RESOLUTION" NO. 79-R-/3
A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, REQUESTING WITHDRAWAL FROM THE ATTORNEY
GENERAL'S PROPOSED LAWSUIT AGAINST PRICING
ACTIVITIES OF CERTAIN CEMENT COMPANIES.
WHEREAS, the Attorney General of the State of Texas has
conducted an investigation concerning pricing activities of certain
cement companies across the nation; and
WHEREAS, the Attorney General intends to file suit on
September 10, 1979 under the federal antitrust laws against those companies;
and
WHEREAS, Section 15.40 of the Business and Commerce Code
grants the Attorney General the authority to represent the City of Schertz
in lawsuits brought to recover damages provided for by the federal anti-
trust laws; and
WHEREAS, The City of Schertz must approve a formal resolution
to withdraw the authority of the Attorney General to represent said city
in the proposed suit against the cement companies; and
WHEREAS, the City of Schertz' cement purchases have been
negligible since year 1970; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT the City of Schertz finds no reason to be a party to
this lawsuit and; therefore, requests the withdrawal of authority of the
Attorney General to represent the City in the proposed lawsuit.
