ORDINANCE NO. 130A '<, AT:lo 1-4-l-1 8-26-65 " ~ . . AN ORDINANCE 130A CALLING A SPECIAL ELECTION IN THE CITY OF SCHERTZ, TEXAS, PURSUANT TO SECTIONS 5 AND 16 (a) OF THE URBAN RENEW1'IL LAW OF TEXAS, AND PROVIDING FOR THE FORM OF NOTICE THEREOF AND THE FORM OF BALLOT FOR USE IN SAID ELECTION WHEREAS, pursuant to a resolution duly adopted on the 1st day of July, A.D.,.1965, and a notice duly published in accordance therewith, the City Council of the City of Schertz, Texas, on the 9th day of September, A.D., 1965, met and held a public hearing on the question of whether or not it will order an election, as required by the Urban Renewal Law of the State of Texas, to determine if the City Council should adopt a certain resolution under said law, substantially in the form set forth in the form of notice contained in Section 4 hereof; and WHEREAS, after due consideration of said question and of the matters presented at said public hearing, the City Council has determined to call said election; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: section 1. In accordance with the provisions of the Urban Renewal Law of the State of Texas, including sections 5 and 16 (a) thereof, a special election within the corporate limits of the City of Schertz, Texas, is hereby ordered to be held on the 16th day of October, 1965, to determine Whether the City Council should adopt a resolution substantially in the form set forth in the form of notice contained in Section 4 hereof. Section 2. Only legally qualified voters residing within the corporate limits of the City of Schertz, Texas, owing taxable property within the boundaries thereof, who have duly rendered the same for taxation, shall be entitled to vote at said election. Section 3. Except as otherwise provided herein, said election shall be held and conducted during the hours and in the manner and the ballots cast shall be canvassed and the returns made and the results declared, all substantially as required by the applicable provisions of the Constitution and laws of the State of Texas pertaining to city elections and with respect generally to special elections in said city. Section 4. City Secretary is hereby authorized and directed to cause to be given, in the manner required by the applicable pro- visions of the laws of the State of Texas, and the ordinances of the City of Schertz, Texas, with respect. generally to special elections in said city, at least thirty (30) days notice of the special election herein ordered. It is hereby found and deter- mined that one or more slum or blighted areas exists in the City of Schertz, Texas. 'Section 2. It is hereby further found and determined that the rehabilitation, conserva- tion, or slum clearance and redevelopment, or a combination thereof, of such area or areas is necessary in the interest of public health, safety, morals or welfare of the residents of such city. 'Section 3. It is hereby further determined that the city of Schertz, Texas shall exercise the powers granted to the City by the Urban Renewal Law of the State of Texas, except the Urban Renewal Project Pow~rs as defined in said Urban Renewal Law~ 'Section 4. It is hereby further determined to be necessary and in the public interest that the City of Schertz, Texas elect, and accordingly the City hereby elects, to have said Urban Renewal Project Pow~rs exercised by the Urban Renewal Agency of the City of Schertz, Texas, which Agency is created by said Urban Renewal Law. Texas. , v ~ ,G TO THE CITIZENS OF SCHERTZ: On Saturday, October 16, if you are a property owner and tax payer of Schertz, you will have the opportunity to vote on a referendum as to whether or not we should enter into a Urban Renewal Program in our community. A public hearing was held last September 9 on this subject. In the event that you were not pre- sent at that meeting, I wish to take this occasion to discuss the issue with you. For many years the citizens of Schertz have felt the need to improve our community by fixing our streets and drainage, and rehabilitating our substandard housing. We have tried to do this with our own resources but the bond issue necessary to do the work was defeated. Now comes an opportunity, through Urban Renewal, by which Schertz can accomplish its objectives with considerable financial aid from the U.S. Government. There are many advantages in this program; the enclosed questions-and-answers will give you some of the facts. Numerous large and small cities in the United States have taken advantage of this federal program to upgrade their housing and environmental facilities. We think that it is time for Schertz to become one of these progressive co~~unities and enter into this important and far-reaching program. I hope you will agree with me and vote YES on the referendum on October 16. Sincerely, Roy W. Richards, Mayor W / o TEN QUESTION & ANSWERS ON URBAN RENEWAL 1. What is urban renewal? Urban renewal is the term used to describe the official program of a community to improve itself through the elimination of slums and blight and the removal of the cause of slum and blighted areas. Urban renewal is a locally planned and executed community-wide improvement program, using public and private resources. Through it a city seeks to re-fashion and rebuild its physical plant along modern lines, so that it can cope more successfully with the many problems of this industrial age. 2. Is urban renewal the same as slum clearance? Not necessarily. Urban renewal may include clearance, but it is much more. It is systematic improvement according to a plan for the entire community. It includes conservation of neighbor- hoods, repair and modernization of individual buildings, and installation of necessary public improvements. 3. ~fuat is the U. S. Government's role in urban renewal? Federal assistance is available to help a community carry out its urban renewal program. Congress has provided for loans, grants, and technical assistance to communities, and special mortgage insurance for housing related to urban renewal activities, making possible a partnership among local and State governments, private enterprise, citizens, and the Federal Government to attack slums and the causes of urban blight. Federal assistance for urban renewal includes, but not limited to the following forms: ~ - 3 - Cost spent by the local government on utilities, schools, parks, etc. can be credited toward its 1/4 share of the financing. 6. Does Schertz expect to have total slum clearance? The urban renewal projects anticipated for Schertz is of rehabilitation nature. That is to say, to fix up the en- vironmental deficiencies that caused some of our houses to run down, as well as to fix up our run-down Houses and buildings. 7. Will the entire City of Schertz be benefited? Yes, It is expected that, through a series of projects, the major portion of Schertz will eventually be benefited. 8. Will urban renewal require a bond issue or increases in City Taxes? The first project can be financed without a bond issue or tax increase. This is because the City of Schertz expects to have enough credit generated out of previous public works and future school projects. Neither bond issue or tax increase will be required. 9. Why is a referendum vote needed? texas State law requires that before a community proceeds with plans for urban renewal, its citizens must express themselves whether they are in favor of this program. 10. Are other cities doing urban renewal? Yes. Numerous cities, large and small, allover the country has taken advantage of this program. Federal assistance comes from our taxes. We should get our share for the City of Schertz. ~ - 2 - a. Grant assistance for the preparation of full-range renewal programs on a community-wide basis, including the identification of needs, estimates of financial, rehousing and other resources, and programming of urban renewal projects and activities. b. Loan and grant assistance for planning and carrying out urban renewal projects involving the rebuilding or con- servation of blighted and deteriorating urban areas. c. Special FHA mortgage financing aids for new or rehabi- litated housing in the redevelopment of urban renewal project areas. 4. What is the local government's role? Urban renewal projects are carried out by a local agency. It is not a part of the Federal Government. This local agency initiates, plans, and carries out local urban renewal programs. However, all urban renewal activities in a city are under the effective control of the city councilor other governing body. The Urban Renewal Administration provides technical and financial assistance and sees to it that the local decisions are made in accordance with local, State, and Federal laws, and administrative requirements. 5. How is an urban renewal project financed? Advances may be made by the Federal Government through the Urban Renewal Administration to localities to finance surveys and plans which ~ust be made before a project is undertaken. When a project has .been approved, the locality may obtain a loan-and-grant up to 3/4 of the expenses needed to finance the redevelopment.
