06-28-1983 t. e e ~e , , PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in Regular Session on Tuesday, June 28, 1983 at 7:00 PM, in the Conference Room of the Municipal Complex, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION John Linebarger, Chairman Ken Greenwald, Vice-Chairman Clay McMahan, Secretary Merwi n Wi 11 man Ray Stanhope Lee Boswell Cam Beauchemin CITY STAFF Earl Hartzog, Planning and Zoning Coordinator OTHERS PRESENT Mrs. Hopkins #L CALL TO ORDER Chairman Linebarger called the meeting to order at 7:00 PM. #2 READING OF MINUTES: Regular Meeting June 14, 1983 Mr. Willman noted Item #5, second sentence should be amended to read: "The variances on (1) len th of cul-de-sac; (2) turnin circle radius; (3) building on zero lot line; 4 size of lot frontage of 70 feet with a minimum of 20,000 square feet, which were previously approved, were revi ewed" . After a short discussion, it was agreed the variances should be in- cluded in the minutes. Mr. Willman made a motion to accept minutes as amended, Ray Stanhope second the motion and vote was unanimous in favor. #3 CONSIDER AND TAKE APPROPRIATE ACTION: Lot 8, Block 1, Freeway Manor Variance for 2 Mobile Homes on One Residential Lot After a lengthy discussion, the legality of the Plat, no streets, curbs. gutters, sewer, sidewalks, and other amenities in the subdivision and responsibilities for providing these utilities, a motion by Ray Stanhope was made to deny request for variance to authorize 2 mobile homes on single lot. Lee Boswell second and vote was unanimous in favor. Mrs. Hopkins was advised of Commission decision and she could appeal to Council. t. e - .e PLANNING AND ZONING MINUTES, DATED: 6-28-83, PAGE 2 .. Chairman Lingebarger asked for a letter to be sent to Council advising them of our decision and reason. Reason as follows: (a) Zoning Ordinance, Appendix "A", Page 47, authorizes mobile homes only in a Mobile Home District. (b) Zoning Ordinance, Article II, Section 5.2, Page 4, there shall not be more than one residential dwelling on a lot on a duly recorded plat. (c) Zoning Ordinance, Article XIX, Section 2.2.2, Paragraph 3, Page 27, granting request would create an incompatible use difference from surrounding property and would be considered spot zoning. Chairman Linebarger, after more discussion, asked for;7the City Staff to obtain a legal interpretation: (1) is the plat still legal; (2) can the City go back and force the developer to put in streets, curbs, gutters, sewer, water, sidewalks and other amenities into the subdivision. He also asked for the City Staff to identify other property purchased after annexation have same problem. #4 CONSIDER AND TAKE APPROPRIATE ACTION: Model Home Northcliffe Community Variance on Lot Size and Lot Variance The Commission was provided a letter asking for a lot size variance for a Model Home Area in Northcliffe to build zero lot line Garden Homes on 37 foot by 90 foot, 3,300 square feet. After a short discussion about already approving these types of homes in another area in Northcliffe, the Members felt the Model Home Area should be in the same location. A motion was made by Ken Greenwald to deny request for variance. Ray Stanhope second and vote was unanimous in favor. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Subdivision Ordinance Review Each member on the Commission was provided a copy of a Proposed New Subdivision Ordinance. Mr. Willman and Earl Hartzog had taken the ordinance proposals by TML and the current Subdivision Ordinance and combined them into one. The Members were advised of major changes and identified problem areas, and decision would need to be made to some items. The Subdivision Ordinance should be put on the Agenda and the Commission would review each page together at the next meeting. Chair- man Linebarger asked each member to look over the proposed ordinance and be prepared to discuss it at the next meeting. #6 GENERAL DISCUSSION Earl Hartzog provided the Members with a copy of the letter from Home- craft pertaining to the ball park shown on the Master Plan. The letter released the City from the responsibility to include a ballfield as part of the final plat for Northcliffe Community Section 5. The Commission was advised the ball park was never included on a recorded plat. The ball park is an item the Homeowner needs to take up ~i~h Homecraft. The Commission was advised it would be overstepping its' authority to become involved in the issue of the ballfield. Chairman Linebarger asked for this item to be placed on the Agenda for the next meeting. Earl Hartzog advised the Commission that a letter was received from Homecraft's Engineer, asking for approval of underground electric, telephone and cable TV in the street Right-of-Way, for Northcliffe East Community Section III and IV. The Commission was advised that the City Staff was looking into this item and should have a recommen- dation for the next meeting. Chairman Linebarger asked for input from the City Utility Department. The Commission was advised the City Utility did not recommend this item be approved. The City Utility Department felt it would be dangerous and someone would get hurt if the utility lines were in the street right-of-way. Chairman Linebarger asked for this item to be placed on the Agenda for the next meeting and asked for more information from GVEC on the location of the meter and anything else if all utilities were in the street right-of-way. The Commission was advised of a one-day Flood Plain Management Meeting in San Antonio on July 19th. The City Inspector, Earl Hartzog and Mr. Willman plan thur far to attend this meeting. The Commission was advised Don Decker had a new location for his condominiums. He plans to put a minor street through the site and has asked for an opinion on an idea to have .pull in and back out parking directly along the minor street. The Commission did not go along with the idea and felt the length of the cul-de-sac was to long. The Commission Members commented on the cleaning of Cibolo Creek taking place, thus far the project looks great. It was recommended a letter be sent to the City Staff when the project is completed. #7 ADJOURNMENT Chairman Linebarger adjourned the meeting at 10:08 PM.
