07-12-1983 ., e e .e PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in Regular Session on Tuesday, July 12, 1983, 1983 at 7:00 PM, in the Conference Room of the Municipal Complex, 1400 Live Oak Road. Cam Beauchemin CITY STAFF Earl Hartzog, Planning and Zoning Coordinator OTHERS PRESENT Ray Wi ltshi re Jim Migloria Billy Timberlake #1 CALL TO ORDER John Linebarger, Chairman, called the meeting to order at 7:00 PM. #2 READING OF MINUTES: Regular Meeting June 28, 1983 Lee Boswell made motion to accept minutes, Merwin Willman second the motion and vote was unanimous in favor. #3 CONSIDER AND TAKE APPROPRIATE ACTION: Northcliffe Community East Model Home Park Variance on Lot Size (37'x 90') Ray Wiltshire explained purpose of centrally locating the Model Home Park; justifying lot variance request for 37' x 90' lots in the Model Park. The plan was to build 3 units and, if the selling went well, they had plans to build 4 additional units. After a short discussion, Merwin Willman motioned to grant variance for Lots 5, 6, 7 only (shown on the Model Home Layout Plan). Ken Greenwald seconded and vote was unanimous in favor. \ J e e . e PLANNING AND ZONING MINUTES, DATED: July 12, 1983, PAGE 2 #4 CONSIDER AND TAKE APPROPRIATE ACTION: Northcliffe Community Section 5 Preliminary Plat Approval Conditions (Ballfield) Letter from Homecraft released. City from liability of ballpark. Ray Wiltshire advised the Commission of a new location being platted. to dedicate a ballpark, and it would have an area for parking. After a short discussion about requirements for developers providing park land and the constitutionality of this past requirement, item was closed. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Fence Ordinance The Commission was provided a copy of a complaint letter and the City Managers' input to Council on fence at 1409 Chestnut. Mr. Timberlake expressed his views relative to his complaint and asked several questions regarding the City Ordinance. He was advised that based on current ordinance, the fence is legal and if ordinance is changed, it would not apply to this fence. The Commission was given a list of current ordinances pertaining to fences and a recommended fence ordinance. After a lengthy discussion the item was tabled. Planning and Zoning Members were asked to view the fence in question. #6 CONSIDER AND ~KE APPROPRIATE ACTION: Subdivision Ordinance Review ffie Commission reviewed through Section 12 of the Proposed Subdivision Ordinance. Some definitions were changed and some question of Flood Plain requirements need to be checked with the City Engineer. The definition of a "structure" was added to the proposed ordinance. A sentence was added to the variance, to require formal application on variance request. The Commission agreed to allow an option to set a time limit on variances. #7 GENERAL DISCUSSION Earl Hartzog advised the Commission that three developers have asked for permission to place all utilities in the street right-of-way. All utility companies have been contacted to provide input for the July 26th meeting. The Commission was advised the City Engineer recommends approval and it would eliminate the open easement in the rear of property. The Commission was advised the City Public Works was against the proposal, because of the increased chance of coming in contact with electrical wires. The Commission was provided a list of Bills relating to Planning, passed by the 1983 Texas Legislature. A list of Bills that failed were provided. It was noted the bill to prohibit City Limitations on Mobile Home was one of those that failed to pass. . , ' I .. e e .e PLANNING AND ZONING MINUTES, DATED: July 12, 1983, PAGE 3 Earl Hartzog advised the Commission about findings on requirements for mail delivery in new subdivisions. The Post Office wants clustered mail boxes. The Commission agreed to identify in the subdivision ordinance that developers should contact the Post Office to determine requirements for mail delivery in any new development. The Commission was advised Greenfield Unit 3was just about completed and wanted to check on procedures to be followed on identifying required traffic control signs required. The Members agreed this was not the Commissions' responsibility to identify required traffic control require- ments in new areas, but is was recommended stop signs should be placed at the two streets in question and speed limits be established, commensurable with other sections of the City. It was noted the traffic signs in Oak Forest lI~ have not been identified. Merwin Willman advised the Commission on Mrs. Hopkins and Freeway Manor. Council had disapproved Mrs. Hopkins request to place two mobile homes on her lot in Freeway Manor. Mr. Willman provided a proposed letter to be sent to TML, asking question about theCitys' responsibility for utilities and streets in this subdivision. The Commission agreed the letter should be sent, in order to find out the Citys. legal position. There was a discussion on Certificate of Occupancy. Earl Hartzog advised the Commission Don Brodeur, Assistant City Inspector, had checked this item out. City Ordinance No. 79-$-15, Section 21-22, appears to be adequate. Better controls need to be established to ensure Certificate of Occupancy is obtained on new business. On new buildings the Certificate of Occupancy should be inCluded in the cost of the Building Permit. The only recommended change is the possibility of increasing the fee. The present fee is $5.00 which probably pays for gas and paper work, item closed. #8 ADJOURNMENT Chairman Linebarger adjourned the meeting at 9:35 PM. *
