. Willman advised the Commission to table this item inorder to allow a
little more time to consolidate the present and proposed changes recom-
mended by TML and City Staff. Everything should be ready by the next
meeting to start a page by page review. Item Tabled.
#9 GENERAL DISCUSSION

Earl Hartzog advised the Commission Dorothy Hopkins was back and wanted
to put 2 Mobile Homes on one lot in Freeway Manor. The Members felt
this item was already covered by the Commission, but a review of the
minutes from March 22, 1983, indicated final action may of not been
taken on this matter. John Linebarger recommended we put this item
back on the Agenda and take appropriate action.
40 MPH Speed Limit on Elbel Road was discussed and Commission advised
this change would not take place.
Commission was advised of Mr. Riedel"s plan to put an apartment complex
behind the cemetery, next to his Mobile Home Park. Commission was
advised this area was in the flood plain and request should be disapproved
until action was taken to raise the area out of the Flood Plain and
channel the south drainage ditch to off-set the encroachment.
Earl Hartzog advised Commission of Flood Plain Management Heeting in San
Antonio in July. Asked if anyone on the Commission would like to attend
this meeting, would have more information next meeting.

Commission was advised of plans to put Go-Carts in at Goofy Gulf. The
plan is to close one of the courses and use the rest of the area as the
track. Zoning ordinance could not stop this business and the nuisance
ordinance could not stop construction plans. Commission recommended the
owner be advised of the nuisance ordinance and complaints could make it
necessary to close the Go-Cart Track.

mendation to name the second street in Greenfield III as ~Cyrus
Me Co rm i c k" .
