A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, SETTING A TIME, DATE AND PLACE FOR
PUBLIC HEARINGS PURSUANT TO THE PROPOSED
ANNEXATION OF 88.9 ACRES OF LAND, MORE OR
LESS, OUT OF COMAL COUNTY.
WHEREAS, the City Council of the City of Schertz, Texas,
desires to institute proceedings concerning the territory
described herein; and
WHEREAS, in accordance with Section 6, Article 970a,
Vernon's Texas Civil Statutes, public hearings are required, NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT a public hearing is hereby scheduled for 7:00 o'clock
p.m. Tuesday, August 20, 1985, to be held in the Council Chambers
of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas, to
obtain the views of the public concerning the proposed annexation
of 88.9 acres of land as described on the attached fieldnotes
description and map: and
BE IT FURTHER RESOLVED:
THAT a second public hearing is hereby scheduled for 7:00
o'clock p.m., Tuesday, September 3, 1985, to be held in the
Council Chambers of the Municipal Complex, 1400 Live Oak Road,
Schertz, Texas, to obtain the views of the public on the proposed
annexation of 88.9 acres of land, as described in the attached
fieldnote description and map, and made a part hereof.

PUBLIC HEARING
~ The Schertz City Council will hold a public hearing Tuesday, August 20,
1985, at 7:00 p.m. in the Council Chamber of the Municipal Complex, 1400 Live
Oak Road, Schertz, Texas. The purpose of the public hearing is to received
the views of the public concerning the proposed requested annexation of approx-
imately 88.9 acres of land being part of a 101.65 acre tract situated in the
Francisco Rodriques Survey No. 99, the J.F. Zepeda Survey No. 257, and the
C.M. Gahagen Survey No. 258 recorded in Volume 433, pages 297-299 and
Volume 433, pages 346-349 deed records of Coma1 County, Texas.

SERVICE PLAN PROVIDING FOR MUNICIPAL SERVICES
I Pursuant to H.B. 1952, Sixty-Seventh Legislature of the
State of Texas, the City of Schertz, Texas, does hereby
propose and adopt the following service plan that provides
for the extension of city services to land that adjoins the
corporate limits of the City of Schertz, Texas. Said land
being herein described by legal description and that said
land is hereby being cons1dered for annexation by the City of
Schertz, Texas; and whereby upon annexation of said land by
the City of Schertz, Texas, the plan hereby adopted '
establishes a contractual obligation between the City of
Schertz, Texas, and the registered voters that will be within
the territory herein described and proposed to be annexed by
the City of Schertz, Texas.
II This plan applies to a 88.9 acre tract of land out of Comal
County, described in the following metes and bounds:
All of that certain lot, tract or parcel of land being 88.9
acres being part of a 101.65 acre and 89.412 acres tract
situated in the Francisco Rodriques Survey No. 99, the J. F.
zepeda Survey No. 257, and the C. M. Gahagen Survey No. 258
recorded in Volume 433, Pages 297-299 and Volume 433, Pages
346-349 deed records of Comal County, Texas.
COMMENCING: At the intersection of the West right-of-way line of
Schwab Road and the Northwest right-of-way line of
Interstate Highway No. 35;
THENCE: S 59 45' W, 189.30 feet and S 53 43' W, 173.30 feet
along the Northwest right-of-way line of Interstate
Highway No. 35 to a point;
THENCE: N 30 05'58" W, 694.85 feet to the corner of the
intersection of the city limits line of the City of
Schertz established in Ordinance No. 74-A-49 and the
city limits line established in Ordinance No. 80-A-
25, said point being the POINT OF BEGINNING of the
herein described tract;
THENCE: S 59 41' 00" W, 2715.93 feet along the above
mentioned city limits line established in Ordinance
No. 80-A-25 (said line being 900 feet from and
parallel to the centerline of Interstate Highway No.
35), to a point in the Southwest bountry of the
above mentioned 101.65 acres tract;
THENCE: N 16 57'59" W, 1097.02 feet, N 60 00'00" E, 726.59
feet, and N 30 00'00" W, 793.46 feet along said
Southwest boundary of the 101.65 acres tract to a
point in the city limits line established in
Ordinance No. 74-A-49;
THENCE: N 69 38'00" E, 1764.07 feet and S 30 05'58" E,
1552.01 feet along the City limits line established
in Ordinance No. 74-A-49 to the POINT OF BEGINNING
and containing 88.9 acres of land.
III The City of Schertz, Texas, proposes and adopts the following
plan:
A. That upon installation of water and sewer lines as
required by ordinances of the City, the City will permit
those services to be used according to the general
standard and scope of those type of services furnished by
the City in other areas of the City of Schertz which have
characteristics of topography, patterns of land
utilization, and population density similar to this area
being annexed.
B. That law enforcement services, fire department services,
and emergency medical services will be provided by the
City of Schertz according to the general standard and
scope of those services furnished bh the City in other
areas of the City of Schertz which ave characteristics
of topography, patterns of land utilization, and
population density similar to this area being annexed.
C. That garbage collection service will be made available by
the City of Schertz according to the same standard and
scope of that type of service made available by the City
in other areas of the City of Schertz, Texas.
D. That all other utilities available within the present
corporate limits of the City of Schertz will be made
available to this area being annexed according to the
ca~abilities of those companies providing those utilities
an according to any agreement, contract, or franchise
that may exist between those companies and the City of
Schertz.
E. That this area being annexed and the residents thereof
are entitled to the amenities of the City of Schertz to
the equal degree of the citizens presently within the
corporate limits of the City of Schertz.
F. That the area being annexed and the residents thereof are
entitled to and shall be governed by the Charter of the
City of Schertz and all statutes, ordinances, policies
and any and all other governin~ directives that exist or
may ever exist for those resi ents presently within the
corporate limits of the City of Schertz.
G. That if this area being annexed is ever disannexed, then
only those laws, rules, regulations, ordinances and any
and all other governing directives that may apply to
areas of land wi thin the extra territorial jurisdiction
of the City of Schertz will be in effect.
H. That it is the intent of the City of Schertz to comply
with the laws of the State of Texas that relate to the
annexation of territory.
I. That the provisions of this plan will commence upon the
effective date of an approved and adopted ordinance
annexing this territory into the corporate limits of the
City Schertz.
