PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning ~ommission and- City Council
conducted a Joint Public Hearing on Tuesday, April 18,1989 at
7:00 P.M. in the Municipal Complex Council Chambers, 1400 Schertz
Parkway. Those ppesentwere as follows:-

#1 CALL TO ORDER
Mayor Sawyer called the meeting to order at 7:00 P.M.
Mr. Sawyer proudly acknowledged all the library volunteers and
told them how happy he was to see them at the meeting. A Special
Award was presented to David Arneson, a volunteer associated with
the library extension project.
After the Special Award presentation, Councilman Aguilar
indicated to those present that he doesn't think they fully
appreciate all the time the volunteers devote to the library
besides attending meetings.
At this time, due to the fact that the first item scheduled for
the public hearing was a request from him, Mayor Sawyer turned
the meeting over to Mayor Pro Tern Adolph Aguilar.
Mayqr Pro Tern Aguilar announced there are two items on the agenda
for the joint public hearing - the request from Earl Sawyer and
the acceptance of the new zoning map. Mr. Aguilar then turned
the meeting over to Planning and Zoning Chairman Ty Brisgill.
Chairman Brisgill explained the rules of procedure that would be
used for ~he public'hearing.

'2 PUBLIC HEARING: Exception to Zoning Ordinance (ZC #92)
To receive citizens' comments on the request .from Earl W. Sawyer
for an exception to the Zoning .Ordinance, permitting a variance
to the side yard setback at 512 Aviation.
steve Simonson gave a .brief presentation saying letters had been
sent to all the property owners within 200 feet of 512 Aviation.
Mr. Simonson reported that 19 letters had been sent, 7 were
returned indicating they were in favor of the request from Mr.
Sawyer.. and none returned indicating opposition to the request.
Mr. Simonson further stated that among the 7 letters returned in
favor 'of the request from Mr. Sawyer were a. letter from the
neighbor on each immediate side (510 and 514 Aviation) expressing
their approval. Mr. Simonson also noted there are several
carports in the area.
Chuck Sharpe of 1200 Antler Drive spoke at this time. Mr. Sharpe
reminded the Council and the Commission that they had recently
passed several ordinances aimed at making Schertz a neater and
cleaner place in which to live and asked them to envision the
City if everyone were to build a carport.
Councilman Baldwin, referring to a statement in the request
submi tted by Mr. Sawyer, commented he takes exception to the
remark about removing an existing valuable tree if the exception
is not granted. Mr.' Baldwin said he had driven by the property
and the valuable tree referred to by Mr. Sawyer is a stump.
Councilman Hartzog asked if a similar exception had ever been
granted.
Bob Andrews replied that Billy Linehan on Brooks had been granted
an exception. Mr. Andrews also mentioned a carport at a house in
the 700 Block of Pecan.
Councilman Baldwin observed there are a proliferation of carports
in the City that have been put up without the homeowner coming in
and obtaining a permit and at least the Mayor is going through
proper channels.
Councilman Hartzog asked if any similar exceptions had been
granted in the last six months and if Mr. Linehan's carport was a
new one. Bob Andrews replied there were none granted in the last
six months and that Mr. Linehan's carport was not new.
Councilman Hartzog then questioned if there were any similar
exceptions granted previous to the last six months. Bob Andrews
said he could not recall any, but there may. possibly have been
some before his tenure on Planning and Zoning~
Ste~e Simon~on informed the ~ou~cil that. in 1986, Mr; Kendall of
605 . Brooks; was granted an exception, of. 2 feet into the 7 feet
side. yard. setback requirement, for a house extension.

Councilman Hartzog asked if. Mr. Sawyer' s proposed carport will
hand 'down on the side and extend over the property lirie. steve
Simonson replied that according to his interpretation of Mr.
Sawyer's plans, the carport appears to have a flat roo~.
Counc:ilman Hartzog asked again if there had been any similar
exce~tions granted in. the past. Chairman Brisgill remarked there
had been one in Greenshire Oaks and one in Savannah Square, but
Merwin Willman pointed out these had not been for carports.
There was no further discussion on Zoning Change #92.
#3 PUBLIC HEARING: Acceptance of New Zoning Map (ZC #93)
To receive citizens' comments on the acceptance of the new zoning
map.
Chairman Brisgill thanked Steve Simonson, Merwin Willman and Ford
Engineering for their efforts in putting together the new map and
said they have given the City of Schertz a zoning map to be proud
of.
steve Simonson gave a brief presentation saying th~'old map did
not show the Shirmerville area and"there were some hard to define
areas that were on the old map with magic marker. Mr. Simonson
said they researched several areas and, if Council recalls, held
a public hearing on the reconfirmation of the zoning of 850 plus
acres. Mr. Simonson further stated the new map is very accurate
and in the case of further changes, Ford Engineering can turn out
stick-on composites which are easy to put on the map for the
purpose of updating it.
Chuck Sharpe of 1200 Antler spoke at this time and urged approval
of the new zoning map. Mr. Sharpe said it is evident a lot of
hard work has gone into the map by Steve Simonson, Merwin Willman
and Ford Engineering and he thinks it will help sell the City of
Schertz.
Mayor Pro Tern Aguilar remarked on how easy the new map is to read
because of the different colors denoting various zonings and
stressed this had been needed for a long time.
Mary Marsh voiced the opinion that this new zoning map together
with a very good Comprehensive City Plan would definitely put
Schertz in the list of top cities in Texas having an excellent
marketing tool for future economic development.
There was no further discussion on Zoning Change #93.

