A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING
PURSUANT TO THE PROPOSED ANNEXATION ON 1121.56 ACRES
OF LAND OUT OF GUADALUPE AND COMAL COUNTIES.
WHEREAS, the City Cdunci1 of the City of Schertz, Texas
desires to institute annexation proceedings concerning the territory
described herein, and
WHEREAS, in accordance with Section 6, Article 970a,
Vernon's Texas Civil Statutes, a public hearing is required, NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

That a public hearing is hereby scheduled for 7:00 P.M.
May 15, 1979, to be held in the Council Chambers of the Municipal Building,
1400 Live Oak Road, Schertz, Texas, to obtain the views of the public
concerning the proposed annexation of the following territory;

TRACT #1
Beginning at a point in the City Limits of the City of Schertz,
said point being the intersection of the East right-of-way line
of FM 3009 and the North boundry line of the Guadalupe County
,Joint Venture 206.6 acre tract;
Thence South 590 53' \^lest 120' to a point in the West
right-of-way line of FM 3009;
Thence North 300 13' West 1750' (more of less) to a
point in the West right-of-way line of FM 3009, said
point being an extension of the Southeast property
line of the Coy Simmons 33.314 acre tract;
Thence North 590 16' East 120' to a point in the East
right-of-way line of FM 3009;
Thence continuing North 590 16' East 20' to a point,
said point being the Southeast corner of the Coy
Simmons 33.314 acre tract;
Thence continuing North 590 16' East 730' to a point i
in the Southeast property line of the Coy Simmons 33.314
acre tract;
Thence South 300 13' East 1750' (more of less) to a
point, said point being on the Northwest property line
of the Guadalupe County Joint Venture 206.6 acre tract;
Thence South 590 53' West 750' along the Northwest
property line of the Guadalupe County Joint Venture
206.6 acre tract to the point of beginning and con-
taining 34.95 acres.

Beginning at a point in the City Limits of the City of Schertz, which point
is the intersection of the East right-of-way line of FM 3009 and the North
right-of-way line of Crest Oak;
THENCE, North 290 361 West, 2,108.61 to a point being the inter-
section of the East right-of-way line of FM 3009 and the Southeast
line of the Roy Richard 18.0 acre tract;
THENCE, North 600 141 East, 750' with the Southeast line of the Roy
Richard 18.0 acre tract to a point;
THENCE, South 290 36' East, 2,108 (more or less) to a point, said
point being on the Northwest right-of-way line of Crest Oak;
THENCE South 600 081 West, 750' along the Northwest right-of-way
line of Crest Oak to the point of beginning and containing
36.29 acres.

Beginning at a point in the City Limit Line of the City of
Schertz, Texas which is the point of intersection of a CUT-
OFF in the North line of IH 35 and the East line of Lookout
Road;
Thence North 300 08' West, 3620' (more or less)
with the East right-of-way line of Lookout Road
to an angle in Lookout Road;
Thence South 600 West, 100' (more or less) to a
point, being the intersection of the North right-
of-way line of Lookout Road and the West line of
the Clarence Dolle tract;
Thence North 310 30' West, 380' (more or less)
along the West line of the Clarence Dolle tract
to a point;
Thence North 600 East, 2330' (more or less) with
the City Limits of the City of Schertz to a point;
Thence South 300 East, 2640' with the City Limits
of the City of Schertz to a point;
Thence North 600 East, 2640' with the City Limits
of the City of Schertz to a point;
Thence South 300 East, 1265' (more or less) with
the City Limits of the City of Schertz to a point,
said point being in the North right-of-way of IH 35;

Beginning at a point in the City Limits of the City of
Schertz, said point being the intersection of the West
right-of-way line of FM 3009 and the North right-of-way
line of the Missouri, Kansas and Texas Railroad;
Thence South 620 18' West, 3,000' (more of less)
to a point;
Thence North 300 West, 450' (more of less) with
the City Limits line to a point, said point be-
ing a corner in the City Limits of the City of
Schertz;
Thence continuing North 300 West, 2400' (more or
less) to a point of intersection with the North
right-of-way line of the Missouri Pacific Rail-
road;
Thence North 670 58'30" East, 3960' (more or
less) along the North right-of-way line of the
Missouri Pacific Railroad crossing the center
line of Old Doerr Lane at 750' (more or less)
and the center line of FM 3009 at 3116' (more
or less);
Thence South 300 06' East, 4480' (more or less)
to a point in the North City Limits of the City
of Schertz;
Thence South 600 West, 980' (more or less) along
the City Limit line of the City of Schertz to a
point in the West right-of-way of FM 3009;

Thence: 346.33' along a curve to the left (whose
chord bears North 260 44' West, 346.28') having a

right-of-way line of the Missouri, Kansas and

Beginning at a point in the City Limits of the City of Schertz,
said point being the intersection of the North right-of-way

TO THE CITY OF SCHERTZ:
PETITION OPPOSING ANNEXATION
We, the undersigned real property owners, from Guadalupe and Comal
Counties, owners from Tract 5 and Tract 6 according to the proposed
designated map of the City of Schertz for the purpose of annexing these
tracts as well as others, strongly protest and contest the proposed
annexation by the City of Schertz for the following reasons:
1. The undersigned real property owners have never petitioned
the City of Schertz to be annexed.
2. The undersigned real property owners long prior to this
proposed annexation have had and used the facilities for fire from
Bracken Fire Station in Comal County, Texas.
3. The undersigned real property owners have long had their
own and sufficient water supply systems.
4. The undersigned real property owners have long had their
own and sufficient sanitary systems.
5. The City of Schertz could not supply and not compete with
the subject matter enumerated in Paragraphs 2, 3, and 4 aforesaid.
6. The property owners herein would receive absolutely ~
benefits from the City of Schertz by this proposed annexation and in
fact this proposed annexation would create a burden on these property
............
owners who are closer to the City limits of New Braunfels and Garden
Ridge.
7. That the acts of the City of Schertz are in violation of and
contrary to Article 970a of Vernon's Civil Statutes of the State of Texas
Annotated.
