ORDINANCE NO. i 3
AN ORDINANCE RELATING TO THE EXPENDITURE OF CERTAIN
OF THE BOND PROCEEDS TO BE DERIVED FROM THE SALE OF
CITY OF SCHERTZ, TEXAS, WATERWORKS AND SEWER SYSTEM
REVENUE BONDS, SERIES 1963; CONTAINING OTHER PROVI-
SIONS RELATING THERETO; AND PROVIDING THAT THIS ORDIN-
ANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER
ITS ADOPTION

The City Council of the City of Schertz, Texas, convened

session at the regular meeting place thereof within
said City on the 22nd day of March, 1963, with the following mem-
bers present, to-wit:

when the following, among other business, was transacted, to-wit:
The Mayor introduced an ordinance which was read in full.
Alderman #1> In III" made a motion that the ordinance be adopted as
read. Alderman t?<!lI S /,y seconded the motion for adoption of said

ordinance. The motion, carrying with it the adoption of the ordi-
nance, prevailed by the following vote:
AYES: Aldermen Ikels, Beck, Bolton, Ebert,
Cosby, and Mayor Richard.
NOES: None.
The Mayor thereupon announced that the motion had duly
and lawfully carried, and that the ordinance had been duly and law-
fully adopted. The ordinance thus adopted follows:

AN ORDINANCE RELATING TO THE EXPENDITURE OF CERTAIN
OF THE BOND PROCEEDS TO BE DERIVED FROM THE SALE OF
CITY OF SCHERTZ, TEXAS, WATERWORKS AND SEWER SYSTEM
REVENUE BONDS, SERIES 1963; CONTAINING OTHER PROVI-
SIONS RELATING THERETO; AND PROVIDING THAT THIS ORDIN-
ANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER
ITS ADOPTION
WHEREAS, the City of Schertz, Texas, is in the process
of issuing $300,000.00 CITY OF SCHERT~, TEXAS, WATERWORKS AND
SEWER SYSTEM REVENUE BONDS, SERIES 1963, dated February 1, 1963,
for the purpose of purchasing a privately-owned waterworks system
which serves the inhabitants in and in the vicinity of said City,
and improving and extending said waterworks system; and
WHEREAS, such privately-owned waterworks system is owned
by Schertz Water Works, Inc., and the City is in the process of
purchasing said system (with the exception of certain properties
of said system which are located within the boundaries of Universal
City, Texas); and
WHEREAS, the purchase price of said waterworks system has
been agreed upon between said City and the Schertz Water Works, Inc.,
as $256,500.00; and
WHEREAS, the City is also in the process of purchasing
certain tracts of land located within said City of Schertz, Texas,
for the purpose of improving and extending said waterworks system;
and
WHEREAS, said tracts of land are owned by Walter A. Schertz
and wife Lula Mae Schertz, Helen Schertz Rowell and husband Russell
G. Rowell, and Frances Schertz Classen and husband Udo H. Classen;
and
WHEREAS, the purchase price of said tracts of land has
been agreed upon between said City and the owners named above as
$12,000.00; and

WHEREAS, said sums of $256,500.00 and $12,000.00 will
be paid by said City with like amounts of the proceeds to be de-

rived from the sale of the bonds mentioned above; and
WHEREAS, the City Council wishes to confirm the amount
of each purchase price mentioned above, to authorize the distribu-
tion of the sum of $268,500.00 (out of the bond proceeds) to the
sellers mentioned above in the respective indicated amounts, and
to authorize and direct the Mayor and City Secretary to do any and
all things necessary and/or convenient to consummate the purchase
of said waterworks system and said tracts of land; Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS:
Section 1: That the matters and facts set forth and re-
cited in the preamble to this ordinance are hereby found and de-
clared to be true and correct.
Section 2: That the purchase price to be paid by the
City of Schertz, Texas, to Schertz Water Works, Inc., for the water-
works system properties of said Corporation which are to be purchased
by said City is hereby found and declared to be $256,500.00.
Section 3: That the purchase price to be paid by the City
of Schertz, Texas, to
Walter A. Schertz and wife, Lula Mae Schertz,
Helen Schertz Rowell and husband, Russell G.
Rowell, and Frances Schertz Classen and husband,
Udo H. Classen,
for the tracts of land owned by such parties which are to be pur-
chased by said City is hereby found and declared to be $12,000.00.
Section 4: That of the proceeds to be derived by said
City from the sale of its $300,000.00 CITY OF SCHERTZ, TEXAS,
WATERWORKS AND SEWER SYSTEM REVENUE BONDS, SERIES 1963, dated
February 1, 1963, the sum of $268,500.00 is to be distributed as
follows:

$256,500.00 is to be delivered to Schertz Water
Works, Inc., as the purchase price of the water-
works system properties mentioned above, and
$12,000.00 is to be delivered to Walter A.
Schertz and wife Lula Mae Schertz, Helen Schertz
Rowell and husband Russell G. Rowell, and
Frances Schertz Classen and husband Udo H.
Classen, as the purchase price of the tracts of
land mentioned above.
Section 5: That the Mayor and the City Secretary of
said City are hereby authorized and directed to do any and all
things necessary and/or convenient to consummate the purchase of
said waterworks system properties and said tracts of land, in-
cluding the distribution of the moneys mentioned above.
Section 6: That this ordinance shall be in full force
from and after its adoption.
PASSED AND APPROVED this 22nd day of March, 1963.