Chairman Brisgillturned the meetin;g back over to Mayor Pro Tem
Aguilar who adjourned the public hearing at 7:19 P.M~
The Schertz Planning 'and Zoning Commission convened in a Special
Session, after the Joint Public Hearing, in the Municipal Complex
Conference Room.
16 CALL TO ORDER
Chairman Brisgill called the meeting to order at 7:22 P.M.
#7 CITIZENS' INPUT, OTHER THAN AGENDA'ITEMS
There was none.
"8 CONSIDER AND MAKE RECOMMENDATION: ZC #92
Mary Marsh remarked she thought they had a good discussion about
this and didn't just give it the rubber stamp because it was a
request from the Mayor.
George Vick indicated the Commission should to take a look at the
Zoning Ordinance as it stands to see if, perhaps, it needs to be
changed.
Bob Andrews made a motion to recommend to City Council approval
of the request from Earl Sawyer for an exception to the Zoning
Ordinance, permitting a 6'6" variance to the side yard setback at
512 Aviation. Joe Potempa seconded the motion.
Before the vote, Merwin Willman interrupted to say he would like
it understood the carport will not be enclosed after it's built.
Chairman Brisgill wasn't sure Planning and Zoning

19 CONSIDER AND MAKE RECOMMENDATION: ZC #93
Bob Andrews commented that all the input about the new zonlng map
had been positive.
Bob Andrews made a motion to recommend approval to City Council
of the acceptance of the new zoning map. Mary Marsh seconded the
motion and the vote was unanimous in favor. Motion carried.

110 GENERAL DISCUSSION
Merwin Willman brought up the following:
(a) In the "Guidelines for Changing Street N~mes Within the City
of Schertz" he noticed a statement about a publ ic hearing for
both Planning and Zoning and City Council. ~r. Willman's opinion
was that separate public hearings are an added cost.
Chairman Brisgill said Councilman Baldwin had requested it that

Mary Marsh concurred with Merwin Willman's opinion on added cost.
steve Simonson informed the Commission the City Manager had
insisted on separate public hearings.
After more discussion on the added cost, Chairman Brisgill
commented Planning and Zoning has made it's recommendations and
City Council has made theirs.
Bob Andrews added that it can always ge changed if Council
decides they don't want it that way.
(b) Said he had received a reply from the fifth city, which was
Arlington, Texas, and showed the Commission a copy of Arlington's
Comprehensive Plan. ,Mr. Willman commented it was an APA award
winning plan.
Mr. Willman also told the Commissioners that they were welcome to
read over any of the replies and plans he had received from other
cities.
(c) Mentioned that

(a) Asked if Jim Shriver had a report on the input from the
businesses on the Sign Ordinance. (steve Simonson said he should
have it by the meeting on the 25th.)
(b) Al so on the subject of signs, Mr. Vick had brought in a
newspaper picture of "garage sale" signs. Merwin Willman noted
that the ordinance doesn't specifically cover "garage sale"
signs.

Bob Andrews expressed the opinion that if he saw the police
pulling up' "garage sale" signs he would be very irate - he ,does
not think- it is their '~esponsibility to do this.
(c) Stated that the approval of the new zoning map behooves all
the Comm-issioners to review it well, and if they do see anything
that is in error, bring it to the attention of steve S~monson.
Joe Potempa reported to Steve Simonson there is a ~ed stretch van
and a blue and white pick-up truck at 5300 Plaza Drive that have
no license plates. Mr. Potempa said he had notified the Police
Department.
Bob Andrews said he assumed that GVEC had gotten a permit for
their portable sign announcing an open house.
Mary Marsh commented on two vehicles in the City being used as a
means of advertising, one across from the boot store and the
other across from the liquor store.
Chairman Brisgill complained that Garden Ridge Closeouts has
several banners and a Negley Paint discount sign at their
business and he sees no excuse for this violation of the Sign
Ordinance. Mr. Brisgill further stated they should be familiar
with the ordinance, especially since Planning and Zoning had
already granted them an exception for their original sign.
Steve Simonson brought up the following:
(a) Reported that the Inspection Department has gone out to every
business with streamers and extra signs and requested they pull
them down. Mr. Simonson said some of the businesses have
cooperated, others are fighting it and the letters of
notification have been sent.
(b) Stated further that the Inspection Department is patrolling
various areas of the City, as they have time, to determine where
notifications should be sent regarding the removal of trash and
weeds.
(c) Had checked on the new billboard going up next to San Antonio
Machine and discovered they are redoing an old billboard. Mr.
Simonson said they had not obtained a permit, so the City is
trying to track them down.
Merwin Willman asked if there isn't something ln the ordinance
about redoing 50% of an existing sign.
Bob Andrews replied he, thought it said if they are redoing more
than 50%, then they are' required to obtain a permit as if it were
a new sign.
